Rajasekhar Mantha, J.:— The matter concerns, a proceeding under Section 67/84B of Information Technology Act, 2000 read with Section 354A(1)(iv)/354D(1)(ii)/506/509 of the Indian Penal Code now pending before the court of the learned Chief Metropolitan Magistrate, Kolkata.
2. This Court attempted to try and settle the matter between the parties but the parties are not willing.
3. The settlement has not occurred. Hence, the proceeding shall go on.
4. It is submitted by the counsel for the petitioners that the police continued to summon them under Section 41A for 2 years now and yet are not able to complete the investigation.
5. In those circumstances, let the police complete the investigation within a period of 10 days from the date of communication of a copy of this order.
6. No coercive steps shall be taken by the police against the petitioners during the course of investigation.
7. The police shall also complete seizure of any documents that any parties may wish to file within the period aforesaid.
8. A final report shall be filed before the ACJM concerned within a period of 20 days from the date of communication of a copy of this order.
9. With the aforesaid directions, the revisional application shall stand disposed of.
10. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
