AN ACT TO REPEAL THE ANDHRA PRADESH TAHSILDARS AND DEPUTY
TAHSILDARS (CONSTRUCTION OF REFERENCES) ACT, 1985.
Whereas, on formation of Mandals in the place of Taluks and Firkas under the Andhra Pradesh Districts (Formation) Act, 1974 as amended by the Andhra Pradesh Districts (Formation) (Amendment) Act, 1985, the Andhra Pradesh Tahsildars and Deputy Tahsildars (Construction of References) Act, 1985 has been enacted for construing any reference of Tahsildar, Deputy Tahsildar in the application of any law, rule, bye-law, regulation, notification, scheme, form or order as Mandal Revenue Officer.
And whereas, the nomenclature of Tahsildar is familiar to one and all throughout the Country;
And whereas, certain offices and undertakings of Central Government are not recognizing the certificates issued by the Mandal Revenue Officers; And whereas, the set up of the Mandal Revenue Officers, in the Revenue Administration thus causing confusion and creating problems; And whereas, the Government have taken a decision to change the nomenclature of the Mandal Revenue Officer as Tahsildar, Deputy Tahsildar, so as to overcome the above contingencies by repealing the Andhra Pradesh Tahsildars and Deputy Tahsildars (Construction of References) Act, 1985; Be it enacted by the Legislative Assembly of the State of Andhra Pradesh in the Fifty-seventh Year of the Republic of India as follows:-
1. Short title, extent and Commencement - (1) This Act may be called the Andhra Pradesh Tahsildars and Deputy Tahsildars (Construction of References) (Repeal) Act, 2007.
(2) It extends to the whole of the State of Andhra Pradesh.
(3) It shall be deemed to have come into force with effect on and from the 25thMay, 1985.
2. Repeal and Savings - (1) The Andhra Pradesh Tahsildars and Deputy Tahsildars (Construction of References) Act, 1985 (Act 15 of 1985) is hereby repealed.
(2) Upon such repeal,-
(a) any reference to Tahsildar or Deputy Tahsildar construed as the Mandal Revenue Officer in any law, rules, regulations, bye- laws, notifications or schemes under the repealed Act shall be construed as Tahsildar or as the case may be the Deputy Tahsildar;
(b) the provisions of section 8 of the Andhra Pradesh General Clauses Act, 1891 (Act 1 of 1891) shall apply.
