AN ACT TO VALIDATE THE AD HOCAPPOINTMENT OF CERTAIN MINING
OFFICERS MADE TO THE ORISSA MINING AND GEOLOGY SERVICE.
BE i t enacted by the Legislature of the State of Orissa in lhe Filty-fourth Year of the Republic of India as follows :-
Short lille. 1. This Acl may be called the Orissa Mining and Geology Service (Validation of Appointment) Act. 2003.
Oelinit~ons, 2. In this Act, unless the contexl otherwise requires.-
(a) "Government" means the Government of Orissa ;
(bJ "Recruitmenl Rules" means the Orissa Mlning and Geology Service Rules. 1976 :
(cJ "Service" means the Orissa Mining and Geology Service ; and
(dl "Year" means the Calendar year
3. (1) Nolwilhstanding anything contained in the Recruilment Rules, seven
numbers of Mining Officers belonging to the discipline of Mining Engineering as specified in the Schedule with lheir names. da:es of birth. dates of appoinlment.

working in Sleel and Mines Department nn ad hoc basis since the dale of such appointment, shall be deemed to be validly and regularly appointed under the Steel and Mines Department of Ihe Government againsl the direct recruitmenl - quota ol Ihe service with effect from the date of commencement of this Act and, accordingly, no such appointment shall be challenged in any court of law merely on Ihe ground thal such appoinlments were mademotherwise than in accordance with the procedure laid down in the Recruitment Rules.
(2) The inferse seniority of the Mining Officers whose appoinlments are so validated shall be delermined according to their dates of appointment on ad hoc basis as menlioned in the Schedule and they shall be enblock junior lo the Mining Officers appointed to tht service in their cadre in accordance with the provisions of Ihe Recruitment Rules. prior to the commencement of this Acl.
(3) The services rendered by the Mining Officers whose appointmenls are so validated, prior to the commencement of this Acl, shall. subject to the provisions in sub-section (21, count for Ihe purposes of their pension, leave and increment and for no other purpose.
