(ASSAM AMENDMENT) ACT, 1978.

further to amend the Bengal, Agra and Assam Civil Courts Act, 1887, in its application to the State of Assam. Preamble. W hereas it is expedient to amend I m the Bengal, Agra and Assam Civil Courts

Act, 1887, hereinafter called the princi- pal Act, in its application to the State

of Assam, in the m anner here inafter

It is hereby enacted in the T w enty-

1. (1) This Act m ay Bengal, Agra and Assam be called the

Civil Courts

(Assam Am endment) Act, 1978.

(2) It shall extend to the whole State of Assam.

(3) It shall come into force at once. Amendment 2. In Section 19 of the principal T9 of Act, in sub-section (2), for the words

d rupees" the words "ten thousand rupees" shall be substituted. Amendment

3. In Section 21 of the principal Act, in sub-section (1), in clause (a), for the words "fifteen thousand rupees" the words "tw enty thousand rupees" shall be substituted.

provision of clause (a) of tion. sub-section (1) of Section 21 of the 1887. principal Act as amended by Section 3 of this Act shall apply irrespective of the fact th a t suits, proceedings, decrees or orders out of which the appeals re - ferred to therein arise were institu ted or m ade prior to the commencement of this Act.

(2) N otw ithstanding anything to CentrH the contrary contained in the L im itationAci%f. Act, 1963, an appeal from a decree or order m ade before the commencement of this Act, which but for the provisions of th is Act, would have been p referred before the High Court w ithin n inety days from the date of such decree or order, shall be preferred to the District Judge, w ithin the said period.
