UNAUTHORISED OCCUPANTS) AMENDMENT
ACT, 1986*
(ACT 19 OF 1986)
An Act further to amend the Kerala Public Buildings (Eviction nf Unauthorised Occupants) 'Act, 1968.
Preamble.-WHEREAS it is expedient turther to amend the Kerala Public Buildings (Eviction of Unauthori~~d Occupants) Act, 1968, for the purposes hereinafter appearing.
BE it enacted in the Thii ty-seventh Year of the Republic of India as follows :- · '
I. Short title and commencement.-( I) This Act may be called the Keral a PubJic Buildings (Evicti.>n of Unauthorised Occupants) Amendment Act, 1986. '
(2) It shall be deemed to have come into force on the 7th day of February, 1983.
2 Amendment of section 2.-In section 2 of the Kerala Public Buildings (Eviction of· Unauthor1sed Occupants) Act, 1968 (25 of 1968) (hereinafter referred to as the principal Act),-

(I) clause (a) shall be re-lettered as clause, (aaa) ani before that clause, the following clauses shall be inserted namely :-
"(a) ''company, means a company jn which not less than fift~ one per cent of the paid up share capital is held by the Government of Kerala or j'Jintly by the Central Government and the Government of Kerala and includes a company which is a subsidiary of any such company;
(aa) "corporation'' means a corporation established or constituted

(2) in clause (d), in the opening paragraph, after the words "or a Joe~ I authority", the words "or a company or a corporation" shall be r 1 111serted. ·

~. Amendment of sectio\1 3 -In section 3 of the principal Act, for the pr(!)viso to clause (a), the following proviso shall be suhlitituted, namely:-
"Provided that-
(i) in the. case of a local authority, the executive authority of that local authority; and .
(ii) in the case of a company or a corporation, an officer of that company or corporation not below the rank of a :qeputy Direc•or of the Industries Department, nominated by that company 6r corporation
shall be appointed as estate officer;".

1-•. Amendment of sectzon 6 -l, section 6 of the principal Act, ~n sub- se{,hon (2), after the words "or the local author1ty", the words "or the company or the corporation" shall be 1nserted. . .
5. Amendment of sectlon 12.-In sect10n 12:or tl,c principal Act, in sub· section (2), for the word~ "or to a local authority", the words or a local authority or a company or a corp01 atio:n" shall be substituted.

6. · Amendment of sectzon 13.-In section 13 of the principal Act, for the words "or to a loc;tl authontv", the words "or a local authonty or a company or a corporatiOn" shall be SUbStituted.
7. Amendment of secllon 14.-In section 14 of the principal Act, after the words <'or the local authonty", the words "or the company or the corpot:ation'' shall be Inserted. .
8. Amendme.nt of sectzon 17.- I o section I 7 of the principal Act, after the words "or a lo~al authority", the words '
9. Repeal and saving.-(1) The Kerala Public Buildtngs (Eviction of unauthorised O{,cupants) Amendment Ordmance, 1986 (54 of 1986),,. is hereby repealed.
(2) Notwithstanding such repeal, anythtng done or deemed to have been done or any actwn taken or deemed to have been taken under the principal Act as a1ncnded by the ·said Ord1nance shall be deemed to. a'Te been done or taken under the prll;tctpal Act as .amended by th1s Act.
