Justices of the Peace Act, 1864 [Repealed]

PREAMBLE
Whereas cases have arisen wherein persons have brought forward conscientious objections to taking the several oaths hitherto administered to Justices of the Peace in order that they may be duly qualified to act under Commissions of the Peace; It is enacted as follows:
Section 1. Repeal of Section 1 of Act XVI of 1841
Section 1 of Act XVI of 1841 is hereby repealed.
Section 2. Justices of the Peace to be capable of acting as such on making certain declarations
All persons who are or shall be nominated and appointed in any Commission of the Peace, shall be capable of acting as Justices of the Peace in every respect according to the terms of such Commission, upon making and subscribing before any other Justice of the Peace or the chief Civil Officer of any Station within the places in and for which any such Commission shall have issued, declarations to the following effect:
I declare that I will be faithful and bear true allegiance to Her Majesty Queen Victoria.
I declare that I will truly and faithfully discharge the Office of a Justice of the Peace.
Section 3. Subscriptions to such declarations where to be deposited
The subscriptions of such persons to the said declarations shall be deposited and kept with the records in the Home Department of the Office of the Secretary to the Government in the province wherein such declarations shall have been made.
