P.K Das:— The Tribunal vide stay order No. C/305/08 dated 26.9.2008 directed the applicant to deposit a sum of Rs. 3 lakhs and report compliance on 4 December, 2008. Today when the matter was called, none appeared on behalf of the applicant. There is also no compliance report in the file. In view of that appeal is dismissed for non-compliance of stay order under Section 129 of Customs Act, 1944.
