Factual and Procedural Background

The appeal, brought by Special Leave by the Special Land Acquisition Officer, S.V.H Electric Project (Shimoga District), concerned lands that were originally Government lands and were granted to the respondents subject to a condition that if Government took possession for any public purpose, no compensation would be payable to them. Despite this condition, the Government issued a notification for acquisition under Section 4 of the Land Acquisition Act.

During acquisition proceedings, the respondents claimed compensation. The Land Acquisition Officer quantified compensation at Rs 19,265.37 paise but declined to make an award due to the no-compensation condition in the grant. At the respondents’ instance, the matter was referred to the Additional District Judge, Shimoga under Section 18 of the Land Acquisition Act. The District Judge held that the respondents were entitled to the compensation as determined by the Land Acquisition Officer. The appellant challenged this by revision before the High Court of Mysore, which dismissed the revision following its earlier decision in M.S Seshagiri Rao v. Special Land acquisition and Refhabilitation Officer (1964) 2 Mys LJ 287. The present appeal followed.

Legal Issues Presented

  1. Whether respondents, whose grant contained a condition that no compensation would be payable if the Government resumed the land for a public purpose, were entitled to compensation when the Government acquired the land under Section 4 of the Land Acquisition Act.
  2. Whether the Land Acquisition Officer assessed compensation for the respondents’ rights in the land (as opposed to the entire land value), and whether the appellant could dispute that valuation in these proceedings.

Arguments of the Parties

Appellant/State of Mysore's Arguments

  • The Land Acquisition Officer had not assessed compensation for the respondents’ rights in the lands acquired, but had merely estimated the value of the lands themselves.
  • The respondents were not entitled to the entire value of the lands; they were entitled only to the value of their rights in the lands, as held by this Court in the Seshagiri Rao case.

Table of Precedents Cited

Precedent Rule or Principle Cited For Application by the Court
M.S Seshagiri Rao v. Special Land acquisition and Refhabilitation Officer (1964) 2 Mys LJ 287 The respondents are entitled to compensation for the value of their rights in the acquired lands, notwithstanding a condition in the grant purporting to deny compensation upon Government resumption for public purpose. The High Court followed this decision to dismiss the revision; the Supreme Court treated the governing principle as binding and used it to reject the appellant’s position that no compensation was payable.
Special Land Acquisition and Rehabilitation Officer, Sagar v. M.S Seshagiri Rao, AIR 1968 SC 1045, (1968) 2 SCR 892, (1968) 2 SCJ 853 Substantial affirmation by this Court of the decision in the Seshagiri Rao case. The Court relied on this affirmation to hold that the Land Acquisition Officer’s view that no compensation was payable could not be sustained.

Court's Reasoning and Analysis

The Court addressed the appellant’s contention that the Land Acquisition Officer had assessed only the land’s value and not the value of the respondents’ rights in the land. After examining the award, the Court concluded that the Land Acquisition Officer “appears to have valued the rights of the Respondents in the lands acquired.”

The Court further held that whether the valuation was correct could not be examined in these proceedings, and that the appellant was bound by the valuation made by the Land Acquisition Officer.

On the central question of entitlement to compensation despite the no-compensation condition in the original grant, the Court held that the Land Acquisition Officer’s view that respondents were not entitled to any compensation could not be sustained in view of this Court’s decision in the Seshagiri Rao case (as substantially affirmed by this Court in the cited Supreme Court decision).

Holding and Implications

DISMISSED: The appeal failed and was dismissed with costs.

The direct effect was that the respondents remained entitled to receive compensation as determined by the Land Acquisition Officer (Rs 19,265.37 paise), and the appellant could not deny compensation on the basis of the grant condition in light of the Seshagiri Rao precedent. The opinion does not indicate any broader implications beyond applying the existing precedent to the parties’ dispute.

Special Land Acquisition Officer v. K.S Ramachandrarao And Others

K.S Hegde, J.— This appeal has been brought up by Special Leave by the Special Land Acquisition Officer, S.V.H Electric Project, Shimoga District. The lands acquired under the present proceedings were originally Government lands. They had been granted to the Respondents subject to the condition that if it becomes necessary for Government to take possession of the lands for any public purpose then no compensation will be paid to them. Despite that condition the Government notified these lands for acquisition under Section 4 of the Land Acquisition Act. During the land acquisition proceedings, the Respondents claimed compensation for the lands in question. The Land Acquisition Officer valued the compensation payable to the Respondents at Rs 19,265.37 paise but he declined to make an award in respect of the same in view of the condition attached to the original grant. Thereafter the matter was referred to the Additional District Judge, Shimoga under Section 18 of the Land Acquisition Act, at the instance of the Respondents. The learned District Judge came to the conclusion that the Respondents were entitled to get the compensation determined by the Land Acquisition Officer. Aggrieved by that decision, the Appellant went up in revision to the High Court of Mysore. The High Court of Mysore following the decision of that Court in M.S Seshagiri Rao v. Special Land acquisition and Refhabilitation Officer (1964) 2 Mys IJ 287 dismissed the revision petition. The decision in Seshagiri Rao case has been substantially affirmed by this Court in Special Land Acquisition and Rehabilitation Officer, Sagar v. M.S Seshagiri Rao AIR 1968 SC 1045, (1968) 2 SCR 892, (1968) 2 SCJ 853.

    2. Mr M. Veerappa, the learned counsel for the State of Mysore, contends that the Land Acquisition Officer had not assessed the compensation payable for the rights of the Respondents in the lands acquired. According to him the Land Acquisition Officer merely estimated the value of the lands acquired. He contends that the Respondents are not entitled to the entire value of the lands acquired, but that they are entitled only to the value of their rights in those lands as held by this Court in Seshagiri Rao case (supra). We have gone through the award made by the Land Acquisition Officer. The Land Acquisition Officer appears to have valued the rights of the Respondents in the lands acquired. Whether the valuation made by him is correct or not cannot be gone into these proceedings. The appellant is bound by the valuation made by the Land Acquisition Officer. The view taken by the Land Acquisition Officer that the Respondents are not entitled to any compensation in respect of the lands acquired cannot be sustained in view of this Court's decision in Seshagiri Rao case.

    3. In the result this appeal fails and the same is dismissed with costs.
