1. Short title and Commencement.- (1) This Act may be called the Uttaranchal Panchayat Laws (Amendment) Act, 2006.

(2) It shall come into force atonce.

Section 2. Amendment of section 11-C of the United Panchayat Raj Act no. 26 of 1947

2. Amendment of section 11-C of the United Panchayat Raj Act no. 26 of 1947.- In section 11-C of the United Provinces Panchayat Raj Act, 1947, hereinafter in this chapter referred to as the principal Act, sub-section (3) shall be omitted.

Section 3. Substitution of section 12-B

3. Substitution of section 12-B.- For section, 12-B of the principal Act, the following section shall be substituted, namely:-

"12-B(1) A Gram Sabha shall ordinarly meet for the meetings of Gram Sabha transaction of business at least once every month but two months shall not intervene between two consecutive meetings:

Provided that the date to be appointed for the first meeting of Gram Sabha, shall be within thirty days from the date of its constitution.

(2) The meetings of the Gram Sabha shall be held at such place and in such manner as may be prescribed."

Section 4. Amendment of section 14

4. Amendment of section 14.- In section 14 of the principal Act-

(a) In the heading the words "and Up-Pradhan" shall be omitted.

(b) For sub-section (1) the following sub-section shall be substituted; namely-

"(1) The Gram Sabha may at a meeting specially convened for the purpose and of which at least 15 days previous notice shall be given, remove the Pradhan by a majority of two-thirds of the members of the Gram Sabha present and voting.

(1-A) Notwithstanding anything contained in section 11 one-third of the members of the Gram Sabha shall form the corum for a meeting under sub-section (1)."

(c) In sub-section (3) for the words "two years" the words "one year" shall be substituted.

Section 5. Insertion of new section 14-B

5. Insertion of new section 14-B.- After section 14-A of the principal Act, the following section shall be inserted, namely:-

"14-B(1) Removal of Up-Pradhan-The Gram Sabha may, at a meeting specially convened for the purpose and of which at least fifteen days previous notice shall be given, remove the Up-Pradhan by a majority of two-thirds of the members of the Gram Panchayat.

(2) A meeting for the removal of a Up-Pradhan shall not be convened within two years of his election.

(3) If the motion is not taken up for lack of requisite majority at the meeting, no subsequent meeting for the removal of the same Up-Pradhari shall be convened within two years of the date of the previous meeting.

(4) Subject to the provisions of the section, the procedure for the removal of a Up-Pradhan, including that to be followed at such meeting, shall be such as may be prescribed."

6. Amendment of section 61 of U.P. Act no. 33 of 1961.- In section 61 of the Uttar Pradesh Kshetra Panchayats and Zila Panchayats Adhiniyam, 1961 hereinafter in this chapter referred to as the principal Act, for sub-section (1) the following sub-section shall be substituted, namely:-

"(1) A Zila Panchayat shall meet for the transaction of business at least once in every two months:

Provided that the date to be appointed for the first meeting of a Zila Panchayat, shall be within thirty days from the date of its constitution."

Section 7. Amendment of section 84

7. Amendment of section 84.- In section 84 of the principal Act, for sub-section (1), the following sub-section shall be substituted, namely:-

"(1) A Kshetra Panchayat shall meet for the transaction of business at least once in every two months:

Provided that the date to be appointed for the first meeting or a Kshetra Panchayat, shall be within thirty days from the date of its constitution."

Section 8. Amendment of section 239

8. Amendment of section 239.- In section 239 of the principal Act in sub-section (2), in the list in item 1 relating to public safety and convenience, clause (a) shall be omitted.
