Smart Summary

Factual and Procedural Background

Pursuant to an earlier order dated 3 February 2017, the four accused—Pawan Kumar Gupta, Vinay Sharma, Akshay Kumar Singh and Mukesh—were directed to place affidavits before the Supreme Court of India. On the present date, counsel for the accused submitted those affidavits (both in Hindi and English translations). The Court, acting to ensure full compliance with Section 235(2) of the Code of Criminal Procedure (requirement of a hearing on sentence), reviewed the completeness of the material and issued further directions for additional information, including a conduct report from the Superintendent of Jail. The matter was adjourned to 20 March 2017 at 2:00 p.m. for receipt of the requested documents.

Legal Issues Presented

  1. Whether the affidavits submitted by the accused sufficiently address all factors—such as socio-economic background, criminal antecedents, education, physical health and prison conduct—required for a meaningful hearing under Section 235(2) of the Code of Criminal Procedure.
  2. Whether a direct report from the Superintendent of Jail regarding the accused persons’ conduct during their nearly four-year incarceration is necessary for the Court’s sentencing inquiry.

Arguments of the Parties

Submissions of the Amicus Curiae

  • Mr. Raju Ramachandran argued that the affidavit filed on behalf of Mukesh is incomplete, lacking details on socio-economic background, criminal record, family particulars, education, vocational skills, physical health and prison conduct.
  • He urged the Court to obtain additional information to fulfil the mandate of Section 235(2) CrPC.

Counsel for the Accused

  • Mr. Manohar Lal Sharma contended that although a conduct report had been sought, it had not been filed directly by the Superintendent of Jail. He undertook to file a more comprehensive affidavit for Mukesh within one week.

State’s Counsel

  • Mr. Siddharth Luthra, representing the respondent-State, stated that the State has already submitted an affidavit enclosing the Superintendent of Jail’s report.

Court's Reasoning and Analysis

The Court observed that a direct report from the Superintendent of Jail would shed essential light on the conduct of the accused during their four-year custody, a factor it considered crucial for a proper sentencing inquiry under Section 235(2) CrPC. Noting the insufficiency of Mukesh’s affidavit, the Court granted his counsel one week to supply the missing information. It maintained that the previously granted permission for counsel to visit the jail remains operative, thereby facilitating the collection of requisite data.

Holding and Implications

ORDER: The Superintendent of Jail is directed to file, in a sealed cover, a detailed report on each accused’s conduct while in custody on or before 20 March 2017. Counsel for Mukesh shall file a supplementary affidavit addressing the specified omissions within one week. The earlier direction permitting counsel to visit the jail will continue until further orders.

Implications: The order extends the fact-gathering phase to ensure the Court possesses comprehensive mitigating information before determining sentence, thereby reinforcing procedural safeguards under Section 235(2) CrPC. No new legal precedent was set; the immediate effect is limited to directing further submissions and adjournment.

Mukesh & Anr. Petitioner(S) v. State For Nct Of Delhi & Ors. (S)

    1. In pursuance of our order dated 3.2.2017, affidavits on behalf of the petitioners have been filed. Mr. A.P Singh, learned counsel has filed affidavits on behalf of the three accused persons, namely, Pawan Kumar Gupta, Vinay Sharma and Akshay Kumar Singh and Mr. M.L Sharma, learned counsel has filed the affidavit on behalf of Mukesh. Be it noted, Mr. A.P Singh, learned counsel has filed the translated version of the affidavits and Mr. Manohar Lal Sharma, learned counsel has filed the original version in Hindi as well as the translated one.

    2. At this juncture, Mr. Raju Ramachandran, learned senior counsel who has been appointed as Amicus Curiae to assist the Court, submitted that two aspects are required to be further probed to comply with the order dated 3.2.2017 inasmuch as this Court has taken the burden on itself for compliance of Section 235(2) of the Code of Criminal Procedure. Learned senior counsel would point out that the affidavit filed by Mukesh does not cover many aspects, namely, socio-economic background, criminal antecedents, family particulars, personal habits, education, vocational skills, physical health and his conduct in the prison.

    3. Mr. Manohar Lal Sharma, learned counsel submits that a report was asked for from the Superintendent of Jail with regard to the conduct of the accused persons while they are in custody, but the same has not directly been filed by the Superintendent of Jail.

    4. Mr. Siddharth Luthra, learned senior counsel for the respondent-State, would, per contra, contend that he has filed the affidavit and the affidavit contains the report of the Superintendent of Jail.

    5. In our considered opinion, the Superintendent of Jail should have filed the report with regard to the conduct of the accused persons since they are in custody for almost four years. That would have thrown light on their conduct. Let the report with regard to their conduct be filed by the Superintendent of Jail in a sealed cover in the Court on the next date of hearing.

    6. As far as the affidavit filed by Mukesh is concerned, Mr. Sharma, learned counsel stated that he will keep the aspects which are required to be highlighted in mind and file a further affidavit within a week hence.

    7. The direction issued on the earlier occasion with regard to the visit of jail by the learned counsel for the parties shall remain in force till the next date of hearing.

    8. Let the matter be listed at 2.00 p.m on 20.3.2017 The report of the Superintendent of Jail, as directed hereinabove, shall be filed in Court on that date.
