An Act to Provide for the Cessation of Office of the Chairman of Saharapada Panchayat Samiti and for Matters Incidental thereto
Be it enacted by the Legislature of the State of Orissa in the Thirty-third year of the Republic of India, as follows:
Section 1. Short title and commencement
(1) This Act may be called the Orissa Panchayat Samiti (Cessation of Office of the Chairman of Saharapada Panchayat Samiti) Act, 1982.
(2) It shall be deemed to have come into force with effect from the 13th day of August, 1982.
Section 2. Definitions
In this Act, unless the context otherwise requires,
(a) appointed date means the date appointed by the Government by notification, for the purposes of this Act;
(b) Panchayat Samiti Act means the Orissa Panchayat Samiti Act, 1959 (Orissa Act 7 of 1960)
(c) words and expressions used in this Act, but not defined herein, shall have the same meaning as assigned to them respectively under the Panchayat Samiti Act.
Section 3. Cessation of office of Chairman
(1) Notwithstanding anything contained in the Panchayat Samiti Act, the Chairman of Saharapada Panchayat Samiti holding office as such with effect from the 20th day of May, 1977, shall cease to hold office with effect from the appointed date.
(2) The powers and functions of the Chairman who ceases to hold office under sub-section (1) shall be exercised by the Sub-divisional Officer having jurisdiction over the concerned block until the newly elected Chairman assumes office.
Section 4. Repeal and savings
(1) The Orissa Panchayat Samiti (Cessation of office of the Chairman of Saharapada Panchayat Samiti) Ordinance, 1982 (Orissa Ordinance No. 5 of 1982), is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken (including any notification issued) under the said Ordinance shall be deemed to have been done, taken or issued under this Act.
