The Bihar Elementary School Education Committee (Repeal) Act, 2019

AN

ACT

To repeal the Bihar Elementary School Education Committee Act, 2011 (Bihar Act 12,

2011)

Preamble- Whereas, the "Right of children to Free and Compulsory Education Act, 2009"

has been enforced in all over India including the State of Bihar and in exercise of the powers conferred by section-38 of the said Act, the State of Bihar has already formulated "Bihar State Right of Children to Free & Compulsory Education Rules, 2011" which has also been amended from time to time; and

Whereas, all actions are being taken in view of provisions under the "Right of Children to Free & Compulsory Education Act, 2009" and "Bihar State Right of Children to Free & Compulsory Education Rules, 2011" (as amended from time to time), the existence of Bihar Elementary School Education Committee Act, 2011 has become irrelevant and, it is expedient to repeal the Bihar Elementary School Education Committee Act, 2011;

Now, therefore, Be it enacted by the Legislature of the state of Bihar in the seventieth year of the Republic of India as follows :-

1. Short title, extent and commencement :-

(1) This Act may be called The, "Bihar Elementary School Education Committee (Repeal) Act, 2019."

(2) It shall extend to the whole of the State of Bihar.

(3) It shall come into force at once.

2. Repeal and Savings :-

(1) The Bihar Elementary School Education Committee Act. 2011 (Bihar Act 12, 2011) is hearby repealed.

(2) Notwithstanding such repeal, the functions discharged under the said the Act will be treated valid and will not questioned on the basis of repeal of the Act. By Order of the Governor of Bihar,
