2. Having regard to the conflict in the decisions of this Court in Abdul Rashid Ibrahim Mansuri v. State of Gujarat (2000) 2 SCC 513 and Sajan Abraham v. State of Kerala (2001) 6 SCC 692 both rendered by a three-Judge Bench, relating to the provisions of Section 42 of the NDPS Act, these appeals are referred to a larger Bench.
3. Tag with Crl. Appeal No. 36 of 2003.
4. Papers be placed before the Hon'ble the Chief Justice of India for appropriate orders.
