Factual and Procedural Background

This order arises in the context of SLP (Cri.) No. 1800 of 2009, where bailable warrants in the sum of Rs 5,000 had earlier been issued to Ms Priya Porwal by an order dated 12-5-2010. According to the office report, those warrants could not be served because she was not found residing at the address mentioned in the earlier order. The office also reported that unserved covers sent to certain police authorities were returned with courier remarks such as “Short Address”, “No such Police Station”, and “Police Station Shifted”.

Legal Issues Presented

The opinion addresses a procedural matter and does not frame distinct legal issues.

Arguments of the Parties

The opinion does not contain a detailed account of the parties' legal arguments.

Table of Precedents Cited

No precedents were cited in the provided opinion.

Court's Reasoning and Analysis

The Court considered the office report indicating non-service of the earlier bailable warrants and the return of unserved covers with adverse courier remarks. The Court expressly declined to comment on the “unsatisfactory service report” of the courier agency, noting that the practice of service of notice through a courier had since been discontinued.

To secure the presence of Ms Priya Porwal, the Court directed issuance of fresh bailable warrants for a higher amount (Rs 10,000), returnable on 6-11-2012. The Court also structured the mode of execution to improve efficacy: the warrants were to be given dasti to the petitioner’s counsel for delivery to the Office of the Commissioner of Police, Delhi Police Headquarters. The Commissioner of Police was directed to ensure prompt execution, trace Ms Priya Porwal, and produce her before the Court on the next date, along with submission of a compliance report.

As an additional compliance measure, the office was directed to transmit a copy of the order to the Commissioner of Police. Further, on the request of Mr A.S Chandhiok, learned Additional Solicitor General appearing for the Government of NCT, a copy of the order was also to be supplied to the learned counsel for NCT of Delhi.

Holding and Implications

FRESH BAILABLE WARRANTS ISSUED: The Court directed that fresh bailable warrants in the sum of Rs 10,000 be issued against Ms Priya Porwal, returnable on 6-11-2012, with specific directions to the Commissioner of Police for execution and reporting.

The direct implication is that the process for securing Ms Priya Porwal’s appearance was escalated and operationally re-routed through the Commissioner of Police, with dasti delivery through the petitioner’s counsel and mandatory reporting to the Court. The order is procedural in nature and, as provided, does not articulate any broader legal principle or set a new precedent.
