Heard counsel for the parties.
The relief claimed in the main writ petition was to challenge the order passed by the Sub Divisional Officer and respondent No. 2-Collector, Tikamgarh dated 19.04.2012 and 26.04.2012 respectively. By those orders, the authorities directed removal of encroachments on the land in question and nothing more.
It is common ground that the structure standing on the land, referred to in the show cause notice, which was subject matter of impugned orders, has already been removed. In that sense, the relief claimed in the writ petition is worked out and for that reason, no interference in appeal is warranted.
Counsel for the appellants, however, submits that the authorities have initiated action for cancellation of Patta. That process will have to be taken to its logical end. For, it was not subject matter of challenge in the writ petition. As aforesaid, the same will have to be proceeded, in accordance with law.
The appellants are free to participate in the said process and file their objection, if any, which will have to be dealt with by the authorities, in accordance with law.
Appeal stands disposed of accordingly.
