Summary of the Order

Factual and Procedural Background

The Court had previously directed the State Government to provide accommodation for judicial officers within a fixed time frame. The Deputy Secretary of the Legal Department filed an affidavit, but it did not disclose the efforts made or the steps taken immediately after the Court’s earlier order. [1]

The present order concerns an interlocutory application seeking further time for compliance with that direction. [1][2]

Legal Issues Presented

  1. Whether the State Government had provided sufficient material concerning its efforts to implement the Court’s direction within the prescribed time. [1]
  2. Whether the Court should extend the period for compliance without evidence of the action already taken. [1]

Arguments of the Parties

The opinion does not contain a detailed account of the parties' legal arguments.

Court's Reasoning and Analysis

The Court expressed strong dissatisfaction with the State Government’s treatment of its earlier direction. It found that the Deputy Secretary’s affidavit failed to identify either the efforts made to secure accommodation for judicial officers or the immediate steps taken to comply within the prescribed period. [1]

The Court also objected to language in the affidavit that appeared to characterize its binding direction as a mere “instruction.” It held that an extension of time could not be granted unless the State placed the necessary material before it concerning the action taken toward timely implementation. [1]

Accordingly, the Court required the Chief Secretary to file an affidavit explaining the measures taken and specifying the period within which compliance would be achieved. [1]

Holding and Implications

EXTENSION OF TIME NOT GRANTED AT THIS STAGE; CHIEF SECRETARY DIRECTED TO FILE AN AFFIDAVIT. A copy of the order was directed to be furnished to State counsel for transmission to the Chief Secretary, and the interlocutory application was listed for 9 May 1994. [1][2]

The direct effect was to require senior-level accountability and further disclosure before the Court would consider additional time for compliance. The order states no broader implications and establishes no new precedent. [1][2]

    Order

    1. We are far from satisfied about the manner in which the direction of this Court has been dealt with. It is not disclosed as to what effort was made by the State Government for providing accommodation to judicial officers in the State. Nothing has been mentioned in the affidavit filed by the Deputy Secretary of the Legal Department as to what steps were taken immediately after this Court's order to ensure implementation of its directions within the time-frame fixed by the Court. The statement in the affidavit to the effect “taking into consideration the instruction of the Supreme Court for direction of Judicial Officers quarters” (emphasis supplied) seems to convey that the State Government treats it as a mere instruction. Unless the necessary materials are placed before this Court as to what action the State Government took to implement the Court's direction within the time-frame, we cannot extend the time. We would, therefore, like the Chief Secretary of the State to file an affidavit in this behalf and to inform us of the period within which the direction will be complied with. Let a copy of this order be given to the State counsel for transmission to the Chief Secretary.
