Preamble

[Cotton Ginning and Pressing Factories 1[(Tamil Nadu) Amendment] Act, 1965]*

An Act further to amend the Cotton Ginning and Pressing Factories Act, 1925, in its application to the 3[State of Tamil Nadu].

Be it enacted by the Legislature of the 3[State of Tamil Nadu] in the Sixteenth Year of the Republic of India, as follows:-

Section 1. Short title, extent and commencement

1. Short title, extent and commencement.- (1) This Act may be called the Cotton Ginning and Prying Factories 1[(Tamil Nadu) Amendment) Act, 1965.

(2) It extends to the whole of the 3[State of Tamil Nadu].

(3) It shall come into force on such date as the State Government may, by notification, appoint.

Section 2. Amendment of section 3-C, Central Act XII of 1925

2. Amendment of section 3-C, Central Act XII of 1925.- In sub-section (1) of section 3-C of the Cotton Ginning and Pressing Factories Act, 1925 (Central Act XII of 1925)-

(1) for clause (a), the following clause shall be substituted, namely:-

"(a) For the purposes of section 3-B, cotton shall be deemed to be watered, if it contains-

(i) moisture in excess of the normal quantity; or

(ii) cakes or patches.";

(2) for clause (c), the following clause shall be substituted, namely:-

"(c) A certificate given by the prescribed authority as to the presence of moisture in excess of the normal quantity in a given quantity of cotton or as to the presence of cakes or patches shall, until the contrary is proved, be presumed to be correct."
