enacted by

Delhi

Legislature of

the National

Capital Territory of

Delhi

in theSeventieth

Yearof the

Republic

of

Indiaas

follows:-

1. Short

title,

extentandcommencement (1)

This Actmaybe called the Delhi Skilland Entrepreneurship

University Act,

2019.

(2) It shall come into force on such dateasthe Government may, by notification in

the

official Gazette,

appoint.

2.

Definitions:

-

In this Act, unless

the context otherwise requires

- (a)"Academic Council"

means the Academic Council of the

University; (b)"Academic Staff" means such categories of staffasare

designated by the Statutestobe the

academic

staff

of the University;

(c) "Board" means the

Boardof Management

of

the

University; (d)"Campus"

meanstheunit

established orconstituted

by the

Universityformaking arrangements for instruction, or research, orboth

within theterritorial

jurisdiction ofNational Capital

TerritoryofDelhi;

(e) "Competency"

means the

ability touse

acquired

knowledge

and

learning

and

development

of character for performing ajob rolesuccessfully and

efficiently;

(f) "Center"

means the Center establishedormaintained

by

the

University;

(g) "Certificate" meanssuchaward granted by

Delhi

Skillsand

Entrepreneurship

University certifying thatthe recipient has

successfully

completed a

courseofstudyasprescribed; (h)"Chancelfor",

"Vice Chancellor"and"Pro-Vice

Chancellor"meanthe

Chancellor, theVice

Chancellor and the Pro-Vice Chancellor ofthe University;

(i) "Controller of Examinations"

means Controller of

Examinations

of

the

University; (j)

"ControllerofFinance" means Controller ofFinance of the

University; (k)"Court" means the Court of the University;

(1) "Credit Framework" means the

framework,

developed

by the

University,

built onmeasured units

of education,

skillsandlearning

credits forastudent toachievethe

competencyfor

performingajob rolesuccessfully or efficiently;

(m)

"Curriculum

package"

means the competency based curriculum

package consisting

of

syllabus, textbooks, student's manual,

trainers

guide,

training manual,

assessmentandevaluation

guidelines andallsuch material,

including

electronic material, required to

impart

skills education andteaching to

prepare astudent to

acquire the

performance

outcomes, skills

and

competencies

required

ofa

person

engaged or

likelytobe

engaged,

ina particularjob

role; (n)

"Dean,

" means the Dean of

the University. (o)"Degree"

means

any such

degree,as maybe

specified

by the

University

Grants

Commission,

by notification in theOfficial Gazette, under section 22ofthe

University

Grants Commission Act,

1956; (p)"Delhi"

meansthe

National

Capital Territory of Delhi; (q)"Department"

meansanAcademic Department within aFaculty;

(r) "Diploma"

means

such

award,

not being a degree, granted

by

the

University

certifying

that the

recipient

has successfully

completed a courseof

studyas

prescribed; (s)

"Employee"

means

any

person appointed

by

the

University;

(t) "Faculty" means a Faculty

of

Studies of

the

University;

(u) "Finance Committee" means the Finance

Committee

of the

University; (v)

"Government" means Lieutenant

Governor of the

National Capital

Territory of Delhi

appointed

by

the President under article 239

and designated assuch under article 239AAof

the

constitution; (w)

"Hall" means a

unit

of residence or of corporate life for

the

students

of the

University; (x)

"Institution" means an academic institution established or

maintained

by

the

University; (y)

"Instructors" means

persons appointed

specifically for

imparting skills

in

their

specialized

zones;

(z) "Misconduct" means a misconduct prescribed by

the Statutes and the Ordinance; (aa)

"National

Occupational

Standards"

means

National

Occupational

Standards

developed

by

Sector Skill Councils concerned and defines the measurable

performance outcomes, skillsand

competencies required

of a

person engaged orlikelytobe

engaged,

in a particular

job

role

forming

the benchmarks for education, training or

recruitment for

particular

employments; (ab) "National

Skill

Development

Agency" means the National

Skill

Development Agency notified as

such

by the

Central

Government; (ac) "National Skill

Development Corporation:

means National

Skill

Development Corporation notified as such by

the

Central

Government; (ad)

"National

Skill

Qualification

Framework" means the

qualifications assurance framework

for

skills, notified as such by the Central Government, based on

national

principles,

organizing qualifications

according

to a series of levels of

knowledge

and skills defined

in

terms

of

learning outcomes

regardless of how such

knowledge, skills or competency is required; (ae)

"Notification" means a notification published

in

the official Gazette; (af)

"Proctor" means the Proctor of

the

University; (ag) "Prescribed" means

prescribed

by the Statutesor

Ordinances or

Regulations made under this Act; (ah) "Registrar" means the

Registrar of

the

University; (ai)

"School" means

a School of

Studies

of the

University; (aj)

"Skills"

means the qualification and competency achieved through

educationandlearningfor

performinga job role successfully and

efficiently; (ak) "Staff' means all teaching

and

non-teaching

staff of the

University; (al)

"Statutes",

"Ordinances" and

"Regulations"meantheStatutes,

Ordinances and

Regulations ofthe University;

(am)

"Teachers"

means

professors, associate professors,

assistant

professors

and such other persons as

may be appointed for

imparting

instruction,

teachingorconducting

research in theUniversity,or in any

institution/centre maintained by theUniversity

and aredesignated as

teachers by the

Statutes; (an) "University" means the

Delhi

Skill and

Entrepreneurship

University as

incorporated

under

this Act; (ao)

"University

Grants

Commission"

means University Grants Commission established under

the University Grants Commission Act,

1956.

3.

Incorporation

of the Universityr-(l) With effect

from such

dateasthe Government may, by notification

in the official

Gazette, appoint,

there shall be established aUniversityby thename ofthe

Delhi Skill and Entrepreneurship

University, comprisingofthe

Chancellor, the Vice

Chancellor,

the Pro-Vice Chancellors, the first members of theCourt,theBoardof

Management,theAcademic Councilandthe Finance Committeeofthe University

and all such persons as mayhereafter be

appointed to

such

officeoras

memberssolongasthey

continue to hold

such office or membership; (2)The

University

shall be a

body corporate with

thenameaforesaid

having

perpetual succession and acommon seal with power, subject tothe

provisions ofthis Act, to

acquire,

hold and dispose ofproperty andtocontract and may, by

the said name, sueorbe

sued; Provided thatthe land

acquired

and building

constructed

with theassistanceoftheGovernment shallnotbe disposed without the

prior approval ofthe Government. (3)The University

shall be aCentreforexcellence

engaged

in

teaching and

research

in

emerging

areas

of higher education with

focusonbutnotrestrictedtoEngineering,

Technology, Sciences,

HumanitiesandSocial Sciencesand Management and shall promote inter-disciplinary

education and researchtoachieve excellence in

these and committed fields;

4.

Jurisdiction:- Saveasotherwise

provided

by orunder this Act, the limitsofthe area

within

which the University shall

exercise its powers, shall be

that oftheNational Capital TerritoryofDelhi;

5. Objects of theUniversity:-

The

objects

of the

University

shall

be - (a)to establish asa

world

class

institution

of

quality

in

applied

sciences andskills

education

recognized

by industry,

nationally

and

internationally; (b)to

develop

employable

human

resource and assist

in

placement for the

growth

and

development

of economy; (c)to

train persons in

the field

of applied

sciences and skill

proficiencies

and

competencies at

different levels designed on principles ofapplied sciencesandskills

education; (d)to

establish the world class standards of

training, teaching

and

integrated

research; (e)to

provide opportunities

for flexible learning systems and

provide a

platform

for

life

long learning

in

applied sciences andskill

development;

(f) to develop

linkages

with

industries to

provide applied

sciencesand

skills

educationas pertheir

requirements and

expectations; (g)to design

and implement

applied

sciences

oriented programmesjointly

with

industries; (h)to promote entrepreneurship

development initiatives

andto

create inspiring ecosystem for

experimenting ideas;

(i) to ignite

the

spirit

of

innovation,

creativity and

experimentation;

(j) to maintain

transparency

of

highest

order

in

matters of admission,

appointments,

evaluation, accreditation, administration and

finance;

(k) to set

up business

incubators,

technology transfer company and innovation foundations;

(1) to publish

books, journals,

periodicals, reports, scholarly

articles

in

such areasas

prescribed;

(m) todo

all

such

thingsasareincidental, necessary orconducivetothe

attainment of allor

any of the objects ofthe

University;

6. Powers and functions oftheUniversity:- The

University shall have

the

following powers and perform the following

functions, namely:-

(i) to

comply

with

the

National

Skills

Qualification

Framework &the

framework

applicable tocourses of

applied sciences;

(ii) to

have

autonomy in

financial,

administrative

and academic mattersin

regardtothe attainment

of

its

objects;

(iii) to

develop credit

framework

in

accordance

with

the

National

Occupational Standards

developed

by

such bodies as may be

specified,

by or

under, theNational Skills

Qualification

Frameworkandframework

applicable to courses of

applied

sciences;

(iv) to

develop

curriculum

packages

for

each level and

each

skill as maybedefined, byor

under,

the National

Skills

Qualification

Frameworkandframework

applicable tocoursesof

applied

sciences;

(v) to

define

norms and parameters of

applied

sciences,

skills

education,

teaching and instruction,

consistent with thecredit framework and curriculum

packages,

in

such

skills and allied

areasasthe

University may

deem fit;

(vi) to

impart

instruction

in

accordance

with

the credit

framework and curriculum

packages,

in such skills and allied areas of

applied

science,asthe

Universitymaydeem fit, for the

dissemination

of

knowledge

and skills training and consistent with

its objects;

(vii) to

impart instruction

in such branches of learning,

other than

skills, consistent

with

its

objects, asthe University may, from time to

time, determine;

(viii) to award

degrees,

diplomas,

certificates

and other distinctions that conformtothe

provisions

of the University

Grants Commission Act,

1956, ortheNational Skills

Qualification

Framework,asthecase may be;

(ix) to define norms of examination or

any other measure of assessment

of

knowledge and competency ofa student or, or

admission tothe

University;

(x) to conduct examinations or other

assessments

of

knowledgeor

competency, oraccredit the examination or

other

assessment

systems of

institutions

of skills

education,

as

the

University may,

from timetotime,

determine;

(xi) to

recognize industries

for purposes of

practical

training

of

students

in

skills and to define norms for recognition ofcompetency attained by astudent

in such

practical

training

in

industry forthe purposeofearning credits;

(xii) to

define

norms and measuresofassessment for recognition or

prior

learning

and competency in

skills, based on relevant

experience atwork orinindustry;

andto

assign credits forsuch

prior

learning or

competencyin accordance

with the credit

framework;

(xiii) to lay

down norms for transfer of

credits to

promote

new

learning

opportunities

without

compromising on learning outcomes;

(xiv) to

institute education

in applied

sciences, skills education,

teaching or other academic positions, required by the

University,withsuch

qualifications and

designationsas it may

deem fit, andto appoint persons

on tenure, termor

otherwise tosuch

positions;

(xv) to

appoint persons working or having significant

experience

or

working, in any

other

University or educational

institution

or

any industry,

possessing

the

required knowledge or

competency, as

adjunct, guest

or visiting faculty of

the

University onsuchterms and

for such durationas

University may

decide;

(xvi) to

lay

down parameters

for assessment and accreditation

of courses

of

applied

sciences,

skill educators and

training

providers in

accordance with

the norms

specified by orunder the National

Skills

qualification Framework, or

intheir absence, suchnorms as maybedetermined bythe

University;

(xvii) to create administrative and other posts and to

make

appointments

thereto;

(xviii) to

determine,

specify and receive paymentof

fees

and other

charges, as the University may deem fit, from students and any other person, institution,

industry or body corporate for instructions and other services, including

training,

consultancy

and

advisory

services,

provided

by

the

University;

(xix) to establish and maintain such infrastructure, including campuses and

training centres

within

its territorial

jurisdictions,

as

may

be

necessary for attainment of

its

objects;

(xx) to

undertake,

or cause to be undertaken,

such

studies

for assessment of courses, skill needs as

may be required in thefutureandto

prepareand

maintain a

databaseof

coursesof

applied

sciences,

skills assessmentand requirements intermsoftheemerging employment market inDelhi, nationally or

internationally, asthecase maybe, relevant tothe

instructions

imparted or

proposed tobe

imparted inthe

University;

(xxi) to

institute and award fellowships, scholarships,

exhibitions, prizes and

medals;

(xxii) to

collaborate

with any

other

universityorinstitution in

offering

joint degree programmes for bridging, education in

applied

sciences, skill education

with

higher

education;

(xxiii) to

partner with

institutionsandindustries

for

creating andoperating

centresandprogrammes.

(xxiv) to

promote international collaboration in

applied

sciencesandskills education

with

institutions of applied

sciences forthepurpose of

developing competency, knowledgeand

ability to

global

standards;

(xxv) to

promote a

spirit of

entrepreneurship

in skills amongst youth;

(xxvi) to establish,

maintain

institutions,

centres,

campusesand such

other centresof

education, research, training and extension asdeemed

appropriate

by the

University;

(xxvi) to

determine mode

and

standards

for admissionstothe

University

whichmayinclude

examinations, evaluation or

any other

methodof

selection;

(xxvii) to

establish,

maintainandmanage halls,

hostels,

residences etc for theresidence of , staff,

studentsand scholars; (xxviii) to

prescribe,

regulate and

enforce the

discipline andconduct of

students of the

Universityandtomake arrangements for

promoting

their

health,

welfare

and cultural and corporate life;

(xxix) to regulate

the work and conduct

of

employees of

the University and take such

disciplinary

measures

in this

regard as

may deem

necessary;

(xxx) tomake arrangements for

promoting the

healthandgeneral

welfare of employees ofthe

University;

(xxxi) to

create any Reserve

Fund,

Insurance

Fund or anyother special Fund whether

for

depreciation orfor repairing,

improving, extendingormaintaininganyof the

properties orrightsofthe

University

and/orforrecoupment of

wasting

assetsandforanyother purposesforwhich the

University

deems it

expedient or

proper to

create or maintain such

Funds;

(xxxii) to

draw, make, accept, endorseanddiscount

cheques,

notesorother

negotiable

instruments; (xxxiii) toreceive

benefactions, donations andgifts

from

personsand

organizationsandto

name, after them, such

chairs, institutions,

buildings

and the likeasthe Universitymaydetermine,

whose

giftordonationtothe University is

worth suchamount as the

Universitymay

decide;

(xxxiv) to

acquire by

gift,

purchase,

exchange,

lease, hireorotherwise howsoever any movable or immovable property which may be necessary orconvenient

for

the

purpose of the

University

andtobuild, construct, improve, alter, demolish,

repair

and maintain such buildings,

works and constructions as maybe necessary for

carryingoutthe objects ofthe

University; (xxxv)to

borrow

money, with the

approval

of

the Government, for

the purpose of

the

University;

(xxxvi) to assesstheneeds

in

terms of subjects, fields of

specialization,

levelsof

education and training of technical and other manpower, both on short and longtermbasis,

andtoinitiate necessary programmes to meet

those needs; (xxxvii) to initiate

measures to enlist the

cooperation

of the

industry and other expert agencies to provide

complementary facilities; (xxxviii) to prescribe codeof

ethics, codeof

conductanddisciplinary rules

for its

employees

and

Code

of Discipline forthe students.

7.

University

open toall

classes,

castes and creed:- (1)

The

University

shall

be open

to

persons

of

either sex or whatever race, creed,

caste or

class, tobe admitted

as

student

of the

University ortograduate

thereat and

it

shall not be

lawful for

the University to

adopt

or impose on

any

person

any test

whatsoever

of religious

belief or

profession or political opinion

in

ordertoentitle themtobe admitted as

students

of

the

University,

in ordertoentitle them to be appointed asa

teacherofthe

Universityortohold any

office therein. (2)Nothing in this

section shall be deemed to

preventthe

University from

making any

special provision for

the appointment oradmission of

womenor ofpersons belongingtotheweaker sections of theSociety,

and in

particular, of persons belonging

to the

Scheduled Castes and the

Scheduled

Tribes;

and

physically challenged. However, the provision prevalent

in theGovernment ofNational

Capital

Territory

of Delhi such

instructions

will be

followed;

8.

Training

and Teaching in the

University:- (1) Thetraining

and teaching

in

connection with

the

degree, diploma and

certificate

programmes

of the

University

shallbeconductedinaccordancewiththe

Ordinances and Regulations;

(2)The courses and curricula and the authorities responsible

for organizing

the

training

and

teaching of such courses and curricula shall be as

prescribed

the

Ordinances;

9.

Visitor ofthe

University:-

(1) The President of the

Republic

of India shall

be the Visitor of the

University. (2)Any

dispute

arising between the University

andanyother

University

established

by

law in

Delhi,

may be referred to

the Visitor whose decision shall be

final and

bindingonthe

parties.

10. Chancellor of theUniversity:-(1)

The Lieutenant

Governor of

the

National Capital Territory ofDelhi shall be

the

Chancellor of the

University;

(2) The Chancellor shall,

ifpresent, preside overthe

convocation

of the

University

for

conferring degrees; (3)The

Chancellormay

cause aninspectiontobemade by

such person or

persons ashemaydirect,ofthe University,

its

buildings,

libraries

and equipment andofanyinstitution maintained by

the University, andalso ofthe examinations,

teaching andotherworkconducted or

done bythe

Universityandcausean

inquiry tobemade in the like

manner inrespectofany

matter connected

with the

administration andfinancesofthe

University; (4)The

Chancellor may offer such

advicetothe

University as

hemaydeem fit

with

referencetothe

resultof such

inspection orinquiry; (5)The University

shall

communicatetothe Chancellor the action

taken or

proposed tobetaken on

such advice; (6)The

Chancellor may invite a

person or

personsof

eminence toadvise

the

University in

relation toaffairsof the

University asand when he

deems

it necessary.

11. OfficersoftheUniversity:-

The

following

shall be the officersofthe

University;

(a) the Vice-Chancellor; (b)

the Pro

Vice-Chancellors; (c)

the

Deans; (d)

the

Registrar; (e)

the Controller

of

Examinations; (f)

the Controller of Finance;

and (g)

such other

officers as

may be declared

by

the Statutestobe

the officers

of

the

University;

12.

Vice-Chancellor of the University:- (1)

The

Vice-Chancellor

shall be a

person of

eminence

having

rich

Vice-Chancellor will be

appointed

Chancellor

University

Vice-Chancellor

shall be the

principal

academic and executive officer of the University and shall be responsible forproper administrationofthe

vacant

sanctioned posts;

The Vice-Chancellor

shall have the power tosend members of the staff for training or for a

course

of instruction ortoattendanyconferenceorsymposiumorworkshop

within

Indiaorabroad andpay

registration fees and

sanction

expenditure ofthe concerned staff:

The Vice-Chancellor

shall have the

power tosanction remissionor

reduction

of rents for buildings rendered wholly or partially unsuitableon

the recommendation ofthe Finance

The Vice-Chancellor

shall have the power tosanction temporary allocation of any building for any

purpose other than that for which

it was

constructed; but

in any case

it

will not

be for commercial use;

(15)

The

Vice-Chancellor may, athis

discretion,

constitute

such

Committeesashe may consider

appropriate;

(16) Inemergent cases, the

Vice-Chancellormayexercise all

the powers of the Board of management,

Senate and Finance

Committee and put up in

the

respective

Bodies of the action taken

in the next

meeting; >

Pro Vice-Chancellors of the

University- (1)Every

Pro

Vice-Chancellor shall be

appointed

by

Board of Management (BOM) in

such manner, onsuch emoluments and other conditions of

service,

and

shall exercise

such powers and

perform

such functions, as maybe prescribed; (2)The Pro

Vice-Chancellors

shall

perform such

duties and

exercise such

functions

and powers

as

the Vice-Chancellor mayspecify generally or in

individual casesand

shall assisttheVice-Chancellor on academic and administrative matters;

(3)The termofthePro

Vice-Chancellors

shall be co-terminus

with

the term of

Vice-Chancellor;

14. TheDeans:- Every Dean

shall

be

appointed

in

such manner, and

shall

exercise

such powers and

perform such duties as may

be prescribed;

15. The

Registrar-

(1)

The

Registrar

shall be appointed

by Board of Management

(BOM)

in

such manner,

on such emoluments and

other conditions of service, andshall exercise

such powers and

perform

such

functions,

as

may be

prescribed;

(2) The Registrar empowered by

the Board

of

Management

shall have the power

to enter

into

and

sign agreements and legal

documents and authenticate records on behalf of the

University;

(3)

The

Registrar shall act as the custodian of

records;

16. Controller of Examinations-The Controller of

Examinations

shall be appointed by

the Board of Management in

such manner,

on such emoluments and other conditions of

service,

and shall exercise such powers and perform such functions as

may be

prescribed;

21. Powers, functionsandmeetings

ofthe

Court- (1)Subjecttothe

Act,

the Court

shall review, fromtime to

policies and programmesoftheUniversity

and suggest measures for improvement and

development of the

University,

the

Court shallhavethefollowing

other

powers and functions namely:-

(a) to consider

the broad

policies or anyproposed modification thereof

the Board of

Management;

Chancellor in respect of any

the Government shall be

required;

(iv) to enter into, vary, carryoutandcancel

contracts onbehalf of theUniversity andforthatpurpose toappoint such officers asitmay

think

fit;

(v) to provide

the

buildings,

premises,

furniture, computers and apparatus and

other means needed

for

carrying on the work of

the

University;

(vi) to entertain,

adjudicate upon, and

if it

thinks fit,toredressanygrievances

of

the

officers,

the

teachers, the students and the employees of

the University;

(vii) to create

posts of all Groups on

the recommendation

of Senate and appoint persons toacademicaswell as

other posts in the University;

(viii) toselect a

commonseal

for theUniversity;

(ix) to

lay

down

policy guidelines

for admitting "Foreign

students,

Persons of

Indian Origin

(PIOs),

theNon- Resident

Indians

(NRIs)

and sponsored students" as

supernumerary against higher fee

prescribed by itfromtime to time;

(x) to exercise

such other powers andtoperform such other duties as maybe

considered necessary or

imposed on it

by orunder this

Act;

(2) (a) The Board shallmeetatleast,

three times

in a year

and notlessthanfifteen

days notice

shall

be given for such

meetings; (b)The meetings ofthe

Board shall

be called

by the

Registrar

under instructions of the

Vice-Chancellor oratthe request ofnotless

than

eight members

of the

Board; (c)One

halfof the members

of the Board shall form

the quorum at

any meeting; (d)In case of

difference of opinion among the

members, the

opinion of

the majority

shall prevail; (e)Each member of

the Board shall haveonevoteand

if there

and the Board may either ratify the decision of the

Chairperson

or accept it with

modifications or reject it

and

in

the event of modification orrejection ofthedecision oftheChairpersonby the

Board, such decision shall stand

modified or rejected, asthecase maybe, retrospectively i.e., from thedateofimplementation of such

decision oftheChairperson;

(h) Ifurgent action

by the Board becomes necessary, the Chairperson, Boardof

Management,maypermit the business to be transacted

by circulation

of papers tothe

members ofthe

Board, andthe

action so

proposed tobe taken shall not be taken unless

agreed to

by a

majority of

members oftheBoardandthe actionsotaken

shall

be forthwith intimated toallthe members of the Board andincasetheauthority

concerned

24. TheAcademic

Council:- (1)The Academic Council shall be the

principal academic

body ofthe

University and

shall,

subject to

the provisions of this Act, the Statues and the Ordinances,

have the

control and regulation of,

and be

responsible for, the

maintenance ofstandards of

instruction,

education andexamination

within the

University and shall

exercisesuchother powersand

perform suchother

duties as maybeconferredor

imposed uponit by the Statutes;

(2)The Academic Council

shall have the right toadvise the Boardof

Powers,

Functions and

Meetings of theAcademic

the academic affairs andmattersin theUniversityandin

particular

shallhavethe

following powersand

functions, namely: -

(i) to

report

it by the

Board;

(ii) to make recommendations to

the Board with regard tothe

creation,

abolitionor

classification of

teaching posts in the University

and the

emoluments

payable

and the duties

attached

thereto;

(iii) tomakerecommendations totheBoard

with regard tothe

creationsandabolitionofvarious

faculties of studies andacademic Departments;

(iv) to

promote research

within

the

University

and to

require

from

time to

time, report on such research;

(v) to consider

proposals submitted

by the teachersonthe academic

activities;

(vi) to lay

down policies

for admissions to the

University;

(vii) to recognize

diplomas and

degrees

of other Universities and

Institutions andto

determine their equivalence in

relationtothe

diplomasand

degrees of theUniversities;

(viii) to fix, subject to

any conditions

accepted

by

the

Board, the

time,

mode and

conditions

of the competition for

Fellowship, Scholarship and

other prizes andto

recommend forawardofthe same;

(ix) to

appoint

examinersand

moderators, and ifnecessary toremovethemandto

fix their fees, emoluments, travelling and other allowances andexpenses;

(x) to recommend arrangements for the conduct

of

examinations and the dates

for

holding

them;

(xi) to declare

and

review

the result of the various

examinations orto

appoint

committees or

officers

to do so, and to make recommendations regarding

the confermentor

grantof

degrees,

honors, diplomas,

licenses,

titles

and marks of honor;

(xii) to recommend stipends, scholarships,

medals and

prizes andto make other awards in

accordance

with

the regulations and such other conditionsas

maybeattachedtothe

awards;

(xiii) to

approve orrevisethe

syllabus forthe

prescribed

coursesofstudy

and lists of

prescribed

or recommended textbooks andtodecide for

publishing

of

books

by the

University;

(xiv) to

approvesuch

forms and

registersasarefromtimeto

time,

required

by theordinances and

regulations;

(xv) to formulate,

from time to

time,

the desired standards

of

education

to be adhered

in

drawing up the curriculum and

syllabi for

being taught inthe

University;

perform, in

relation to academic matters,allsuchduties andto doallsuchacts as

maybenecessary for the proper carrying outof

the provisions of thisActandtheOrdinancesand

Regulations madethere under;

(2)

(i) The Academic

Council

shall meet as oftenas

may be necessary, but not less than three times,

during an academic year;

(ii) One half of the existing members of the Academic Council

shall

form the quorum forameeting

ofthe Academic

Council;

(iii) In case of difference of

opinion

among the members, the

opinion of themajority shall

prevail; (iv)

Each

member

of the

Academic

Council, including

the

Chairperson

of the Academic

Council,

shall haveone vote and

if

there be

an

equality

of votes on

any

matter to be

determined

by

the Academic Council,

the

Chairperson shall in

addition,

have a

casting vote;

(v) Every meeting

of the Academic

Council

shall

be

presided overby

the

Vice-Chancellor

and in the absence of Vice-Chancellor, thePro-Vice Chancellor asnominated by

the

Vice-Chancellor,

will

preside themeeting andin his absence,

seniormostDeanwill

preside overthe

meeting; (vi)

If urgent action bytheAcademic

Council

becomes necessary, the

Chairperson

oftheAcademic

Council may

permit the

businesstothe transacted by circulation

of papers tothe members of

the

Academic Council and the action

proposed tobetaken shallnotbe

taken unless

agreedto,by a

majority ofthe membersof the

Academic Council, and the

actionastaken

shall

forthwith beintimatedtoallthe members of theAcademic

Counciland

in case the

authority concerned

fails

to take a

decision,

the matter shall be referredtothe

Chancellor

whose decision shall be final.

26. The

Schools of

Studies: -(l)There

shall

be

such number

of the Schools of Studiesasthe

Universitymay determine fromtimetotime. (2)The

constitution, powers and

functions of

the Schools

of

Studies

shall be such as

be

prescribed.

27 . TheFinance

pay-scales

and those items which are not included in

the budget,

shall

be examined

by the Finance

Committee before

they are considered by

the Board of Management; (d)to

consider

the annual accounts and the

financial estimates of

the University prepared

by

the Controller of Finance

and laid before

the Finance Committee for approval

and thereafter submittedtothe

Boardof

Management; (e)

the Finance Committee shall

fix

the limits

for

the

total

recurring and

non-recurring

expenditure

for

the year, based on income and resources of the University,

andno

expenditure shall be

incurred

by

the University in

excess

of the limits so fixed,

without

the

approval

of the Finance Committee;

its views and tomake recommendations tothe Board of

either on

meet,atleast, four times ina

year; five members of the Finance Committee shall form thequorum at anymeeting;

Other Authorities:- The constitution, powers and

in respect of

the terms and

conditions of

service of the teachers and other members of the academic

staff appointed

by the

University; (j) thetermsandconditions of

other employees

appointed

by

the

University; (k)

the constitution of the

pension or

the provident

fund and the establishment ofan

insurance scheme for the benefit ofthe

employeesofthe

University; (1)

the principles

governing

the

seniority

of employees of the

University; (m) the

procedure

forany

appeal

byan

employee or astudent of

the

University; (n)conferment

of

honorary degrees; (o)institution

of

fellowships, scholarships, studentship,

medals,

prizes

and other incentives; (p)maintenance of

discipline

among

the

employees ofthe University; (q) establishment of

chairs,

schools and

institutions; (r)management, supervision and

inspection of institutions and centers established and

maintained

by

the University; (s)

the

delegation

of powers vested in

the authorities or

the officers of the

University; (t) all other matter which,

by or

under this Act, are to

be, or may

be, provided

for by

the Statutes; 30.

Statutes

how

made:- (1)

The first

Statutes shall be those made

by

the Government

with the prior approval of the Chancellor within

sixty days ofthecommencement ofthisAct.

(2) The

Board

may,from timetotime,

make neworadditional Statutes or may

amendorrepeal

the Statutes referred to in sub-section (1):

Provided thattheBoard

shallnotmake,

of theUniversity

until such authority hasbeen

givena

reasonable

opportunity

of

expressing

its opinion inwritingonthe

proposed

change andanyoption so

expressed

within thetime

specified bytheBoardhas been considered by

the

Board.

Everynew

Statute or

addition tothe Statutes or

any amendment or

repeal

thereof shall

require

the

approval of

the

Chancellor, whomay

assent thereto orwithhold

his assentor

remit

it tothe

Board for reconsideration

in

the light

of the

observations,

ifany,made

by him.

(4)

A newStatuteora

Statute

amendingor

repealing anexisting Statute shallnotbe valid unless

it

has received the assentofthe

Chancellor, who

will

takeintoconsideration the

viewsof the

concerned

department while

deciding the

matter.

31. Ordinances -(1) Subject to the

provisions

of this Act and

the

Statutes, the

Ordinances may provide for all or any

of the

following matters, namely:-

(a)

the admission of

students, the

courses of study and

the

fees therefore, the

qualifications pertainingtothe award of

degrees

and

diplomas

and

other academic

distinctions,

the

conditions

for

the grant of

fellowship

and awards and the

like; (b)

the conduct

of

examinations,

including

the termsand

conditions

of office and

appointment

of examiners; (c)

the conditions of residence

of

students and

their

general

discipline; (d)

the

management of

institutions,

schools

and centers maintained

by

the

University; (e)

the procedures for the settlement

of

disputes

between the

employees

and the University, or between the students andthe

University; (f)

the

procedures for thesettlementofdisputes

between the employees

and students; (g)

the

procedure for any

appeal

byanaggrieved

employee ora

student;

(h) maintenance of discipline

among

the students of the

University;

(i) regulation of the

conduct

and duties of the

employees of the University

and

regulation of the

conduct

of the students ofthe

University; (j)

the

categories

of

misconduct

for

which

action maybe

taken

under

thisAct or

the

Statutes or

the Ordinances;

(k) any

other

matter which,

by orunder thisActor

the

Statutes,istobe, or may

be,

provided for by

the Ordinances.

(2)

The first Ordinances shall

be made

by

the Vice-Chancellor

with

the

prior approval of the Government and the Ordinances so mademaybe

amended, repealedoraddedto, at anytime by

the Board in

such

manneras maybe prescribed;

32. Regulations:- The

authorities of the

University may make regulations

consistent

with this Act, the Statutes and the

Ordinances, in

the

manner

prescribed

by the

Statutes for the conduct

of their own

business

and

that of the committees,

if any, appointed

by

them andnotprovided for

by

this

Act,

the

Statutes or

the Ordinances.

33.

Annual report:- (1)

The

annual report of the

University shall

be

prepared

and

placed before

the

Board of Management for

approval,

which

shall

include, among other matters, the steps taken

by

the

University

towards the fulfilment of its

objects. (2)The annual report so prepared shall be

submitted to the Chancellor

within 12

months from the date of completion

of the

academic

year. (3)A copy of the

annual report,as

prepared

under sub-section

(1),

shall also be submittedtothe Government which

shall, assoonas

may be, cause the sametobe

laid before

the

Legislative

Assembly ofDelhi.

34.

Annual accounts:- (1)

The annual accounts and

the balance sheet

of the

University

shall

be

prepared

and place before the

Finance Committeeforapproval and

shall,atleast, once

everyyear atintervalsofnotmore

than fifteen months, be

audited bytheController and

Auditor GeneralofIndiaorsuch

person or

persons ashemay authorize in

this behalf. (2)A copy of the annual accounts together

with

the

audit report shall be

submitted firsttothe Board

of Management and

then to

the

Government

along

with

the

observations, if any,

of the Board.

A

copy of

the annual accounts together

with

the audit report shall be assubmittedtothe Government which shall, as soon as maybe,

causethesame tobelaid

beforetheLegislative Assembly ofDelhi.

35. Conditionsof

serviceof

employee:- (1) The University

shall enter intoawritten contract of service

with every newemployee

of the

University

appointed, onregular

basisorotherwise and the terms and

conditions of the contract shall notbe inconsistent

with

the provisions

of this Act, the Statutes and

the

Ordinances.

(2) A copy of the contract referredto

in

sub-section

(1) shall be

lodged

with

the University and a copythereof shall also be furnished tothe

employee

concerned.

36.

Tribunal ofArbitration :-(l)

Any dispute

arisingoutof acontract of employment referred to

in

section

32

between theUniversity and

the

employee shall be

referredtoa

Tribunal ofArbitration which shall consist

of one member nominated

by theBoardof

Management,onemember

nominated by

the employee

concerned andan arbitrator to be nominated by theChancellor.

(2) Every such

reference shall be deemedtobea

submissiontoarbitrationonthe terms of

this section

within

the meaning to the law of Arbitrationasin force,

and all

the

provisions of

that

law, with the

exception of section 2 thereof, shall

apply accordingly.

(3)

The procedure

for regulating

the

work

of the Tribunal

of

Arbitration shall be suchas maybe

prescribed

by the University.

(4) The decision of theTribunal of Arbitration shall be

bindingonthe

parties andnosuit shall lie

in respect of any

matter decided

by

the Tribunal.

37. Provident and

Pension Funds:- The University shall constitute

for the benefit of its employees such provident fund and

pension fund or

provide suchinsurance scheme as itmaydeemfit insuchmannerand

subject to such conditions as maybe

prescribed.

38.

Disputes as tothe

constitution ofthe

University

Authorities

and Bodies:-

If any

question arisesasto whether any

person has been duly

appointed as, or

is entitledto

be, amemberofanyauthorityorother bodyofthe University, thematter shall bereferredtothe

Chancellor with

Board's

recommendations,

whose

decision thereon shall be

final.

39.

Filling ofcasual vacancies:- All

the casual vacancies amongthemembers (otherthanex-officio

members) of any authorityorother body

of the

University

shall be filled,assoon as maybe

convenient,

bytheperson or

body who appoints, elects orco-opts the members whose

place has become vacant andany

person appointed,

electedor co- opted toacasual

vacancy shallbe a

member ofsuchauthorityorbody for the

residueof thetermforwhichthe person whose

place

he

fills,

would

have been a

member.

40. Proceedings of theUniversity

authoritiesorbodiesnotinvalidated

by vacancies:- Noactor proceedings of anyauthorityorother bodyshallbeinvalidated

merelybyreasonsoftheexistenceofanyvacancy or vacancies

amongits

members.

41.

Protection ofaction taken in good

faith:-Nosuitorother

legal

proceeding

shall lie

inany

court against the University oragainstanyauthority, officeroremployee

of the Universityoragainstany

person or

body of persons acting

under the orderordirection

ofanyauthority orofficerorother employee of the

University

for anything which is in good

faith doneorintended tobedone inpursuanceoftheprovisionofthisActortheStatutesorthe Ordinances.

42. Modeofproof of theUniversity record:- Acopyofanyreceipt, application, notice, order,

proceedings, resolution ofanyauthority orcommittee of the

University,orother documents in the

possessionofthe

University,or any entry in

any register duly

maintained

by

the University,

if certified

by the Registrarsodesigned

shall, notwithstanding

anything

contained

in

the Indian Evidence Act,

1872 (1 of

1872)orinanyother

law forthe

time being

in

force, shall be admitted asevidenceofthe mattersand

transaction specified therein,

wherein, where the original thereof would,

ifproduced, havebeen

admissible in

evidence.

43.

Powertoremove difficulties:- If anydifficulty

arises

in

giving effecttothe

provisions ofthis

Act, the Government may,by

order, published

in theofficial Gazette, make such

provisions, not

inconsistent

with the provisions of this Act, as

appear toittobe

necessary or

expedient for

removing the

difficulty:

Provided thatnosuchorder shall be

made under this section after the

expiry of three

years

from the commencement of

this

Act;

44.

Transitional

provisions:- Notwithstanding

anything

contained

intheAct

and the Statutes:-

Statute and Ordinance made under this Act shall

be

published

in

the

official Gazette.

(2) Every

Statute

and

Ordinance madeunder this Act

shall be laid, assoonas may

be after

it

is

made, before the

Houseof the

Legislative Assembly ofDelhi

while itis in

session fora

total

periodof

thirtydays

which may be comprised

inonesession ortwo or

more successive sessions,

and if,

before the

expiry

of the session immediately

followingthesession orthesuccessive

sessions aforesaid, theHouse

agreesin

makinganymodification in theStatuteortheOrdinanceortheHouse agreesthattheStatuteorthe

Ordinance, asthecase maybe,

should not be

made,

the

StatuteortheOrdinance

shall

thereafter have

effectonly

in suchmodified formorbe ofno

effect, asthe case

may be; so, however,

that any such modification or

annulment shall be without prejudicetothe

validity

of anything previously

done under thatStatute or

Ordinance asthecase may

be.

46.

Honorary

degree:- Ifnotlessthantwo-thirdofthemembersof

the

Senate recommendthat an

honorary degree, oracademic distinction be conferredonany

person on thegroundthatheis,

in

their

opinion,

by reasonof eminent attainment and

position, fitandproper toreceivesuchdegree oracademic

distinction, theChancellormay, by an

order,

decidethatthe samemaybeconferred ontheperson recommended.

47.

Withdrawalofdegree or

diploma:-(l)

The

Boardmayeitheronitsownmotion or onthe recommendation of theSenate, withdrawanydistinction,

degree, diploma or

privilege

conferredon, or

grantedto, any person, by aresolution

passed

by

the

majority

of the total membership of the Board present and

votingatthe meeting, if

such

person

has been

convicted

by acourtof

law foran

offence, which,

in

the

opinion of the

Board, involves

moral

turpitudeor ifhe has been

guilty of

gross

misconduct.

(2) No action under sub-section

(1)

shall be taken

againstanyperson

unless he has been given an

opportunity to show cause against

the

action

proposed

to

be

taken.

(3) A copy of

the

resolution

passed

by

the Board of Management shall

be immediately sent tothe person concerned.

(4) Any person aggrieved by the decision taken

by

the Board of

Management

may

appeal to the

Chancellor within

thirtydays from

the dateofreceiptofsuchresolution.

(5) The decisionof

the

Chancellor in

such

appeal

shall be final.

48.

Discipline:-

(1) The University shall maintain a

strict

discipline among students through

its Proctorial Board ina

manner as

may be

prescribed.

49.

Deemed

validity

of

appointments:- Notwithstanding

anything

contained

in any

other law or

instrument having

the

forceoflawfor the time being in force, the appointments

made

to

any post

in

the

University in accordance with

the Statutes,

the

Ordinances

and the

Regulations

shall be

deemed to be

valid and in

accordance

with law.

50.

Overriding

effect:- The provisions of the

Act, the

Statutes, the

Ordinances and the

regulations made there under shall have effect

notwithstanding anything

inconsistent contained therewith

in any other law

or

instrument having

the forceof

law for

the time being in

force.

51.

Sponsored

Schemes:- Whenever the University

receives

funds

from any

Government,

the

University

Grant Commission orother agencies

sponsoring a

scheme to be executed by the

University, notwithstanding anything

in this Act or the Statutes

or

the Ordinance made

there under

- (a)the

amount

received shall be

kept

by the

University separately from

the University Fund and utilized only for

the purpose

of the

scheme;

and (b)the staff required to execute the

scheme shall be recruited in

accordance with

the terms and conditions stipulated bythe sponsoring organization.

52. Power

to

issue

directions:-

The Chancellor may

either

suo moto or on

the

recommendation of the Government may issue such directions as

may be necessary

or expedient

inthe interest of

administration,

financial

or academic

functioning of

the

University

and in

particular to ensure peace

and tranquillity

in

the University and to protect the

property of

the

University. 53.Power toannul the orders of

the

University:-

The Government may,

by

order

published

in

the official Gazette, annulanyorder,

notification, resolution or anyproceedings

of the University

which, in its

opinion,

isnotin

conformity with

the

provisions

of

this

Act, orthe Statutes, Regulations, or

Ordinances oris

otherwise inconsistent with the

policy of theGovernment:

Provided that before makinganysuch

order,theGovernment shall

affordan

opportunity tothe University to be heard against any such

proposed

action.

54. Thecostof

performance

audit:-The Chancellor shall

cause a

performance

audit

of

the University every five years and the cost of

performance audit shall

be borne

by the

University.

55.

Supreme Authority oftheUniversity:-The Chancellor shallbetheSupreme Authorityofthe

University and

shall

have the power toreview theactsof

the

Board and

the Senate and

shall

exercise all

the powers

of the University nototherwise

provided forby

this Actorthe

Statutes.
