Satyawan Petitioner v. State Of Haryana & Ors. S

    Naresh Kumar Sanghi, J.

Prayer in this petition is for issuance of a writ in the nature of Habeas Corpus.

Learned counsel for the petitioner submits that the petitioner had received a call on his mobile on 12.02.2014 from the alleged detenue to the effect that she was illegally detained by her father at Kachh, Gujarat.

In compliance of the order dated 04.02.2014, respondent No. 4 Rajinder son of Tek Chand (father of the detenue) has appeared in the Court. ASI Dharamvir Singh, Police Station, Uklana, District Hisar, is also present. ASI Dharamvir Singh stated at Bar that he had a talk several times on his mobile with the alleged detenue from her mobile No. 7874872401. The detenue stated to him that she had left the company of the petitioner on account of his misbehavior. She further disclosed to him that she had gone to Gujarat with her own free will.

Respondent No. 4 Rajinder, who has been identified by ASI Dharamvir Singh, also states at Bar that the alleged detenue, i.e his daughter, is not in his illegal confinement rather she was living with the petitioner and had left his company on account of his misbehaviour. He also states that he was also worried about the welfare of his daughter.

In view of the fact that the alleged detenue is not in illegal confinement of respondent No. 4, therefore, the present petition fails and is hereby dismissed.
