The Mizoram Salaries, Allowances and Pension of the Members of the Legislative As sembly (Amendment) Act, 1991.

AN
ACT
further to amend the salaries, allowances and pension of the Members of the Legisla- tive Assembly.
Be it enacted by the Legislative Assembly of the State of Mizoram in the Forty Second Year of the Republic of India, as follows:
1. (1) This Act may be called the Mizoram Salaries, Allowances and Pension of the Members of the Legislative Assembly (Amendment) Act, 1991.
(2) It shall be deemed to have come into force with effect from the First of April, 1991.
2. In the Mizoram Salaries, Allowances and Pension of the Members of the Legis- lative Assembly Act, 1987 as amended (hereinafter referred to as the principal Act), in section 3,
(a) for the words "a salary of one thousand rupees per mensem", the words "a salary of one thousand five hundred rupees per mensem shall be substituted. Vol XX Aizawl, Tuesday 14.5.1991 Vaisakha 24. S.E. 1913 Issue No. 97 Amendment of

(b) for the words and figures "daily allowance of Rs. 100/- each day", the words and figures "daily allownce of Rs. 150/- for each day (No separate sitting and daily allowances) shall be substituted.
3. In the principal Act, after section 3, the following new section shall be inserted, namely :-
3A A Member shall be entitled without any payment to the use and maintenance of a furnished residence throughout his term of office as a member for a period of fifteen days immediately thereafter, and so long as such residence for is not provided he shall be entiled to a residence which rental charges shall be not more than three thousand rupees per mensem.
For the purpose of this section -
(a) "residence" includes the staff quarters and other building appurtenant thereto and the garden thereof;
(b) "maintenance" in relation to a residence includes, -
(i) provision of electricity upto 600 units per mensem and free supply of water;
(ii) installation of telephone with provision of telephone call upto 8,000 calls per quarter; and
(iii) payment of local rates and taxes;
(c) "Occupation of Members' Hostel" -A Member, occupying the Mem- bers' Hostel, not just staying a few days as a visitor shall be treated as accupying a residence and shall not be entitled the rental charges in lieu of furnished residence."
4. In the princinal Act, after section 3A so inserted the following new Section shall be inserted, namely : -
3B. There shall be made available a sum of Rs. 20,000 in the first year for furnishing residence and Rs. 5,000 annually furnishing residence for the subsequent years.
5. In the principal Act, for section 4, the following section shall be substituted, namely :-
4A. A Member shall be paid constituency allowances of Rs. 2,500 per mensem and he shall also be entitled contingency allowance of Rs. 1,000 per mensem. Residence, etc.

6. In the principal Act, after scotion 4, the following new section shall be inserted, namely:-
4A. A Member shall be entitled postal and other charges of Rs. 500/- per mensem.
7. In the principal Act, after section 4A so inserted, the following new section shall be inserted, namely:
4B. Notwithstanding anything contained in this Act and subject to the provisions of the Schedule, a Member shall be entitled to:-
(a) free travelling by First Class train upto 20,000 kilometres two times in five years term within India, with family upto 5 members; and
(b) free travelling by air from Aizawl to Calcutta or Calcutta to Aizawl, with family upto 5 members.
8. In the principal Act, in section 5, in sub-section (1), for the words at the maxi- mum rate applicable as would be admissible in respect of journey. on tour to a First Grade Officer of the Government of Mizoram, the words at the rate of Rs. 150/- per day (No separate sitting and daily allowance) shall be substituted.
9. In the principal Act, section 11 shall be deleted.
10. In the principal Act, in section 12,-
(a) in clause (i), for the words one lakh rupees for a building. the words five lakhs rupees, for a building shall be substituted;
(b) in clause (ii), for the words "one lakh rupees", the words "one lakh fifty thousand rupees" shall be substituted.
11. In the principal Act, for section 13, the following Section shall be substituted, namely :-
13. A member shall be entitled to the service of two Muster Roll Grade IV Staff of semi-skill in the residence of his/her choice throughout his/her term of office.
12. In the principal Act. in section 14,-
(a) in sub-section (1), for the words pension of rupees eight hundred per mensem, the words pension of rupees one thousand per mensem shall be substituted;
(b) in sub-section (2) Postal and other charges

(i) for the words additional pension of fifty rupees per mensem the words additional pension of one hundred rupees per mensem (No arrears shall be paid) shall be substituted.
