ACT

to establish and incorporate a University for the development of Veterinary Science, Animal Husbandry, Dairy Technology, Fisheries and allied sciences in the State of Bihar.

Be it enacted by the Legislature of the State of Bihar in the sixty Seventh year of the Republic of India as follows:-

Chapter-I

PRELIMINARY

1. Short title, extent, application and commencement - (1) This Act may be called the "Bihar Animal Sciences University Act, 2016

(2) It shall extend to the whole of the State of Bihar

(3) It shall come into force on such date as it may be fixed by the Government, by notification, in the Official gazette.

2. Definitions - In this Act and all Statutes and Regulations made thereunder, unless otherwise requires in the context :-

(1) "Academic Council" means the Academic Council of the University;

(2) "Act" means the "Bihar Animal Sciences University" Act, 2016;

(3) "Animal" means livestock, poultry, goats, other birds, fish and wildlife;

(4) "Animal Sciences" means Veterinary Science, Livestock, Poultry, Dairy, Fisheries, Wildlife, Poultry Farming and fields related thereto;

(5) "Associate Director" means Associate Director of Research & Extension posted in Headquarter of the University or in its Zonal / Regional Station.

(6) "Authority" means any authority of the University as specified in this Act;

(7) "Board" means Board of Management of the University;

(8) "College" means a constituent college of the University under its direct control and management whether located at the headquarter campus or elsewhere;

(9) "Chancellor" means Chancellor of the University;

(10) "Financial Comptroller" means Comptroller of the University;

(11) "Principal" means the head of the constituent college of the University and includes, where there is no principal, the person duly appointed to act as the principal for the time being and, in the absence of the principal or the acting principal, as the case may be, a vice-principal duly appointed as such;

(12) "Dean of the Faculty" means Dean of the subject matter faculty and the Faculty of Post Graduate studies;

(13) "Director" means Director of Resident Instruction, Director of Research and Director of Extension Education;

(14) "Education Extension Council" means Education Extension Council of the University;

(15) "Faculty" means Faculty in the University as specified in the Act and the Statutes

(16) "Farm" means livestock, poultry, dairy, fishery farms including fodder farms

(17) "Government" means Government of the State of Bihar

(18) "Governor" means the Governor of the State of Bihar.

(19) "Head" means Head of the Department of the University;

(20) "Hostel" means a place of residence for students of the University maintained or recognized by the University either as a part of or separate from University;

(21) "Livestock" means cattle, Cow, buffalo, goat, sheep, horse, pig, pets and other domestic animals;

(22) "Officer" means an officer of the University as specified in this Act, or other person (s) in the employment of the University declared as officer by the statutes.

(23) 'Ordinance' means the ordinances of the University for the time being in force.

(24) "Prescribed" means prescribed under the Act or the statutes/ regulations of the University;

(25) "Registrar" means Registrar of the University;

(26) "Regulations" means the regulations made under this Act;

(27) "Research Council" means Research Council of the University;

(28) "Statutes" means the statutes made under this Act.

(29) "Student" means the person enrolled in the constituent College/ Faculty of the University for taking a course of study for a degree, diploma or other academic distinction duly instituted;

(30) "Teacher" means a person not below the rank of Assistant Professor appointed or recognized by the University for the purpose of imparting education and / or conducting and guiding research and / or extension education programmes, and may include any other person who may be declared by the statutes to be a teacher with minimum prescribed qualifications;

(31) "University" means the "Bihar Animal Sciences University" as constituted under this Act;

(32) "Vice-Chancellor" means Vice-Chancellor of the University;

(33) "Veterinary" means the art and science related to animal health treatment and prevention of animal diseases;

(34) "Regional Station" means Regional station of the University;

(35) "Zonal Station" means zonal Station of the University. Chapter-II

THE UNIVERSITY

3. Establishment and Incorporation of the University - (1)(i) An University called the "Bihar Animal Sciences University" shall be established with effect from the date which may be notified by the State Government, by notification, in the official gazette.

(ii) All colleges, research and experimental centres, animal science centre or other Institutions mentioned in Schedule-1 shall be its constituent units under the full management and control of its officers and authorities and no such units shall be recognized as affiliated units. The State Government shall have power to add or remove any institution to/from Schedule-1.

(2) The University shall comprise of a Chancellor, a Vice-Chancellor, a Board of Management and Academic Council and such other authorities and officers as provided in this Act or in the statutes.

(3) The University subject to the provisions of this Act shall be a body corporate having perpetual succession and a common seal and shall sue and be sued by its name.

(4) The University shall be competent to acquire and hold property, both movable and immovable to lease, sell or otherwise transfer any movable or immovable property which have been vested in or have been acquired by it for the purpose of the University, and to take grants to borrow money from and to contract with any Body Corporate approved by the Central Government, State Government and to do all other necessary works for the purpose of this Act:

Provided that the University shall not lease, sell or otherwise transfer any immovable property transferred to the University by the State Government without prior approval of the State Government.

(5) The Headquarters of the University shall be at Patna, Bihar.

4. Territorial Jurisdiction - (1)With respect to teaching at the University or College level, research and extension education programmes in the field of Veterinary and Animals

Science as defined in this Act, the territorial jurisdiction and responsibility of this University shall extend to the whole of the State of Bihar.

(2) The University may establish, operate, maintain and develop Teaching Centres, Educational Centres, Research and Experimental Centres, and Extension Education Training Centres in the field of Veterinary, Animal Husbandry, Fishery, Poultry, Dairy Technology and allied subjects as may be required in various parts of the State, and shall be responsible for its management, development and operations.

(3) All colleges, research and experimental centres, or other institutions coming under the jurisdiction and authority of this University shall be as constituent units of the University under the full management and control of the University officers and authorities. No unit shall be recognized as an affiliated unit.

(4) The University may work having collaboration in teaching and research programmes, multi-disciplinary approach and academic programmes with other Universities, including foreign Universities or reputed and approved institutes. 5.Objectives of the University - The following are the objectives of the University :-

(i) To make arrangement for giving education in different branches of study, particularly Veterinary Science & Animal Husbandry, Poultry, Fisheries, Dairy and other allied branches of learning and scholarship;

(ii) To further the advancement of learning and conducting of research, particularly in Veterinary & Animal Sciences and other allied sciences;

(iii) To undertake the extension of education of such sciences and technologies that are relevant for the rural people of the State;

(iv) To facilitate and ensure qualitative improvement in the teaching and learning processes and methodology;

(v) To facilitate and ensure quality research in the contemporary and frontier areas of animal science and technologies;

(vi) To facilitate the need for an organized process of life long learning;

(vii) To disseminate knowledge and findings emerging in the University, its colleges, and institutions;

(viii) To establish partnerships with the industries and other entities working in animal science and technology and agriculture manufacturing;

(ix) To establish Hospital for treatment/ research-role of the University.

(x) Such other purposes as the University or Government may from time to time determine.

6. Admission to the University - (1) The University shall, subject to the provisions of this Act and the statutes, be open to all persons irrespective of caste, race, religions or class.

Provided that nothing in this section shall require the University to admit to any course of study any person who does not meet the prescribed academic standards for admission or to retain on the rolls of the University persons whose academic records are below the minimum standard required for the award of a degree or whose personal conduct is such as to be inimical to the purpose of the University or to the appropriate rights and privileges of other students and staffs:

Provided further that nothing in this section shall be deemed to require the University to admit to any course of study larger number of students than can be accommodated in the available faculties of the University or of any particular college or Department as determined by the Academic Council.

(2) Subject to the provisions under sub section (1), the University shall reserve seats for scheduled castes, scheduled tribes and other categories specified by the Government, provided that such person shall have the qualifications and standards prescribed for that category.

7.Powers and functions of the University -There will be following powers and functions of The University :-

(i) To provide for undergraduate and postgraduate instructions in Veterinary and Animal Science & Technology as defined and other allied branches of learning as the University may deem fit;

(ii) To provide for conduct of research in Veterinary and Animal Science & Technology and allied branches of learning;

(iii) To provide for dissemination of the findings of research and technical information through an extension education programme;

(iv) To institute courses of study and hold examinations for and confer degrees, diplomas and other academic distinctions on persons who have pursued a prescribed course of study or research or both in the University including part courses and / or research carried out in any other University or recognized institutions for the purpose;

(v) To confer honorary degrees and other distinctions as may be prescribed;

(vi) To provide training for field workers, village leaders and other persons not enrolled as regular students of the University;

(vii) To collaborate with other Universities and institutions in such manner and for such purposes as the University may determine, subject to the limitations set forth in sub-section (4);

(viii) To establish and maintain colleges, schools, centres, departments and institutions relating to veterinary sciences, animal husbandry, fisheries, dairy technology, poultry and allied sciences;

(ix) To establish and maintain laboratories, veterinary clinics, farms, libraries, research stations and institutions and museums for teaching, research and extension education;

(x) To create teaching, research and education extension posts and to appoint competent persons to such posts subject to prior approval of State Government;

(xi) To create administrative and other posts and to appoint competent persons to such posts subject to prior approval of State Government;

(xii) To institute and award fellowship, scholarships, stipends and prizes in accordance with the statutes;

(xiii) To institute and maintain residential accommodations for students and staff of the University;

(xiv) To fix and receive such fees and other charges in such manner as may be prescribed;

(xv) To supervise and control the residence, conduct and discipline of the students of the University and to make arrangements for promoting their health and welfare;

(xvi) To appoint, on contract or otherwise, Visiting Professors, Emeritus Professors, Consultants, Scholars and such other persons who may contribute to the advancement of the objects of the University;

(xvii) To determine the service conditions of all categories of staffs, including their code of conduct;

(xviii) To determine standards of admission, including the examinations, evaluation or any other method of testing for the University and constituent colleges of the University;

(xix) To receive benefactions, donations and gifts and to acquire, hold, manage and dispose off any property, movable or immovable, including trust and endowment properties for the purpose of the Universitys:

Provided that no immovable property shall be disposed off except with the prior approval of the State Government;

(xx) To lend and borrow with the approval of the Board and in the matters related to borrowing money for the purpose of the University on the security of the property of the University prior approval of the State Government shall be obtain;

(xxi) To initiate measures to enlist co-operation of industries and Government to provide complementary facilities;

(xxii) To further entrepreneurial ability among its teachers and students;

(xxiii) To educate the public with regard to the requirement of opportunities in the profession of animal science and technology;

(xxiv) To do all such works whether incidental to the powers aforesaid or not, in order to further the objects of the University;

8. Powers and Functions of the Chancellor-There will be the following powers and functions of The Chancellor :-

(i) The Governor of Bihar, shall be the ex-officio Chancellor of the University;

(ii) The Chancellor shall preside ever the convocation function of the University in case of being available;

(iii) Award, Honorary Degree or Privileges shall be conferred only after the approval of the Chancellor;

(iv) Without prejudice to other provisions of this section the Chancellor may by order in writing annual any proceeding of the University Authority or an officer which is not in conformity with this Act, statute or the ordinances:

Provided that before making any such order the Chancellor shall call upon, Authority or the concerned officer of the University to show cause why such an order should not be made, and, if any cause is shown within a reasonable time it shall be considered by The Chancellor.

(v) The Chancellor shall have such other powers as may be prescribed in the Act or by the Statute.

(vi) The Chancellor shall have the right to cause an inspection to be made, by such person or persons as he may direct, of the University, its buildings, laboratories, libraries, museums, farms, workshops and equipments and any institution, college or hostel maintained or administered by the University, of the teaching and other work conducted by the University or under its auspices and of the conduct of any other functions of the University and to cause an enquiry to be made in respect of any matter connected with administration and finances of the University.

(vii) The Chancellor shall, in every case, give due notice to the University or the Board of his intention to cause an inspection or enquiry to be made, and the

University or the Board, as the case may be, shall on receipt of such notice, have the right to make such representation to the Chancellor, as it may consider necessary, within such period as specified in the notice.

(viii) After considering the representation, if any, made by the University or the Board or any other institution, the Chancellor may make such inspection or inquiry as referred to in sub section (1).

(ix) Where an inspection or inquiry is conducted by the Chancellor, the University or the Board shall be entitle to appoint a representative who shall have the right to be present and be heard at such inspection or inquiry.

(x) The Chancellor shall communicate to the University or the Board with reference to the result of such inspection or inquiry along with his views thereon and such advice as the Chancellor may be pleased to offer upon the action to be taken thereon, and may, after obtaining the opinion thereon of the University, advice or direct the University to take necessary action fixing a time limit;

(xi) The University shall, within the time limit so fixed, report to the Chancellor the action which has been taken or is proposed to be taken on the advice tendered by the Chancellor.

(xii) The Chancellor may, where action has not been taken by the University to the satisfaction of the Chancellor within the time limit fixed and after considering any explanation furnished or representation made by the University, issue such directions as the Chancellor may think fit and the University shall comply with such directions.

(xiii) Notwithstanding anything contained in the preceding sub-sections of this section, if at any time the Chancellor is of the opinion that no accurate action is being taken in any of the matters of the University or not being taken in view of the provisions of this Act, and the statutes and regulations or the special measures desirable to maintain the standards of university teaching, examination, research or extension, he may issue show cause to the University and call upon the University to offer such explanations, within such time as may be specified by the Chancellor. If the University fails to offer any explanation within the time specified or offer an explanation which, in the opinion of the Chancellor, is unsatisfactory, the Chancellor may issue such instructions as appear to him to be necessary and desirable in the circumstances of the case and may exercise such powers as necessary for giving effect to those instructions.

(xiv) The University shall furnish such information relating to its administration to the Chancellor as it may be required by him.

Chapter-III

AUTHORITIES OF THE UNIVERSITY

9. Authorities of the University - The following shall be the authorities of the University namely :-

(1) Board of Management;

(2) Academic Council;

(3) Research Council;

(4) Extension Education Council;

(5) Faculties including faculty of Post-graduate studies and their Board of studies;

(6) Such other bodies of University as may be declared by the Statutes to be authorities of University.

10. Board of Management and its Constitution - (1) The Chancellor shall as soon as possible, after the first Vice-Chancellor is appointed, constitute the Board of Management.

(2) The Board of Management shall be the Chief Executive body of the University and shall consist of the following :-

(i) The Vice-Chancellor;

(ii) Principal Secretary / Secretary, Department of Animal and Fisheries Resource of the State Government;

(iii) Principal Secretary / Secretary, Finance Department of the State Government or his nominee;

(iv) Principal Secretary / Secretary, Deptt. of Agriculture of the State Government;

(v) Director, Animal Husbandry, Department of Animal & Fisheries Resource of the State Government;

(vi) Director, Fisheries, Department of Animal & Fisheries Resource of the State Government;

(vii) Director, Dairy Development, Department of Animal & Fisheries Resource of the State Government;

(viii) Two eminent educationists / scientists from the field of Veterinary and Animal Sciences to be nominated by the Chancellor;

(ix) One progressive farmer from the jurisdiction of the University to be nominated by the State Government;

(x) One distinguished agro-industrialist to be nominated by the State Government;

(xi) One outstanding woman social worker having background of rural advancement to be nominated by the State Government;

(xii) One representative from the Indian Council of Agricultural Research either from Education or Animal Science Division to be nominated by the Council;

(xiii) One Director in rotation to be nominated by the Vice-Chancellor;

(xiv) One Dean faculty in rotation to be nominated by the Vice- Chancellor;

(xv) Registrar.

(3) The Vice-Chancellor shall be the ex-officio Chairperson and the Registrar non-member-Secretary to the Board.

(4) The term of the office of the members of the Board other than the ex-officio members shall be three years.

(5) When a vacancy occurs in the office of any member by the reason of death, resignation or any cause other than the expiry of the term, the vacancy shall be filled in accordance with the provisions of this section and the person who fills such vacancy shall hold office for the residue of the term for which the person whose place he fills would have been a member.

(6) No action or proceedings of the Board shall be invalid merely on the ground of the existence of any vacancy in the Board or defect in its constitution.

(7) Quorum will be present with the presence of one third members of the Board at a meeting of the Board:

Provided that if a meeting of the Board is adjourned for want of quorum, no quorum shall be necessary at the next meeting called for transacting the same business.

(8) The members of the Board other than the officers of the University and Bihar Government who are member of the Board, shall be entitled to such daily and travelling allowances and honorarium as may be determined by the Board of Management.

(9) No officer or other employee of the University shall be eligible to be a member of the Board under clause (v) to (ix) of sub-section (2) of this section.

(10) The Board for the purpose of consultation may invite any person having experience or special knowledge on any subject under consideration to attend its meeting. Such person may put on his veiws in the meeting or otherwise take part in the proceedings of such meeting but shall not be entitled for voting right. Any person so invited shall be entitled to such allowances for attending the meeting as may be prescribed.

(11) Normally the Board shall meet definitly once in every three months on dates to be fixed by the Vice-Chancellor. However, Vice-Chancellor may whenever, he thinks fit and shall, upon the requisition in writing and signed by not less than five members of the Board, convene as special meeting of the Board.

11. Power and Functions of the Board - (1) Subject to the provisions of this Act and the Statutes, the Board shall be the Chief Executive Body of the University and shall manage and supervise the properties and activities of the University and shall be responsible for the conduct of all administrative affairs of the University not otherwise provided for in this Act.

(2) Without prejudice to the generality of theforegoing powers under the provisions of sub-section (1) the Board shall exercise and perform the following powers and functions:-

(i) to consider and approve the financial requirements, estimates and the budget of the University;

(ii) to hold and control the property and the funds of the University and issue any general directive on behalf of the University

(iii) to accept or transfer any property on behalf of the University

(iv) to administer funds placed at the disposal of the University for the purpose intended

(v) to arrange for the investment and withdrawal of the funds of the University

(vi) to borrow money for capital investments with prior approval of the State Government and make suitable arrangements for its repayment

(vii) to accept on behalf of the University trusts, bequests and donations

(viii) to consider and approve the recommendations of the Academic, Research and Education Extension Councils where required

(ix) to direct in respect tothe form and use of the common seal of the University

(x) to appoint such committees and bodies as it may deem necessary and determine the terms of reference their context in accordance with the provisions of this Act and the Statutes

(xi) to consider and approve the establishment of a new Department, Centre or Research Station / sub-station or abolition of any one thereof or otherwise reconstitution of Department, Research Stations or centre on the recommendation of the Academic Council.

(xii) to consider and approve establishment of a new college or faculty, amalgamation of two or more colleges or faculties into a single college or faculty or abolition of a college or faculty or reconstitution of any of the existing faculties on the recommendation of the Academic Council

(xiii) to approve the recommendations for appointment of officers/officials of the University and teachers of the rank of Associate Professor and above in the prescribed manner.

(xiv) creation of various posts in the University and its Colleges, institutions and centres.

(xv) To perform such other functions as may be assigned to it by Statutes.

12. Academic Council - (1) Academic Council shall consist of the following members :-

(i) The Vice-Chancellor, Ex-officio Chairperson;

(ii) The Directors of Resident Instruction, Research and Education Extension;

(iii) The Deans of the various faculties and Principals of colleges;

(iv) The University Librarian-cum-Information Officer;

(v) Student welfare officer;

(vi) One Head of the Department from each faculty nominated by the Vice-Chancellor on rotation basis

(vii) One Associate Director Research or Extension to be nominated by the Vice-Chancellor on rotation basis

(xiii) All Chairmen -cum-Professors of the University

(ix) One Assoc. Professor from each faculty to be nominated by the Vice- Chancellor on rotational basis and in the prescribed manner.

(x) One eminent educationist in the field of Animal Sciences and allied subjects from outside the University to be nominated by the Vice- Chancellor with the approval of the Board.

(xi) Registrar as member-secretary.

(2) Academic Council may co-opt as members not more than four person for such period and in such manner as may be prescribed so as adequate representation of different sectors of Animal Science and allied fields may be ensured.

(3) All members of the Academic Council except the ex-officio members and members referred in sub-section (2) shall hold office for a term of two years.

(4) Quorum will be present with presence of one third of the members of the Academic Council at the meeting of the Council:

Provided that if a meeting of the Council is adjourned for want of quorum, no quorum shall be necessary at the next meeting called for transacting the same business.

(5) Normally the Academic Council shall meet once in every four months on such date as may be fixed by the Vice-Chancellor. However, special meetings of the Academic Council may be called by the Vice-Chancellor.

13. Powers and Functions of the Academic Council - (1) The Academic Council shall subject to the provisions of this Act and the Statutes, have powers to determine by regulations, all courses of Study and curricula, and shall have control on teaching and other educational programmes within the University, and shall be responsible for the maintenance of standards thereof.

(2) The Academic Council shall have power to make regulations consistent with this Act and the Statutes relating to all academic matters subject to its control and to amend or repeal such regulation.

(3) In particular, and without prejudice to the generality of the foregoing powers; the Academic council shall have the following powers :-

(i) to advise the Board and Vice-Chancellor on all academic matters including the control and management of libraries;

(ii) to make recommendations for the institution of professorships, associate professorships, assistant professorships and other teaching posts including posts in research and education extension and in regard to the duties thereof;

(iii) to make recommendations for the constitution or reconstitution of departments / faculties of teaching, research and education extension;

(iv) to make regulations regarding the admission of students to the University; and determine the number of students to be admitted;

(v) to make regulations relating to the courses of study leading to degrees, diplomas and certificates;

(vi) to make regulations relating to the conduct of examinations and to maintain and improve standards of education;

(vii) to make recommendations to the Board regarding conferment of honorary degree;

(viii) to make recommendations regarding the qualifications to be prescribed for teachers in the University;

(ix) to exercise such other powers and perform such other functions as may be conferred or imposed on it under the provisions of this Act, by the Board or Vice-Chancellor;

14. Research Council - (1) There shall be a Research Council consisting of the following members :-

(i) The Vice-Chancellor;

(ii) The Directors of Animal Husbandry / Dairy/ Fisheries, Director Agriculture / Chief Conservator of Forests

(depending upon nature of research programmes of the University) of Government of Bihar;

(iii) All Directors of the University;

(iv) All Deans of the Faculties;

(v) All Associate Directors Research & Extension;

(vi) All Head of the Departments , University Professors and the Chairmen of the Centres;

(vii) Two eminent scientists in the field of Animal Sciences and allied subjects from outside the University to be nominated by the Vice- Chancellor subject to approval of the Board;

(viii) Research Council may coopt as members not more than four persons for such period and in such manner as may be prescribed so that adequate representation of different sectors of Animal Sciences and allied fields may be ensured.

(2) Vice-Chancellor shall be ex-officio Chairperson and Director Research shall be its Member-Secretary.

15. Functions of Research Council - (1)The Research Council shall consider and make recommendations in respect of the followings :-

(i) research programmes and projects undertaken or to be undertaken by the various University units in the State in the field of Veterinary Science and Animal Husbandry, Dairy Technology, Fisheries, Poultry and other allied Sciences with a view to promote effective co- ordination;

(ii) To give physical, fiscal and administrative facilities required for implementing research projects;

(iii) To make useful orienting research to meet for the farmers' needs;

(iv) To consolidate integration of research, extension education and teaching and participation of research workers in teaching and to ensure participation in education extension programme;

(v) any other matter pertaining to research programmes which may be referred by the Vice-Chancellor or the Board or any other authority of the University.

16. Extension Education Council - (1) There shall be an Education Extension Council consisting of the following members :

(i) Vice-Chancellor;

(ii) Directors of Animal Husbandry / Dairy / Fisheries of Government of Bihar;

(iii) All Directors of the University;

(iv) All Deans of the Faculties;

(v) All Heads of the Departments / Regional Research Stations / Colleges / Centres;

(vi) Two eminent persons of the field of Education Extension from outside nominated by the Vice-Chancellor for any particular meeting in accordance with the requirement of the agenda;

(vii) Three progressive farmers having specialization in general Animal Husbandry, Fisheries and other allied branches to be nominated by the Vice-Chancellor for their specialized knowledge and experience;

(viii) One representative each of the under mentioned organizations as per request of the Vice-Chancellor _

(a) Rural Development Department;

(b) Co-operative Department;

(c) Any other Agro-Industries or Agro-Service Organizations/ Corporations;

(2) Vice-Chancellor shall be ex-officio Chairperson and Director Education Extension Member Secretary.

17. Functions of the Extension Education Council - (1) Education Extension Council shall consider and make recommendations in respect of the following :-

(i) The Education Extension Programmes and Projects of the University;

(ii) Co-ordination of Extension Education activities for improvement of Animal Husbandry and allied branches and for the development of Rural communities;

(iii) Development of Farmers' Education and Training and Advisory Services, identification and resolution of field problems and transmission of informations;

(iv) Methodology of EducationExtension;

(v) Integration of Education Extension with teaching and research in the University and ensure the participation of teachers and research workers in Education Extension programmes;

(vi) Any other matter referred to it by the Vice-Chancellor, Board or any other authority of the Univeristy.

18. Faculties and its Board of Studies - (1) The University shall have initially the faculties of, Veterinary Science & Animal Husbandry, Dairy Technology, Fisheries, Poultry and Post-Graduate Studies and such other faculties as may be later prescribed by the statutes.

(2) Each faculty shall have a Dean, who shall be appointed in such manner as may be prescribed in statues.

(3) These faculties shall comprise of such department / centres as may be prescribed. However, depending on the nature of the subject and functions, one department / centre may cater to the needs of more than one faculty.

(4) Each faculty shall consist of such members as may be prescribed. Dean of the concerned faculty will be the Chairperson

(5) The functions of each faculty shall be the following :-

(i) To revise teaching programmes and suggest for improvement thereof

(ii) To consider the recommendations of the respective Board of studies and to place the same before the Academic Council for consideration and approval

(iii) Faculties of the Subject matter shall be responsible for Bachelor degree programme while Faculty of Post-Graduate Studies shall be responsible for Post-Graduate and Doctoral degree programme.

(iv) Such other functions as may be assigned to it by the Academic council or Vice-Chancellor.

(6) There shall be Board of Studies of each faculty; the constitution of which shall be made such manner as it may be prescribed. Dean Faculty shall be its Chairperson.

(7) Followings shall be the functions of the Board of Studies:-

(i) To propose the instructions to the faculty concerned, the Courses of study and curricula for various educational programmes offered by the faculty

(ii) To perform such other functions as may be directed by the concerned faculty, other authorities and Vice-Chancellor

19. Constitution of Committees - Every authority shall have the power to appoint committees which may unless otherwise provided in this Act or Statutes consist of the members of the authority and such other persons as it may deem eligible.

20. Provisions in relation to membership of authorities - (1) Save as otherwise provided in this Act if any member other than ex-officio member of any authority or body of the University is unable by reason of his death, resignation, removal or otherwise, to complete his full term of office, the vacancy so caused shall, as soon as convenient, be filled by the appointment, nomination or co-option, as the case may be and the person so appointed, nominated or co-opted shall fill such vacancy for the un-expired portion of the term of the member, in whose place such person is appointed, nominated or co-opted, would otherwise have continued in office.

(2) The Board may remove any person from membership of any authority or body of the University on the ground that such person have been convicted of any offence involving moral turpitude or conduct not befitting the office held by the concerned member with the approval of the Chancellor, but prior approval of the Chancellor shall not be necessary where such a person has been convicted by a competent court of laws:

Provided that no such order shall be made against any person without giving reasonable opportunity of being heard.

(3) A person who is a member of any authority or body of the University as a representative of another body whether of the University or not shall cease to be a member of such authority or body if before the expiry of the term of his membership he ceases to be a member of that other body by which he was appointed or nominated.

(4) Whenever any person becomes a member of any authority or body of the University by virtue of the office held by him, he shall forthwith cease to be a member of such authority or body if he ceases to hold such office before the expiry of the term of his membership.

Provided that he shall not be deemed to have ceased to hold his office merely by reason of his proceeding on leave for a period not exceeding four months.

(5) Any member, other than an ex-officio member of any authority or body of the University may resign his office by letter addressed to the Vice-Chancellor and such resignation shall take effect from the date on which the same is accepted by the authority competent to fill the vacancy or on the expiry of three months from the date of its receipt by the Vice-Chancellor, whichever is earlier.

21.Validity and Protection of the acts - (1) No act or proceeding of any authority or body of the University shall be invalid by reason of the existence of any vacancy among its members or by reason of some person having taken part in the proceedings who is subsequently found to have been not entitled to do so.

(2) Save as otherwise provided in this Act, all the acts done or orders made in good faith by the University or any of its authorities shall be final and no suit shall be instituted against or damages claimed from the University or its authority for anything done or purported to have been done in pursuance of this Act or the Statues or the Regulations.

(3) No suit or other legal proceedings shall lie against any officer or other employee of the University in respect of anything which is in good faith done or intended to be done in pursuance of this Act or any Statues made thereunder.

Chapter-IV

OFFICERS OF THE UNIVERSITY

22. Officers - The following shall be the officers of the University namely :-

(i) The Vice-Chancellor;

(ii) The Director Resident Instruction;

(iii) The Director of Research;

(iv) The Director of Education Extension;

(v) The Deans of the Faculties;

(vi) The Registrar;

(vii) The Finance Comptroller;

(viii) The University Librarian-cum-Information Officer;

(ix) The Student's Welfare Officer;

(x) Law Officer;

(xi) Public Relation Officer;

(xii) Such other persons in the service of the University as may be declared by the Statutes to be the Officers of the University.

23. The Vice-Chancellor - (1) (i) Persons of the highest level of competence, integrity, morals and institutional commitment are to be appointed as Vice-Chancellor. The Vice-Chancellor to be appointed should be a distinguished academician, in Animal Sciences and Technology with a minimum of ten years of experience as Professor in a University system or ten years of experience in an equivalent position in a reputed research and/or academic administrative organization.

(ii) The selection of Vice-Chancellor should be through proper identification of a panel of 3 names by a Search Committee through a public notification. The members of the above Search Committee shall be persons of eminence in the sphere of higher education and shall not be connected in any manner with the University concerned or its colleges. While preparing the panel, the search committee must give proper weightage to academic excellence, exposure to the higher education system in the country and abroad, and adequate experience in academic and administrative arena to be given in writing along with the panel to be submitted to the Chancellor.

Vice-chancellor will be appointed by the Chancellor in an effective and meaningful consultation with the state govt. from the panel of minimum three persons (names arranged in alphabatical order) recommended by the committee constituted under subsection(iii) of this section but if the Chancellor does not approve any of so recommended persons, he may call for new recommendations in consultation with the government.

(iii) The Search Committee shall be constituted by the following manner :-

(a) A member of Chief Secretary rank nominated by the State Government who shall preside over the meeting of search committee as Chairman

(b) A member nominated by the Chancellor, who shall be an eminent Scholar/Academician of national repute or (ICAR award) in the field of education or Veterinary & Animal Science.

(c) The Director or Head of an institute or organization of national repute, related to Animal Husbandry/Fisheries/Dairy Technology or Vice-Chancellor of a statutory University nominated by the Chancellor as member.

(2) The first Vice-Chancellor shall be appointed by the Government till the sub- sections 1 (ii) and 1 (iii) become operational.

(3) The first Vice Chancellor shall hold office for a term of five years and extendable for two more years from the date on which he enters upon his office and be eligible for the appointment for the next term and maximum age limit will be 70 years. Subsequent Vice- Chancellor shall hold office for a term of three years or till he attains the age of 70 years which ever is earlier:

Provided that the State Govt. may require the Vice-Chancellor after his term has expired, to continue in office for such period, not exceeding a total period of one year or as may be specified by the Government.

(4) The emoluments and other conditions of service of the Vice Chancellor shall be as prescribed by Statutes;

(5) If the office of the first Vice Chancellor becomes vacant due to death, resignation or otherwise or if he is unable to perform his duties due to ill health or any other cause, the State Government shall have the authority to appoint Vice Chancellor for the residual term.

24. Removal of the Vice-Chancellor - (1) If at any time and after such inquiry as may be considered necessary, it appears to the Chancellor that the Vice-Chancellor

(i) has failed to discharge any duty imposed upon him by or

(ii) has acted in a manner detrimental and prejudicial to the interest of the University or

(iii) has been incapable of managing the affairs of the University or acted in a manner suggestive of misbehavior, the Chancellor may, notwithstanding the fact the term of office of the Vice-Chancellor has not expired, require the Vice-Chancellor by reasoned order in writing after consultation with the State Government, may requir to resign his post from the date as may be specified in the order.

(2) No order under sub-section (1) shall be passed unless a notice stating the specific grounds on which such action has been proposed has been served for a reasonable opportunity to show cause against the proposed order, has been given to the Vice-Chancellor.

(3) On and from the date specified in the sub-section(1) of this section it shall be deemed that the Vice-Chancellor has resigned his post and the office of the Vice-Chancellor shall be deemed vacant.

25. Powers and Duties of Vice-Chancellor - (1) The Vice-Chancellor shall be the principal executive and academic officer of the University and ex-officio Chairperson of the Board, Academic Council and other authorities and shall in the absence of the Chancellor preside at the convocation of the University and confer degrees on persons entitled to receive them.

(2) The Vice-Chancellor shall convene the meetings of the Board , Academic Council, Research Council and Education Extension Council.

(3) The Vice-Chancellor shall exercise general control over the affairs of the University and shall be responsible for due maintenance of discipline in the University.

(4) The Vice-Chancellor shall ensure faithful observance of the provisions of this Act and Statutes and Regulations.

(5) The Vice-Chancellor shall be responsible for the presentation of the annual financial estimates and the annual accounts and balance sheet to the Board of Management.

(6) The Vice-Chancellor may, if he is of the opinion that immediate action is necessary on any matter, exercise any power conferred on any authority of the University by or under this Act and shall report to such authority at its next meeting the action taken by him on such matter:

Provided that such exercise of power shall be made only in emergent situation in no case in respect of creation and upgradation of posts an appointment thereto and emoluments thereof:

Provided further that if the authority concerned is of the opinion that such action ought not to have been taken by the Vice-Chancellor it may refer the matter to the Chancellor whose decision thereon shall be final:

Provided also that if any person in the service of the University who is aggrieved by the action taken by the Vice-Chancellor shall have the right to appeal against such action to the Board within three months from the date on which decision on such action is communicated to him and thereupon the Board may confirm, modify or reverse action taken by the Vice-Chancellor.

(7) The Vice-Chancellor, if he is of the opinion that any decision of any authority of the University is beyond the powers of the authority conferred by the provisions of this Act, the Statutes, the Regulation or that any decision taken is not in the interest of the University, may ask the authority concerned to review its decision within sixty days of such decision and if the authority refuses to review the decision either in whole or in part or no decision is taken by it within the said period of sixty days, the matter shall be referred to the Chancellor whose decision thereon shall be final.

(8) Where any action taken by the Vice-Chancellor under sub-section (7) affects any person in the service of the University to his disadvantage such person may prefer an appeal to the Board within thirty days from the date on which such person has been served with a notice of the action taken.

(9) Subject to the provisions of the preceding sub-sections the Vice-Chancellor shall give effect to the decisions of the Board regarding the appointments, promotions and dismissal of officers, teachers and other employees of the University

(10) The Vice-Chancellor shall be responsible for the proper administration of the affairs of the University and for a close co-ordination and integration of teaching, research and education extension.

(11) The Vice-Chancellor shall exercise such other powers and perform such other duties as are conferred or imposed upon him under the provisions of this Act and the Statutes.

26.Other officers of the University - General Terms & Conditions:-The officers of the University referred to in clause (iii) to (xi) of section 22 shall be appointed by the Vice- Chancellor with the approval of the concerned authority of the University on such terms and conditions as may be prescribed.

Provided that the Vice-Chancellor may make appointments of such officers as a temporary measure for a period of six months under intimation to the concerned authority of the University.

27. Directors, Dean, Registrar, Financial Controller etc.- (1) Director, Resident Instruction : There shall be a Director of Resident Instruction who shall be responsible for

direction and co-ordination of inter-faculty and inter-campus residential instructional programmes and for maintenance and improvement of standard of teaching at all levels of under graduate and post-graduate studies. He will be concerned with the policy matters and system regarding residential instructions in the University and development of educational technology and teacher's training programme. He shall also function as Dean, Faculty of Post-graduate Studies.

(2) Director, Research - There shall be a Director of Research who shall be responsible for the direction and co-ordination of research programmes in the University as laid down in section 30 and efficient working of research stations.

(3) Director, Education Extension - There shall be a Director of Education Extension who shall be responsible for the Veterinary and Animal Science Education Extension programmes as laid down in section 31.

(4) Dean of the Faculty - (i) He shall be the Chairperson of the Faculty and the Board of Studies of the concerned faculty and shall be responsible to the Vice-Chancellor for the organization and implementation of the teaching programme of the faculty.

(ii) The Dean, Faculty of Post-graduate Studies shall co-ordinate post- graduate studies in all Departments, Colleges, and units of the University.

(5) Registrar - (i) The Registrar shall be ex-officio non-member Secretary of the Board of Management and ex-officio Member- Secretary of the Academic Council.

(ii) The Registrar shall be responsible for the due custody of records and common seal of the University.

(iii) The Registrar shall be responsible for maintaining permanent records of the Academic Council, performance of the students of the University including the courses taken, credits obtained, degrees, prizes or other distinctions and other items pertaining to the academic performance and the discipline of the students.

(iv) The Registrar shall invite and receive applications for admission into the University.

(v) The Registrar shall be responsible for establishment matter and general administration in the university as prescribed.

(6) Finance Comptroller - (i) The Finance Controller shall be responsible for preparation of the budget and the statement of accounts of the University. He shall manage the funds and investments of the University. He shall be responsible for ensuring that the expenditure is made as authorized.

(ii) The Finance Controller shall arrange periodical internal inspections of the accounts maintained in the various units of the University.

(iii) The Finance Controller shall be responsible for the maintenance of the accounts of the University in the form and manner as approved by the Board and keep constant watch on the state of cash and bank balance and on the state of investment.

(iv) The Finance Controller shall see that the register of buildings, farms, furniture / equipments and other items are maintained up-to-date

and that the stock checking is conducted of all items in all offices and units of the University.

(7) University Librarian - He shall be responsible for the maintenance and management of the University Library, to guide and co-ordinate the working in the libraries of the various constituent units of the University, to prepare the annual estimate of operational and developmental requirements of all the libraries of the University for incorporation in the budget estimates.

(8) Student's Welfare Officer - There will be following functions of the Students Welfare Officer :-

(i) to make arrangements and supervise management of student's hostel, cafeteria and mess.

(ii) to plan and organize students extra-curricular activities such as sports, cultural and other recreational activities, national cadet corps and other allied activities of the University.

(iii) to plan and direct the programme of student advisement and counselling and to enlist the co-operation of prospective employers and employment agencies to assist in the placement of graduates of the University and to promote discipline amongst the students of the University.

(iv) to supervise and control medical and health services and other welfare measures in the University.

(v) to make arrangements for scholarships, stipends, part-time employments and travel facilities for the study tour of the students.

(vi) Where necessary, Students' Welfare Officer shall consult Deans / Directors.

(9) Law Officer:- He shall be the Principal legal adviser to the University. All legal matters shall be handled by him and he shall represent the legal interest of University in all matters in various courts.

University it think proper may appoint a panel of lawyers on fixed fees to assist the Law Officer.

(10) Public Relation Officer - He shall be responsible for all protocol duties of the University, for its public relations functions, for liaisoning with other authorities and perform such other functions as the Vice- Chancellor may assign to him from time-to- time.

(11) Subject to the provisions of this Act, the Officers of the University referred to in clauses (iii) to (xi) of section 22 shall perform such other duties as may be prescribed or as may be assigned to them, from time to time, by the Board or the Vice-Chancellor. Chapter-V

RESIDENT INSTRUCTION, RESEARCH AND EXTENSION EDUCATION

28. Resident Instruction - (1) Subject to provisions of this Act and the Statutes, Resident Instruction in the University shall include Bachelor's, Master's and Doctoral degree progammes and short-term diploma / certificate courses in the disciplines of Veterinary Science and Animal Husbandry, Dairy Technology, Fisheries, and other allied sciences which may be prescribed.

(2) Resident Instruction programmes shall be based on modern system of Education with the objective of producing competent and practical oriented graduates and post-graduates to handle production, management, research, education extension and

teaching work in the field of Veterinary Science, Animal Husbandry, Dairy Technology, Fisheries and allied sciences.

(3) The existing colleges and teaching units along with the facilities and the budgets in the field of Veterinary Science, Animal Husbandry, Dairy Technology and Fisheries etc. in the Bihar Agricultural University / Rajendra Agricultural University shall be transferred to the University with effect from such date as the Government may notify. 29.Research - (1) Subject to the provisions of this Act and the Statutes, research programme in the University shall carry on research (fundamental as well as applied) on the problems of Veterinary Science, Animal Husbandry, Dairy Technology, Fisheries and other allied sciences for the purpose of aiding the development of these branches for the benefit of rural population in the State.

(2) The University through its research organization shall be the principal agency of control over research activities in Veterinary Science, Animal Husbandry, Dairy Technology, Fisheries and other allied branches in the State.

(3) The existing research organization (As per schedule-i) and experimental station and farms along with the facilities and budget in the field of Veterinary Science, Animal Husbandry, Dairy Technology, Fisheries and allied branches in the Government Departments shall be transferred to the University with effect from such date as the Government may notify.

(4) The University may establish Regional / Zonal Research Stations and Sub- stations in the different agro-climatic zones of the State for the conduct of research. 30.Education Extension - (1) Education Extension programme shall be enitiated in the University and shall be, subject to the provisions of this Act and the Statutes, made useful information based upon findings of research available to farmers and others to help and solve their problems. It shall conduct demonstrations and training programmes for the benefit of students, extension workers, farmers and entrepreneurs. Extension Education shall be co-ordinated with the other functions of the University and other appropriate agencies of the State.

(2) The University shall be responsible for the Veterinary, Animal Husbandry, Dairy, and Fisheries and allied branches Extension Education activities in the State as in subsection (1) above. In order that the University may conduct such activities, the State may transfer to the University the necessary personnel, facilities and funds in accordance with a plan to be developed as mutually agreed upon by the Board and the Government. 31.Co-ordination of teaching, research and education extension, integration of functions , curricula and services - (1) In consultation with the competent officers of the University, the Vice-Chancellor shall be responsible for taking such steps as may be necessary for the full co-ordination of teaching, research and extension activities of the University.

(2) The Vice-Chancellor shall be responsible, working through the appropriate officers of the University, for seeing that conditions are established whereby there is feasible progress in the development of new information and technology in the natural, physical and social sciences related to Veterinary & Animal Sciences and its transfer to the teaching curricula and other educational programme leading to their understanding and adoption where applicable in practice throughout the State.

(3) The Vice-Chancellor shall be responsible and working through the appropriate officers and staff of the University to see that there is an appropriate inter-relation in the different curricula and courses offered in the different faculties of the University so as to

avoid unnecessary duplication of functions between faculties of the University and provide the students with the best course offerings and faculty contacts feasible within the University's resources and talents.

(4) The University shall develop its programme of research and education extension keeping in view the needs of the State and provide the appropriate technical support and advice to the Government departments engaged in the development work in Veterinary Science, Animal Husbandry, Dairy, Fisheries and other allied branches. Chapter-VI

FUNDS AND ACCOUNTS

32. The University Funds -(1) The University shall have a General Fund to which the following shall be credited :-

(i) its income from fees, donations, endowments, gifts, benefactions, grants, loans and borrowing and income received from properties of the University.

(ii) income from the property of the University such as hostels, research centers, farms etc.

(iii) contribution and grants made by the State and Central Government on such conditions as are consistent with the provision of this Act

(iv) Other contributions, grants, donations benefactions and loans and other receipts.

(v) University may create other funds as provided for in the Statutes.

(vi) The Government may provide additional support and grant to the University for learning and research.

(2) The University shall furnish statements of accounts, reports and other particulars to the Government relating to any grant made by the Government and shall take such action and furnish such statements, accounts, reports and other particulars relating to the utilization of any grant within such time and manner as the Government may direct.

(3) University shall be competent in furtherance of its objectives to accept the grants from the Government or any other State Government or the Central Government or Statutory Bodies or endowments or donations under such conditions as may be agreed upon between the University and the granter or donor.

33.Management of Funds - The General Fund, Foundation Fund and other funds of the University shall be managed according to the provisions laid down by the Statutes. 34.Accounts and Audit - (1) The Annual Statement of accounts of the University shall be prepared by the Comptroller and audited and certified by an authority to be nominated or authorized by the Government. The Statement shall include all the money accruing to or received as sponsered or benefits by the University from whatever source and all amount disbursed and paid by the University. Such statement shall be submitted to the Government by the Board normally within six months after close of the financial year to which these pertain.

35. Provident Fund, Pension and Insurance - (1) The University shall constitute for the benefit of its officers, teachers, ministerial staff and other employees, in such manner and subject to such conditions as may be prescribed, such pension, gratuity, insurance, provident fund as it may deem fit provided it does not violate prevailing govt. policy.

(2) For such pension, gratuity, insurance and provident fund so constituted by the University, the government may declare that the provisions of the Provident Funds Act shall apply to such fund as if it were Government provident fund:

Provided that the University shall have power in consultation with the Finance Committee and the Board to invest provident fund amount in such manner as it may determine.

36.Government Grants :-The Government shall every year make the following lump sum grants to the University, namely :-

(i) A grant not less than the net expenditure incurred in the State of Bihar on such of the activities of the Institutions of Veterinary Science, Animal Husbandry, Dairy, Fisheries and other Government agencies / institutions as are transferred to the University;

(ii) A grant not less than the estimated net expenditure of pay and allowances of the staff, contingencies, supplies and services of the University other than in respect of the activities in various organizations, referred to above in clause (i)

(iii) A grant to meet such additional items of expenditure recurring and non- recurring as may be deemed necessary by the Government for the proper functioning of the University

(iv) The State Government may also make non-lapsable lumpsum grant to the University in respect of schemes included in the Five year Plan and transferred to it for implementation by the University of an amount equal to the net outlay in the annual plan. Adjustments of from the anticipated assistance from the Central Government and other agencies sponsoring such schemes may be made in it.

(v) The state government may pay the full cost of the constructions and furnishing of the building of the University.

37.Finance Committee - (1) The Board shall constitute a Finance Committee consisting of :-

(i) The Vice-Chancellor (Ex-officio Chairperson)

(ii) A Officer, nominated by the Department of Finance, Government of Bihar, Nominated by him -Member

(iii) A Officer, nominated by the Department of Animal Husbandry & Fisheries Resource, Government of Bihar -Member.

(iv) Director Research, Director Education Extension, Director Resident Instruction - Member.

(v) One nominee of the Board who should be the non-official member of the Board - Member.

(vi) Financial Controller Ex-officio Member - Secretary.

(2) The following will be the functions of the Finance Committee :-

(i) To examine the annual accounts and budget estimates of the University and to advise the Board thereon

(ii) To review the financial position of the University from time to time

(iii) To make recommendations to the Board on all matters relating to the finances of the University.

(iv) To get the accounts of the University, its colleges and other centers/ institutions audited.

Chapter-VII

STATUTES AND REGULATIONS

38. Statutes - Subject to the provisions of this Act, provisions may be made by the Statutes of the University for any matter whatsoever connected with the affairs of the University particularly for the following matters :-

(i) constitution, powers and duties of the Authorities and other bodies of the University, as may be constituted from time to time;

(ii) constitution, composition and functions of other bodies or committees, necessary or desirable for improving the academic life of the University;

(iii) designations, powers, functions, duties, manner of appointment and selections, and terms and conditions of service of the officers of the University and Colleges/institutions other than Chancellor and Vice- Chancellor;

(iv) classification, qualification and manner of appointment, terms and conditions of services and duties of teachers and non-teaching staff of the University;

(v) terms and conditions of service of the Vice-Chancellor;

(vi) establishment, amalgamation, sub-division or abolition of faculties, Departments/Research Stations/Centres or other units of the University;

(vii) establishment of pension and insurance schemes for the benefit of officers, teachers and other employees of the University and the rules, terms and conditions of such schemes;

(viii) holding of convocations to confer degrees and diplomas;

(ix) conferment and withdrawal of honorary degrees and academic distinctions;

(x) creation of post, conditions of service, remunerations and allowance including travelling and daily allowances to be paid to officers, teachers and other persons employed under the University;

(xi) conditions and manner of appointment and the duties of examining bodies and examiners;

(xii) management of Colleges / Centers / Departments / Regional Stations/other institutions founded or maintained by the University;

(xiii) constitution of Selection Committee for appointment of teachers and other staff;

(xiv) institution of fellowships, scholarships, studentships, medals, prizes and other incentives;

(xv) all other matters for which Provision may be made by this Act or by the Statutes;

39.Statutes how made - (1) The first Statute shall be made by the Government on the recommendation of the Board.

(2) The Board may, from time to time, make new or additional Statutes or repeal the Statutes referred to in sub-section (1).

Provided that the Board shall not make, amend or repeal any Statute affecting the status, powers or constitution of any authority of the University until such authority has

been given an opportunity of expressing its opinion in writing on the proposed change, and any opinion so expressed shall be considered by the Board.

(3) Every new Statute or addition to the Statutes or any amendment or repeal thereof shall require the assent of the Chancellor.

(4) A new Statute or Statute amending and repealing an existing Statute shall have no validity unless it has been assented by the Chancellor:

Provided that if the Chancellor does not convey his decision/ assent within Ninety days of the reference received by him the Chancellor shall be deemed to have given his assent to the Statute, to an amendment proposal or proposal for repeal of a Statute.

(5) All Statutes made under this Act shall be published in the official gazette.

40. Powers to make Ordinances :-If the state government considers that an emergent situation has arisen which cannot be tackled under the Act or statutes or regulations, The state government may promulgate an ordinance with approval of the Governor.

41. Regulations

(1) The authorities of the University may make Regulations consistent with this Act and the Statutes in the manner prescribed by the Statutes for the conduct of their own business and that of the committees, if any, appointed by them for which provisions are made in this Act and the Statutes.

(2) All Regulations made by an authority shall come into force after approval of the Board.

Chapter-VIII

MISCELLANEOUS

42. Residence of students - The students shall reside in the accommodation maintained by the University or approved by the Vice-Chancellor subject to the conditions as may be prescribed. However, the Vice-Chancellor or an authorized officer of the University may permit the student(s) to reside with their parents or in private accommodations when no accommodation is available with the University. 43.Annual Report - The annual report of the University shall be prepared by the Registrar (or any other officer, if assigned) under the direction of the Vice-Chancellor normally within six months from the close of the Financial Year and intimated to the members of the Board one month before the meeting at which it is to be considered. The Board shall after consideration of the annual report forward a copy thereof to the Government.

44. Delegation of Powers - (1) The Board may, by statutes, delegate the powers to be exercised by it under this Act or the Statutes made there under, to any authority, Vice- Chancellor of the University subject to such conditions and restriction as the Board may deem proper.

(2) The Vice-Chancellor may, by Statutes, delegate the powers exercisable under this act or the statutes made thereunder to any officer, Heads of colleges, Departments / Centers/ Units subject to such conditions and restrictions as he may deem proper. 45.Constitution of ad hoc committees - Notwithstanding anything in this Act and until such times as the authorities are duly constituted, the Vice-Chancellor may subject to the prior approval of the Board, after the constitution of the Board, appoint committees temporarily to exercise, perform and discharge any of the powers, functions and duties of such authority under this Act.

46.Disputes as to constitution of Authorities or Bodies - If any question arises as to whether any person has been duly appointed or is entitled to be a member of any authority or other body of the University, the matter shall be referred to the Chancellor whose decision thereon shall be final :

Provided that before taking any such decision, the Chancellor shall give the person affected thereby reasonable opportunity of being heard

47.Legal Proceeding - All suits and other legal proceedings by or against the University shall be instituted, prosecuted or defended on behalf of the University by the Registrar or any other officer specifically nominated in this behalf by the Vice-Chancellor 48.Appointment to posts in connection with the affairs of the University -

(1) Subject to the provisions of this Act and the Statutes made thereunder appointment to duly created posts and service in connections with the affairs of the University may be made by the Vice-Chancellor with the approval of the Board:

Provided that such approval of Board shall not be necessary in respect of appointment of posts carrying scales of pay lower than the pay scale of an Assistant Professor.

(2) Notwithstanding anything contained in this Act and until such time as the Statutes are made or the authorities of the University are constituted appointments to posts and services in connection with the affairs of the University may be made by the Vice-Chancellor on such terms and conditions as may be approved by the Government. 49.Extraordinary Powers of the first Vice-Chancellor -The first Vice-Chancellor shall for a period of one year or until such time as the Board is constituted whichever is earlier, exercise all or any of the powers conferred on the Board by this Act or the Statutes.

50. Transitional Provisions - (1) Notwithstanding anything to the contrary contained in this Act, or in other University Act in the State (Bihar Agricultural University Act 2010 and Rajendra Agricultural University Act, 1971) or in the Statutes or regulations made under any of these enactments any student who immediately before the commencement of this Act was studying in a college which has been or may hereafter be admitted to the privileges of the University for degree, diploma or certificate of the Bihar Agricultural University/ Rajendra Agricultural University in accordance with the regulations of the University, be permitted :-

(i) to complete his course in accordance with the curriculum of studies of Bihar Agricultural University / Rajendra Agricultural University;

(ii) to be examined by the University and if on the results of such examination he qualifies, be entitled to be conferred a corresponding degree or diploma or certificate of the University; and

(iii) to appear at the examination within two years of the normal period required for completing the said course of studies.

(2) In the year of the establishment of the University, University examinations of all courses in different faculties and disciplines shall be conducted by Bihar Agricultural University / Rajendra Agricultural University and in subsequent years the examination shall be conducted by the University.

(3) Notwithstanding anything contained in Bihar Agricultural University Act / Rajendra Agricultural University , or in Statutes or Regulations made there under, Bihar Veterinary College, Patna, Sanjay Gandhi Institute of Dairy Technology, Patna and College of Fisheries will be located in the building of Dr. Kalam Krishi Mahavidyalay, Kishanganj shall after the commencement of this Act, be dis-affiliated from Bihar Agricultural

University, and Rajendra Agricultural University, in the state and shall be maintained by this University as constituent Colleges.

(4) Bihar Veterinary College, Patna and Sanjay Gandhi Institute of Dairy Technology, of Bihar Agricultural University, Sabour; College of Fisheries Kishanganj andInstitute of Animal Health & Production Panta play ground, hostels, residential quarters, farm land, farm buildings attached to these units shall be transferred and vested in the University after the publication of notification of the commencement of this Act, but the University can not sell or rent out /lease out any portion of this land . The ownership of the land will remain with the Government.

(5) Government Goat Breeding Farm, Purnea, Govt. Buffalo Farm, Sipaya (Gopalganj), with all movable assets shall be transferred to the University for education, training, research and extention training purposes but land ownership will remain with the Government.

(6) All employees of the Research Institutes and other offices and institutions of Government Departments whose services along with the unit have been transferred to the University shall be deemed to be employees of the university. Such transferred employees shall be governed in accordance with the terms and conditions as determined by the Board in consultation with the Government. Keeping in view that their regular service condition may not be adversely affected.

(7) The University shall begin its operations in a suitable building available in the campus of Bihar Veterinary College, Patna.

(8) The persons appointed in Bihar Veterinary College, Patna and Sanjay Gandhi Institute of Dairy Technology, Patna,under the Bihar Agricultural University shall be stand transferred along with the budget to the University.

51. Division of assets and liabilities - Liabilities of the existing Universities relating to Veterinary Science, Animal Husbandry, Livestock, Poultry, Dairy, Fisheries etc.- Any asset of existing Universities, immediately before the commencement of this Act, related to Veterinary Science, Animal Sciences, Dairy, Fisheries, including the agricultural land used for fodder production, feed production shall stand transferred to and vested in the University.

Explanation - For the purposes of this section, "asset" shall be deemed to include all property movable and immovable, rights, powers, authorities and privileges, and all other rights and interests arising out of such property, as were immediately before the commencement of this Act, namely ownership, possession, power or control of existing University / Govt. department and all books of accounts, registers, records.

52. Power to make Rules .-The state Governments may make Rules for giving effect to the provisions of this Act, which is consistent with the provisions of this Act.

(2) Every Rule made under this section shall after its publication in the Official Gazette, as soon as possible be laid before both Houses of the State Legislature.

53. Repeal and Saving - (1) The Bihar Agricultural University Act, 1987 {Bihar Act 8, 1988} and The Bihar Agricultural University Act, 2010 {Bihar Act 12, 2010} are deemed to be modified in terms of this Act for the subjects of Veterinary science, Animal Husbandry, Dairy technology, Fisheries as also in respect of institutions enumerated in Schedule-1.

(2) Notwithstanding such modification, anything done or any action taken in exercise of the powers conferred by or under the said Act and so far as it is not inconsistent with the provisions of this Act, shall be deemed to have been done or taken in

the exercise of powers conferred by or under this Act, as if this Act were in force on the day on which such thing was done or action taken.
