Preamble

Tamil Nadu Municipal Laws (Seventh Amendment) Act, 2008*

[Tamil Nadu Act No. 57 of 2008][29th November, 2008]

An Act further to amend the laws relating to the Municipal Corporations and the Municipalities in the State of Tamil Nadu.

Be it enacted by the Legislative Assembly of the State of Tamil Nadu the Fifty-ninth Year of the Republic of India as follows:-

* Received the assent of the Governor on the 29th November, 2008 and published in the Tamil Nadu Government Gazette, Extraordinary.

Section 1. Short title and commencement

PART-I

PRELIMINARY

1. Short title and commencement.- (1) This Act may be called the Tamil Nadu Municipal Laws (Seventh Amendment) Act, 2008.

(2) It shall come into force on such date as the State Government may, by notification, appoint.

Section 2. Amendment of section 52

PART-II

AMENDMENTS TO THE CHENNAI CITY MUNICIPAL CORPORATION ACT, 1919

2. Amendment of section 52.- In section 52 of the Chennai City Municipal Corporation Act, 1919 (Tamil Nadu Act ??? of 1919) (hereafter in this Part referred to as the 1919 Act), after sub-section (1-A), the following sub-section shall be inserted, namely:-

"(1-B) A person disqualified for being a councilor under clause (see) of sub-section (1) of section 53 shall be disqualified for election as a councilor for a period of six years from the date of such disqualification.".

Section 3. Amendment of section 53

3. Amendment of section 53.- In section 53 of the 1919 Act, in sub-section (1), after clause (ee), the following clause shall be inserted, namely

"(eee) does not belong to Scheduled Caste or Scheduled Tribe, but has been elected from the seat reserved for Scheduled Caste or Scheduled Tribe, as the case may be;".

Section 4. Amendment of section 56

AMENDMENTS TO THE MADURAI CITY MUNICIPAL CORPORATION ACT, 1971

4. Amendment of section 56.- In section 56 of the Madurai City Municipal Corporation Act, 1971 (Tamil Nadu Act 4 of 1971) (hereafter in this Part referred to as the 1971 Act), after sub-section (1-A), the following sub-section shall be inserted, namely:-

"(1-B) A person disqualified for being a councilor under clause (ee) of sub-section (1) of section 57 shall be disqualified for election as a councilor for a period of six years from the date of such disqualification".

Section 5. Amendment of section 57

5. Amendment of section 57.- In section 57 of the 1971 Act, in sub-section (1), after clause (e), the following clause shall be inserted, namely:-

"(ee) does not belong to Scheduled Caste or Scheduled Tribe, but has been elected from the seat reserved for Scheduled Caste or Scheduled Tribe, as the case may be;".

Section 6. Amendment of section 58

AMENDMENTS TO THE COIMBATORE CITY MUNICIPAL CORPORATION ACT, 1981

6. Amendment of section 58.- In section 58 of the Coimbatore City Municipal Corporation Act, 1981 (Tamil Nadu Act ??? of 1981) (hereafter in this Part referred to as the 1981 Act), after sub-section (2), the fallowing sub-section shall be inserted, namely:-

"(2-A) A person disqualified for being a councilor under clause (ff) of sub-section (1) of section 59 shall be disqualified for election as a councilor for a period of six years from the date of such disqualification".

Section 7. Amendment of section 59

7. Amendment of section 59.- In section 59 of the 1981 Act, in sub-section (1), after clause (f), the following clause shall be inserted, namely.-

"(ff) does not belong to Scheduled Caste or Scheduled Tribe, but has been elected from the seat reserved for Scheduled Caste or Scheduled Tribe, as the case may be;".

Section 8. Amendment of section 49

AMENDMENTS TO THE TAMIL NADU DISTRICT MUNICIPALITIES ACT, 1920

8. Amendment of section 49.- In section 49 of the Tamil Nadu District Municipalities Act, 1920 (Tamil Nadu Act V of 1920) (hereafter in this Part referred to as the 1920 Act), after sub-section (1-A), the following sub-section shall be inserted, namely:-

"(1-B) A person disqualified for being a councilor under clause (ddd) of sub-section (1) of section 50 shall be disqualified for election as a councilor for a period of six years from the date of such disqualification".

Section 9. Amendment of section 50

9. Amendment of section 50.- In section 50 of the 1920 Act, in sub-section (1), after clause (dd), the following clause shall be inserted, namely:-

"(ddd) does not belong to Scheduled Caste or Scheduled Tribe, but has been elected from the seat reserved for Scheduled Caste or Scheduled Tribe, as the case may be;".
