[Bihar Act 10, 2023] The Bihar Special Courts (Amendment) Act, 2022
AN
ACT
to amendment of The Bihar Special Courts Act 2009 (Bihar Act 5, 2010) Preamble:- The Bihar Special Courts Act, 2009 (Bihar Act 5, 2010) is primarily based on the Prevention of Corruption Act, 1988 and the Act, was amended on 26.07.2018 by the Government of India. The Present amendment is proposed to ensure that the Bihar Special Courts Act, 2009 continues to remain in line with the Prevention of Corruption Act, 1988.
Be it enacted by the Legislature of the State of Bihar seventy third year of the Republic of India as follows :-
1. Short title, extent and commencement - (1) This Act may be called "The Bihar Special Courts (amendment) Act, 2022."
(2) It shall extend to the whole of the State of Bihar.
(3) It shall be deemed to have come into force on the 26th day of July, 2018.
2. Amendment in Section-2(e) of Bihar Special Courts Act, 2009 (Bihar Act 5, 2010) - In sub section (e) of Section 2 of the Bihar Special Courts Act, 2009 (Bihar Act 5, 2010), for the words and figures "section-13(1)(e)" the words and figures "Section- 13(1)(b)" shall be subsituted.
3. Insertion of new Section in Bihar Special Courts Act, 2009 (Bihar Act 5, 2010).- After section 26 of the Bihar Special Courts Act, 2009 (Bihar Act 5, 2010), the following new section 27 shall be inserted, namely :-
"27 Savings.-Notwithstanding such amendments, anything done or any action taken in exercise of any power conferred by or under the said act shall be deemed to have been done or taken in exercise of the powers conferred by or under this Act as if this Act were in force on the day on which such thing was done or action taken. ————
