An Act to amend the Tamil Nadu Educational Institutions (Prohibition of Collection of Capitation Fee) Act, 1992
Be it enacted by the Legislative Assembly of the State of Tamil Nadu in the Fifty-eighth Year of the Republic of India as follows:-
Section 1. Short title and commencement
1. Short title and commencement.- (1) This Act may be called the Tamil Nadu Educational Institutions (Prohibition of Collection of Capitation Fee) Amendment Act, 2007.
(2) It shall come into force at once.
Section 2. Amendment section 4
2. Amendment section 4.- In section 4 of the Tamil Nadu Educational Institutions (Prohibition of Collection of Capitation Fee) Act, 1992 (Tamil Nadu Act 57 of 1992), after sub-section (2), the following sub-section shall be inserted, namely:-
"(2-A) Notwithstanding anything contained in sub-section (1) or sub-section (2), no educational institution imparting education leading to a degree in medicine or engineering shall receive or collect any fee any ??? of the amount fixed by the ‘Committee on fixation of fee’ constituted by the Government.
Explanation.- For the purpose of this sub-section, Committee on fixation of fee means the Committee constituted in pursuance of the direction of the Supreme Court in Islamic Academy of Education v. State of Karnataka, (2003) 6 SCC 697
."
