Gujarat act 022 of 1977 : Gujarat Legislative Assembly Members' Salaries and Allowances (Amendment) Act, 1977

Section 1. Short title and commencement

1. Short title and commencement.- (1) This Act may be called the Gujarat Legislative Assembly Members' Salaries and Allowances (Amendment) Act, 1977.

(2) It shall be deemed on have come into force on the 1st June, 1977.

Section 2. Amendment of section 2 of Guj. II of 1960

2. Amendment of section 2 of Guj. II of 1960.- In the Gujarat Legislative Assembly Members' Salaries and Allowances Act, 1960 (Guj. II of 1960) (hereinafter referred to as "the principal Act"), in section 2, in sub-section (1), in clause (d), for the words "and "Minister" includes Chief Minister", the following shall be substituted, namely:-

"and "Minister" includes-

(i) the Chief Minister,

(ii) the Deputy Chief Minister, and

(iii) a Minister of State;".

Section 3. Amendment of section 3 of Guj. II of 1960

3. Amendment of section 3 of Guj. II of 1960.- In the principal Act, in section 3, in sub-section (2), for the letters and figures "Rs. 150", the letters and figures "Rs. 250" shall be substituted.

Section 4. Amendment of section 4 of Guj. II of 1960

4. Amendment of section 4 of Guj. II of 1960.- In the principal Act, in section 4, in clauses (a) and (b), for the letters and figures "Rs. 21" the letters and figures "Rs. 30" shall be substituted.

Section 5. Insertion of new section 6A in Guj. II of 1960

5. Insertion of new section 6A in Guj. II of 1960.- In the principal Act, after section 6, the following new section shall be inserted, namely:-

"6A. (1) Where a member has a telephone installed at the place where he ordinarily resides or at any other place in the State of Gujarat which is also used by him for residence, the rental charges in respect of such telephone shall be borne by the State Government.

(2) There shall be paid to every Member a sum of Rs. 100 per month to meet with the cost of telephone charges that may be incurred by him as such member, whether or not he has a telephone installed at the place referred to in "sub-section (1).".

Section 6. Amendment of section 8 of Guj. II of 1960

6. Amendment of section 8 of Guj. II of 1960.- (1) In section 8 of the principal Act,-

(1) in sub-section (5),

(a) before the existing proviso, the following proviso shall be inserted, namely:-

"Provided that a member shall be entitled-

(i) in a place where there is no hospital maintained by the State Government, to such accommodation, medical attendance or treat merit in a hospital maintained by a municipality or a panchayat; and

(ii) in a place where there is no hospital maintained by the State Government, a municipality or a panchayat, to be reimbursed by the State Government, subject to such rules as may be made under section 10 in this behalf, with any amount paid by him on account of the attendance and treatment taken by him or a member of his family residing with and dependent upon him from any registered medical practitioner, on production by him of a certificate and bills regarding the charges paid by him to such medical practitioner:";

(b) in the existing proviso, for the words "Provided that", the words "Provided further that" shall be substituted;

(2) after sub-section (5), the following new sub-section shall be inserted, namely:-

"(5A) There shall be paid to every Member a sum of Rs. 50 per month to meet with the cost of postal charges that may be incurred by him as such member."
