Section 1. Short title and commencement

1. Short title and commencement.- (1) This Act may be ??? the Andhra Pradesh University Acts (Amendment) Act, 1937.

(2) It shall Toms into force on such date as the State Government may, by notification in the Andhra Pradesh Gazette, appoint.

Section 2. Amendment of Act 2 of 1926

2. Amendment of Act 2 of 1926.- In the Andhra University Act, 1925.-

(1) in section 2, in clause, (b-2), for the word "Syndicate" the words "Executive Council" shall be substituted;

(1-a) in section 3, in sub-section (1), in clause (a), for the words Senate, a Syndicate and an Academic Council", the words "an Executive Council and an Academic ???" shall be substituted;

(2) in section 4, in sub-section (1), in clause (1) after the word ??? the words "extension programmes" shall be added;

(3) clause (2) shall be omitted;

(4) in clause (12), after item (d), the following item shall be added, namely:-

"(e) University press, University sports and ??? clubs and other similar associations";

(5) for sub-section (ii) the following sub-section shall be substituted, namely:-

"(ii) Nothing contained: in sub-section (i) shall deemed to prevent the Andhra Pradesh Commissionerate of Higher Education from issuing such orders as it may deem fit in regard to the levy of fees and other charges for admission of students to co-Sages";

(6) section 7 shall be omitted;

(7) in section 8, for sub-section (i), the following sub-section shall be substituted, namely:-

"(1) The State Government shall have the right to cause an inspection to be made by the Andhra Pradesh Commissionerate of Higher Education, of the University, its buildings, laboratories, libraries, museums, workshops and equipment and of any institutions maintained by or affiliated to the University and also to cause an inquiry to be made, into the teaching and other work conducted or done by the University in respect of any matter connected with the University. The State Government shall in every case give notice to the University of its intention to cause such inspection or inquiry to be made and the University shall be entitled to be represented thereat. The Commissionerate shall inform the State Government of the results of the inspection and inquiry";

(8) in sub-section (2), for the words "Senate and to the Syndicate" the words "Executive Council" shall be substituted; and for the words "Senate and the Syndicate" the words "Executive Council" shall be substituted;

(9) in sub-section (3), for the word "Syndicate" the words "Executive Council" shall be substituted; and the words "The report shall be accompanied by the opinion of the Senate thereon" shall be omitted;

(10) in sub-section (4), for the words "The Senate or the Syndicate", the words "The Executive Council" shall be substituted;

(11) in the marginal heading, for the word "Visitation" the words "Inspection and inquiry" shall be substituted;

(12) in section 9, after item (iii)(b), ??? following items shall be inserted, namely:-

"(iii)(c) The ???;

(iii)(d) The Directors;"

(13) in section 10, in sub-section (1), the words "and the ??? of the Senate" and "at meetings of the Senate and" shall be omitted;

(14) in section 12,-

(a) in sub-section (1), for clause (a), the following clause shall be substituted, namely:-

"(a) The Andhra Pradesh Commissionerate of Higher Education shall constitute a Search Committee consisting of:-

(i) a nominee of the Executive Council,

(ii) a nominee of Die Andhra Pradesh Commissionerate of Higher Education, and

(iii) a nominee of the State Government.

The Search Committee shall submit a panel of three persons to the State Government from among whom the State Government shall recommend one person to the Chancellor for appointment as Vice.-Chancellor and the Chancellor shall appoint such person as Vive-Chancellor:

Provided that no person shall hold the "Office of Vice-Chancellor beyond the age of Sixty five years".;

(b) in clause (b), the proviso shall be omitted; (c) for clauses (d) and (c), the following clauses shall be substituted, namely:-

"(d) The Vice-Chancellor shall be the academic head and the principal executive officer of the University and shall exercise general control over its ???. He shall be a whole-ume officer of the University and shall be paid the pay and allowances admissible from time to time to a Principal Secretary in the State Government. He shall be provided with a furnished. Official accommodation for which he shall pay ten per cent of his salary towards rent.

(e) He shall, by virtue of his office be a member and Chairman of the Executive Council and of the Academic Senate and shall preside at the Convocations of the University in the absence of the Chancellor.";

(d) for clause (g), the following clause shall be substituted; namely:-

"(g) He shall have power, to convene meetings of the Executive Council and the Academic Senate";

(e) to clause (i), the following proviso shall be added, namely:-

"Provided that he shall not give effect to any decision of any authority of the University if he is of the opinion that such decision is not in the interests of the University.";

(f) in sub-section (2), in clause (b), for the word "Syndicate" the words "Executive Council" shall be substituted;

(g) for sub-section (3), the following sub-section shall be substituted, namely:-

"(3) When the Vice-Chancellor is unable to exercise his powers, perform his functions and discharge his duties owing to absence, illness of any other cause, the Chancellor may, on the recommendation of the State Government make necessary arrangements to perform the duties of the Vice-Chancellor by appointing a Vice-Chancellor in-charge or otherwise.’";

(15) in action 12-A, for the words "appointed by the Vice-Chancellor" the words "appointed by the Executive Council on the recommendation of the Vice-Chancellor" shall be substituted:

(16) for section 13, the following section shall be ???, namely:-

13. The Registrar.- (1) The Registrar shall be a whole-time paid officer, of the University appointed by the Executive Council for a term of three or less and on such other terms as may be prescribed by the statutes; provided that he shall not continue in that office for more than six years.

(2) The Registrar shall exercise such powers and ??? form such duties as may be prescribed.

(3) The Executive Council may transfer the Registrar to a suitable position even before the completion of the term provided he is shown a position in the University with the same emoluments.";

(17) in section 13-A for sub-section (1) the following sub-section shall be substituted, namely:-

"(1) The Finance Officer shall be a whole-time paid officer of the University appointed by the Executive Council for a period of three years or less and on such terms and conditions as may be prescribed; provided that the shall not continue in that office for more than six years. The Executive Council may transfer the Finance Officer to a suitable position even before the completion of the term provided to is shown a position in the University with the same emoluments."

(18) in section 14, for items (i), (ii) and (iii) the following items shall be substituted, namely:-

"(i) The Executive Council,

(ii) The Academic Senate";

(19) Sections 15, 16 and 17 shall be omitted;

(20) in section 13,-

(a) for sub-section (1) including the marginal heading the following shall be substituted, namely:-

18. Executive Council.- (1) The Executive Council shall consist of the following persons, namely;-

Class-I-Ex-Officio Members;

(1) The Vice-Chancellor

(2) The Secretary to Government, Education Department or a nominee of the State Government;

Class-II-Other Members:

1. Two persons nominated by the Andhra Pradesh Commnissionerate of Higher Education.

2. One Professor and one Principal Dean of the University Colleges Professional Colleges, one Principal of the affiliated colleges nominated by the Chancellor be rotation in order of seniority for a period of one year on the recommendation of the State Government.

3. Three eminent person representing the ??? interests, of the University area nominated by the State Government.

(b) in sub-sections (2), (3), (4) and (5), for the word "Syndicate" the words "Executive Council" shall be substituted";

(21) in section 19,-

(a) in the opening portion and in the marginal heading for the word "Syndicate" the words "Executive Council" shall be substituted;’

(b) in clause (c),-

(A) in item (ii), in the proviso, for the word "Syndicate" the words "Executive Council" shall be substituted;

(B) after the proviso, the following further proviso shall be added, namely:-

"Provided further that if the Executive Council rejects the selections, made by the Selection Committee, the matter shall be referred by the University to the State Government whose decision thereon shall be final";

(c) in clause (g) for the words "in accordance with the rules laid down by the Senate"; the words "in accordance with such rules as may be made in this behalf" shall be substituted;

(d) in clause (jj), the words "subject to the approval of the Senate" shall be omitted;…

(e) in clause (1), the words "all such endowments, bequests, donations and transfers shall be reported to the Senate at its next meeting" shall be omitted;

(f) in clause (t), for the words "after consultation with the Academic Council and to recommend to the Senate, after consultation with the Academic Council" the words "after consultation with the Academic Senate and to recommend to the Executive Council after consultation with the Academic Senate" shall be substituted;

(g) in clause (t-1), for the words "Academic Council" the words "Academic Senate" shall be substituted;

(h) in clause (u), for the words "after consultation with the Academic Council and to recommend to the Senate after consultation with the Academic Council the suspension or withdrawal of such recognition", the words "after consultation with the Academic Senate and to suspend or withdraw such recognition after consultation with the Academic Senate" shall be substituted;

(i) after clause (u), the following clauses shall be inserted, namely:-

"(v) to make statutes and to amend or repeal the same;

(w) to institute and maintain University Colleges;

(X) to provide for research and advance-merit and dissemination of knowledge;

(y) to institute professorships; readerships, lecturerships and other teaching posts required by the University;

(z) to establish and equip and maintain the University laboratories and Libraries;

(z-1) to control, in general, all colleges in the University area in the manner prescribed by Statutes;

(z-2) to confer degrees and other academic distinctions on persons who have pursued approved courses of study in a university college or an affiliated college or oriental college, unless exempted therefrom, in the manner prescribed by the regulations and shall have passed the prescribed examination of the University or shall have carried on research under conditions prescribed;

(z-3) to confer honorary degrees or distinctions on approved persons in the manner prescribed;

(z-4) to institute allowances, travelling allowances, scholarships, exhibitions (bursaries, studentships, medals and prizes);

(z-5) to provide for lectures and instruction to persons not being students of the university and to grant diploma to them;

(z-6) to establish and ??? hostels;

(z-7) to prescribe the fees to be charged for no affiliation and recognition of colieges;

(z-8) to prepare the annual reports and ??? accounts and, the financial intimates, of the University for submission to the Academic Senate;

(z-9) to enter into any agreement with the Government or with the private ??? for ??? the management of any institution sad taking or for properties and liabilities or for any other purpose ??? to the ??? of the Act;

(z-10) the Executive Council shall exercise all the powers of the University not otherwise provided for and all powers requisite to give effect to the provisions of the Act,";

(22) in section 19-A,-

(a) for sub-section (1), the following, sub-section shall be substituted, namely:-

"(1) There shall be constituted a Finance Committee which shall be a Sub-Committee of the Executive Council with the following as members, namely:-

(a) Vice-Chancellor (Chairman),

(b) one member of the, Executive Council from among the nominees of the Andhra Pradesh Commissionerate of Higher Education nominated by the Executive Council;-

(c) one member of the Executive Council from among its other Members nominated by the Executive Council.

The Finance Officer shall be the Secretary of the Finance Committee."

(b) in sub-section (2), for the word "Syndicate" wherever it occurs, the words "Executive Council" shall be substituted:

(23) in section 19-B for the word "Syndicate" the words. "Executive Council" shall be substituted;

(24) in section 20, for the words "Syndicate" and "Senate" wherever they occur the words "Executive Council" Aud "Academic Senate" shall respectively be ???.

(25) in section 21, for the words "Syndicate" and "Senate", the words "Executive Council" and "Academic Senate" shall respectively be substituted and for the words "the accounts when audited" the words "the accounts so audited" shall be substituted;

(26) in section 21-A,-

(a) for the word "Syndicate" the words "Executive Council" and for the word "Senate" wherever it occurs, the words "Academic Senate" shall be substituted;

(b) the proviso thereunder shall be omitted;

(27) for sections 22 and 23, the following sections shall be substituted, namely:-

22. Academic Senate.- The Academic Senate shall consist of the following persons, namely:-

(1) The Vice-Chancellor;

(2) The Rector;

(3) The Secretary, Andhra Pradesh Commissionerate of Higher Education;

(4) The Secretary to Government Education;

(5) The Director, N.C.C.;

(6) All Deans/Chairman of Faculties/Directors of Schools and Administrative Deans;

(7) Fifteen or 1/3 of the Heads of the Departments of the University whichever is less nominated by the Chancellor on the recommendation of the Andhra Pradesh Commissionerate of Higher Education;

(8) Fifteen or 1/3 of the Professors of the University whichever is less nominated by the Chancellor on the recommendation of the Andhra Pradesh Commissionerate of Higher Education;

(9) fifteen or 1/3 of the Chairman, Boards of studies whichever is less nominated by the Chancellor on the recommendation of the Andhra Pradesh Commissionerate of Higher Education;

(10) ten teachers of the University, constituent and affiliated colleges nominated by rotation by the Chancellor on the recommendation of the State Government;

(11) fifteen Principals of the affiliated colleges nominated by the Chancellor on the recommendation of the State Government;

(12) two Heads of Research Laboratories and Institutions in the University area recognised by the University, nominated by the Chancellor on the recommendation of the State Government;

(13) six students for a term of one year two each from (a) under graduate (Professional and Non-Professional) (b) Post-Graduate and (c) Research Scholars nominated by the Chancellor from among the names recommended by the State Government on the basis of merit as prescribed;

(14) seven from the alumni of the University representing one Scheduled Castes, one Scheduled Tribes, one Backward Classes, one Woman, one Professor from such areas as engineering, medicine and law one Management of the college, one representing commerce and industry nominated by the Chancellor on the recommendation of the State Government;

(15) five Members of the Legislative Assembly nominated by the State Government; and

(16) Such members of the Executive Council who are not otherwise Members of the Academic Senate,

23. Powers of the Academic Senate.- (1) The Academic Senate shall have the authority to provide instruction and training in such branches of learning as it thinks fit. It shall exercise general supervision over the Academic policies of the University and provide leadership for raising the standard and quality of education and research.

(2) In particular the Academic Senate shall have powers:

(a) to consider the Annual Report and Budget Estimates prepared by the Executive Council;

(b) to advise the Executive Council on all academic matters, including the control and management of the Libraries;

(c) to constitute the several Faculties as may be prescribed;

(d) to formulate, modify or revise schemes for the constitution or reconstitution of departments of teaching;

(e) to make recommendations to the Executive Council for the institution of Professorships; Readerships, Lecturerships and other teaching posts and in regard to the duties and emoluments thereof;

(f) to make recommendations to the Executive Council for the recognition of teachers qualified to give instruction in Affiliated and Oriental colleges;

(g) to make recommendation to the Executive Council for the selection of a college in the University area on a reference made thereof by the Executive Council for the conferment of autonomy on such college or for withdrawal of autonomy already conferred;

(h) to make regulations for the encouragement of co-operation and reciprocity among colleges with a view to promoting academic life;

(i) to make regulations regarding the admission of students to the University;

(j) to make regulations relating to courses, examinations and the conditions on which students shall be admitted to examinations for the degrees of the University;

(k) to decide the conditions under which exemptions relating to the admission of students to examinations may be given;

(l) to appoint standing committees and to delegate to them, or the Vice-Chancellor, powers to execute any of the functions assigned by this Act;

(m) to make regulations for the use of Telugu as medium of instruction and examination.";

(28) in section 24,-

(a) for sub-section (1) the following sub-section shall be substituted, namely:-

"(1) The University shall have such faculties comprising of such departments of teaching as may be prescribed by the Statutes.";

(b) in sub-section (2),-

(i) in clauses (a) and (b) for the words "Academic Council" the words "Academic Senate" shall be substituted;

(ii) for the words "The functions of the Faculties shall be prescribed by the statutes", the following shall be substituted, namely:-

"(3) There shall be Dean/Chairman for each faculty who shall be appointed by the Executive Council from among the members of the faculty on the recommendation of the Vice-Chancellor. The functions of the Faculties shall be such as may be prescribed by the Statutes.";

(29) in section 25, for the word "Statutes" the word "Ordinances" shall be substituted; and the following, words shall be added at the end, namely:-

"There shall be representation for students on the Boards of Studies";

(30) after section 25, the following section shall be inserted, namely:-

25-A. Planning and Monitoring Bord.- There shall be a Planning and Board.

The Vice-Chancellor (Chairman); Four Principals of University and Professional colleges, Deans/Chairmen of ??? nominated by the Vice-Chancellor.

Two outside educationists nominated by the Vice-Chancellor.

Two nominees of the Andhra Pradesh Commissionerate of Higher Education.

The Board shall be the principal Planning and reviewing body and it should also arrange for periodical monitoring of the developmental programmes and of teaching and research in the University.";

(31) in section 26, the words "election or" in the two places where they occur shall be omitted;

(32) in section 27, the words "elected or" shall be omitted;

(33) in section 29, the words "or the invalidity of the election of any of its members" shall be omitted;

(34) in section 30, for sub-section (1), including the marginal heading, the following sub-section shall be substituted namely.

(1) Term of Office of members of Executive Council and the ??? Senate etc.- Save as otherwise pro video, the Executive Council, the Finance Committee and the Academic Senate shall be reconstituted at or about the same time every three years and the members of these authorities shall except in the case of ex-officio members hold office as members thereof upto the date of next reconstitution:

Provided that no person other than ex-officio member, professor, Heads of Departments other than professors, Dean Chairman of Faculties and principals shall be a member of the Executive Council or Academic Senate for more than two terms consecutively.-

(35) after section 30-B, the following section shall be ??? namely:-

30-C ??? Provisional to the ??? of the Executive Senate and the Finance Committee.- Notwithstanding anything in is Act,-

(a) the members of the Senate, the Syndicate, Academic Council and the Finance Committee constituted and ??? before the commencement of section 1 of the Andhra Pradesh University Acts (Amendment) Act, 1987 (hereinafter referred to as the said Act) shall continue to be such members and function only until a new Executive Council, Academic Senate and the Finance Committee is reconstituted in accordance with the provisions of this Act as amended by the said Act; and

(b) on the reconstitution of such new Executive Council. Academic Senate and the Finance Committee in accordance with the provisions of this Act as amended by the said Act, the members of the Senate, the Syndicate, the Academic Council and the Finance Committee holding office immediately before such reconstitution shall cease to be such members.";

(36) in section 31, for the words "Senate" and "Syndicate" the words, "Academic Senate" and "Executive Council" shall respectively be substituted;

(37) in section 33, for the words "Academic Council" and "Syndicate" wherever they occur the words "Academic Senate" and "Executive Council" shall respectively be substituted;

(38) for section 34-A the following section shall be, substituted, namely:-

34-A. Constitution of Selection Committee.- There shall be constituted a Selection Committee in regard to the appointment of Professors and Readers which shall consist of the following, namely:-

(1) The Vice-Chancellor,

(2) Nominee of the Chairman of the Andhra Pradesh Commissionerate of Higher Education,

(3) Three experts from outside the University to be nominated by the Vice-Chancellor of whom atleast two shall be present in the Selection Committee,

(4) Chairman/Dean of the Faculty concerned.

Provided that no person shall participate in the meetings of the Selection Committee for any appointment if he/if his near relative is a candidate for that appointment.

Provided further that no teacher holding a post lower in rank than the one to which the appointment is to be made shall be a member of the Selection Committee.";

(39) in section 34-B, in sub-section (2), for the word "Syndicate", in the two places where it occurs, the words "Executive Council" shall be substituted.

(40) in section 34-C, for the word "Syndicate", in the two places where it occurs the words "Executive Council" shall be substituted;

(41) in section 34-D, for the word "Syndicate", in the two places where it occurs the words "Executive Council" shall be substituted;

(42) section 35-A shall be omitted;

(43) in section 36, for the words "State Government" the words "Andhra Pradesh Commissionerate of Higher Education" shall be substituted;

(44) in section 37, in sub-section (2), for the words "State Government", the words "Andhra Pradesh Commissionerate of Higher. Education" shall be substituted;

(45) in section 37-C, the proviso shall be omitted;

(46) in section 37-D-

(a) for the words "State Government" wherever they occur the words "Andhra Pradesh Commissionerate of Higher Education" shall be substituted;

(b) in the proviso, for the word "Syndicate" the words "Executive Council" and for the words "State Government" the words "Andhra Pradesh Commissionerate of Higher Education" shall be substituted;

(47) in section 39,-

(a) in clause (b), the words "and the Vice-Chancellor" shall be added at the end;

(b) in clause (c), for the word "election" the word "nomination" shall be substituted;

(c) clauses (e), (f) and (j) shall be omitted; (48) in section 40,-

(a) for sub-sections (1) to (4) the following shall be substituted, namely:-

"(1) Every Statute passed by the Executive Council shall be submitted to the Chancellor who may-give or withhold his assent thereto or refer it back to the Executive Council for reconsideration.

(2) No statute passed by the Executive Council shall have validity until assented to by the Chancellor.";

(49) in section 42,-

(a) in sub-section (1), for the word "Syndicate" in the two places where it occurs, the words "Executive Council" and for the words "Academic Council" the words "Academic Senate" shall be substituted;

(b) in sub-section (2), for the word "Syndicate" the words "Executive Council" shall be substituted; and the words beginning with "and the Senate" and ending with "modify any such ordinance" shall be omitted;

(c) sub-section (3) shall be omitted;

(50) in section 43,-

(a) in sub-section (1) for the words "Academic Council" the words "Academic Senate" "shall be substituted;

(b) for sub-section (2), the following sub-section shall be substituted, namely:-

"(2) All regulations shall have effect from such date as the Academic Senate may direct.";

(51) in section 44, for the words "Senate, the Syndicate, the Finance Committee or the Academic Council" the words "Executive Council, the Finance Committee or the Academic Senate" shall be substituted.

Section 3. Amendment of Act XIV of 1954

3. Amendment of Act XIV of 1954.- In Sri Venkateswara University Act, 1954-

(1) in section 1, in sub-section (2), the words "Anantapur" and "Kurnool" shall be omitted;

(2) in section:-

(a) in clause (a-2), for the word "Syndicate" the words "Executive Council" shall be substituted;

(b) in clause (b), the words "Anantapur" and "Kurnool" shall be omitted;

(3) in section 3,-

(a) in sub-section (1), the words "Anantapur", and "Kurnooi" shall be omitted;

(b) in sub-section (2), for the words "a senate, a Syndicate" the words "an Executive Council" shall be substituted and for the words "Academic Council" the words "Academic Senate" shall be substituted;

(4) in section 4:-

(a) in sub-section (i), in clause (1), after the word "research" the words "extension programmes" shall be inserted;

(b) clause (3) shall be omitted;

(c) in clause (13),-

(i) after item (a), the following item shall be inserted, namely:-

"(a-1) University Press"

(ii) in item (d), before the words "A the-letics clubs", the words "sports and" shall be added;

(d) in sub-section (2),-

(i) for the word "Government", the words "Andhra Pradesh Commissionerate of Higher. Education" shall be substituted;

(ii) the words "under the management of the Government and the salaries of teachers in such colleges" occurring at the end shall be omitted;

(5) section 7 shall be omitted;

(6) in section 8,-

(a) in the marginal heading, after the word Inspection", the words "and inquiry" shall be added;

(b) in sub-section (3),-

(i) for the words "by such person or persons as they may direct" the words "by the Andhra Pradesh Comraissionarate of Higher Education" shall be ???;

(ii) the words "The Commissionerate shall inform the State Government of the resists of the inspection and inquiry" shall be added at the end;

(c) in sub-section (2), for the word "???" the words "Executive Council".shall be ???

(d) in sub-section, (3), for the word ‘???" the words "Executive Council" shall he ???

(7) in section 9, after Item (iv), the following items shall be inserted, namely:-

"(iv-a) The Deans,

(iv-b) The Directors,"

(8) in section 10, the words "and the President of the Senate" and "at meetings of the Senate and" shall be omitted,

(9) in section 12,-

(a) in sub-section (1), for clause (a), the following clause shall be substituted, namely:-

"(a) The Andhra Pradesh Commissionerate of Higher Education shall constitute a Search Committee consisting of:-

(f) in sub-section (2) in clause (b) for the word "Syndicate", the words "Executive Council" shall be substituted;

(g) for sub-section (3), the following sub-section shall be substituted, namely:-

(3) "Where the Vice-Chancellor is unable to exercise his powers, perform his functions and discharge his duties owing to absence, illness or any other cause, the Chancellor may, on the recommendation of the State Government make necessary arrangements to perform the duties of the Vice-Chancellor by appointing a Vice-Chancellor in-charge or otherwise.";

(10) in section 12-A, for the words "appointed by the Vice-Chancellor", the words "appointed by the Executive Council on the recommendation of the Vice-Chancellor" shall be substituted;

(11) for section 13, the following section shall be substituted, namely:-

13. The Register.- (1) The Registrar shall be a whole time paid officer of the University appointed by the Executive Council for a term of three years or less and on such other terms as may be prescribed by the statutes provided that he shall not continue in that office for more than six years.

(2) The Registrar shall exercise such powers and perform such duties as may be prescribed.

(3) The Executive Council may transfer the Registrar to a suitable position even before the completion of the term provided he is shown a position in the University with the same emoluments.";

(12) in section 13-A, for sub-section (1), the following section shall be substituted, namely:-

"(1) The Finance Officer shall be a whole-time paid Officer of the University appointed by the Executive Council for a period of three years or less and on such terms conditions as may be prescribed Provided that he shall not continue in that office for ??? than six years. The Executive Council may ??? the Finance Officer to a suitable position even before the completion of the term provided he is shown a position in the University with the same emoluments.".

(13) in section 14, for items (i), (ii) and (iii), the following items shall be substituted, namely:-

"(i) The Executive Council;

(ii) The Academic Senate.";

(14) Sections 15, 16, and 17 shall be omitted;

18. Executive Council.- (1) The Executive Council shall consist of the following persons, namely:-

3. The Executive Officer, Tirumals Tirupathi Devasthanams;

Class II-Other Members:

1. Two persons nominated by the Andhra Pradesh Commissionerste of Higher Education;

2. One Professor and one Principal Dean of the University Colleges; Professional Colleges, one Principal of the affiliated colleges nominated by the Chancellor by rotation in order of seniority for a period of one year, on the recommendation of the State Government;

3. Three eminent persons ??? the interests of the University area nominated ???.

(b) in sub-sections (2), (3), (4) and (5), for the word "Syndicate" the words "Executive Council" shall be substituted;

(16) in section 19,-

(a) in the opening portion and in the marginal heeding, for the word "Syndicate" the words "Executive Council" shall be substituted;

(z-3) to confer honorary degrees or distinctions on approved persons in the manner prescribed;

(z-4) to institute, allowances, travelling allowances, scholarships, exhibitions (bursaries, studentships, medals and prizes);

(z-5) to provide for lectures and instructions to persons not being students of the University and to grant diplomas to them;

(z-6) to establish, and maintain hostels;

(x-7) to prescribe the fees to be charged for the affiliation and recognition of colleges;

(z-8) to prepare the annual reports and ??? accounts and the financial estimates of the University for submission to the Academic Senate;

(z-9) to enter into any agreement with the Government or with the private managements for assuming the management of any institution and taking over its properties and liabilities or for any other purpose not repugnant to the provisions of the Act;

(z-10) the Executive Council shall exercise all the powers of the University not otherwise provided for and all powers requisite to give effect to the provisions of the Act.";

(17) for section 20, the following section shall be substituted, namely:-

"Annual Report 20. The Executive Council shall prepare an annual report of the University and send it to the Academic Senate on or before such date as may be prescribed by the Statutes. The report shall be considered by the Academic Senate at its next meeting. A copy of the report with a copy of the resolution thereon if any of the Academic Senate shall be submitted to the State Government for information.";

(18) in section 21,-

(a) for the word "Syndicate" the words "Executive Council" shall be substituted;

(b) for the words "The accounts when audited", the words "The accounts so audited" shall be substituted;

(c) for the words "shall be submitted to the Senate" the words "shall be sent to the Academic Senate" shall be substituted;

(8) fifteen or 1/3 of the professors of the University whichever is less nominated by the Chancellor on the recommendation of the Andhra Pradesh Commissioner are of Higher Education.

(9) fifteen or 1/3 of the Chairman, Boards of studies whichever is less nominated by the Chancellor on the recommendation of the Andhra Pradesh Coramissionerate of Higher Education.

(10) ten teachers of the University, constituent and affiliated colleges nominated by rotation by the Chancellor on the recommendation of the State Government.

(11) fifteen Principals of the affiliated colleges nominated by the Chancellor on the recommendation of the State Government.

(12) two Heads of Research Laboratories and Institutions in the University area recognised by the University, nominated by the Chancellor on the recommendation of the State Government.

(13) six students for a term of one year two each from (a) undergraduate (Professional and Non-Professional) (d) Post-Graduate and (c) Research Scholars nominated by the Chancellor from among the names recommended by the State Government on the basis of merit as prescribed;

(14) Seven from the alumni of the University representing one Scheduled Castes, one Scheduled Tribc one Backward classes, one woman, one Professor from such areas as engineering, medicine and law, one Management of the College, one representing Commerce and Industry nominated by the ??? on the recommendation of the State Government.

(15) five Members of the Legislative Assembly nominated by the State Government; and

(16) such members of the Executive Council who are not otherwise Members of the Academic Senate.

24. Powers of the Academic Senate.- (1) The Academic Senate shall have the authority to provide instruction and training in such branches of learning as it thinks ht. It shall exercise general supervision over the Academic policies of the University and provide leadership for raising the standard and quality of education and research.

(2) In particular the Academic Senate shall have powers:-

(a) to consider the Annual Report and Budget Estimate prepared by the Executive Council;

(b) to advise the Executive Council on all academic matters, including the control and management of the libraries;

(c) to constitute the several Faculties as may be prescribed;

(d) to formulate, modify or revise ??? for the constitution or reconstitution of departments of leaching;

(e) to make recommendations to the Executive Council for the institution of Professorships, Reader-ships, Lectureships and other teaching posts and in regard to the duties and emoluments thereof;

(f) to make recommendations to the Executive Council for the recognition of teachers qualified to give instruction in affiliated and Oriental colleges.

(g) to make recommendation to the Executive Council for the selection of a college in the University area on a reference made thereof by the Executive Council for the conferment of autonomy on such college or for withdrawal of autonomy already conferred;

(h) to make regulations for the encouragement of co-operation and reciprocity among colleges with a view to promoting academic life;

(i) to make regulations regarding the admission of students to the University;

(j) to make regulations relating to courses, examinations and the conditions on which students shall be admitted to examinations for the degrees of the University;

(k) to decide the conditions under which exemptions relating to the admission of students to examinations may be given;

(l) to appoint standing committees and to delegate to them or the Vice-Chancellor, powers to execute any of the functions assigned by this Act;

(m) to make regulations for the use of Telugu as medium of instruction and examination?’;

(22) in section 25,-

(a) for sub-section (1), the following sub-section shall be substituted, namely:-

"(1) The University shall have such faculties comprising of such departments of teaching as may be prescribed by the statutes.";

(b) in sub-section (2),-

(i) in clauses (a) and (b) for the words "Academic Council" the words "Academic Senate" shall be substituted;

(ii) for the words "The functions, of the Faculties shall be prescribed by the Statutes", the following shall be substituted, namely:-

"(c) There shall be a Dean/Chairman for each Faculty who shall be appointed by the Executive Council from among the members of the faculty on the recommendation of the Vice-Chancellor. The functions of the Faculties shah be such as may be prescribed by the Statutes.";

(23) in section 26, the, following words shall be added at the end, namely:-

"There shall be representation for students on the Board of Studies.";

(24) after section 26, the following section shall be inserted, namely:-

26-A Planning and Monitoring Bord.- There shall be a Planning and Monitoring Board consisting of:-

(1) The Vice-Chancellor (Chairman);

(2) Four Principals of University and Professional Colleges, Deans/Chairman of Faculties nominated by the Vice-Chancellor.

(3) Two out side educationists nominated by the Vice-Chancellor.

(4) Two nominees of the Andhra Pradesh commissionerate of Higher Education.

The Board shall be the Principal Planning and reviewing body and it should also arrange for periodical monitoring of the developmental programmes and of teaching and research in the University."

(25) in section 31, for sub-section (1) including the marginal heading the following sub-section and marginal heading shall be substituted namely:-

(1) Terms of office of members of Executive council and the Academic Senate etc.- Save as otherwise provided the Executive Council, the Finance Committee and the Academic Senate shall be reconstituted at or about the same time every three years and the members of these authorities shall except in the case of ex-officio members hold office as members thereof up to the date of next reconstitution:

Provided that no person other than ex-officio member, professor, Heads of Departments other than professors, Dean/Chairman of Faculties and principals snail be a member of the Executive Council or Academic Senate for more than two terms consecutively.";

(26) after section 31-A, the following section shall be inserted, namely:-

31-B "Special provision as to the reconstitution of the Executive Council, Academic Senate and the Finance Committee.- Notwithstanding anything in this Act,-

(a) the members of the Senate, the Syndicate, Academic Council and the Finance Committee constituted and functioning before the commencement of section 3 of the Andhra Pradesh University Acts (Amendment) Act, 1987 (hereinafter referred to as the said Act) shall continue to be such members and function only until a new Executive Council, Academic Senate, and the Finance Committee is reconstituted in accordance with the provisions of this Act as amended by the said Act; and

(b) on the reconstitution of such new Executive Council Academic Senate and the Finance Committee in accordance with the provisions of this Act as amended by the said Act the members of the ???, the Syndicate, the Academic Council and the ??? Committee holding office immediately before such reconstitution shall cease to be such members.";

(27) in section 32, for the words "Senate" and "Syndicate" where-ever they occur the words "Academic Senate" and "Executive Council" shall respectively be substituted;-

(28) section 32-A shall be omitted;

(29) in section 34,

(a) in sub-section (1) for the words "Academic Council" the words "Academic Senate "shall be substituted;

(b) in sub-section (2), for the words "Syndicate" and "Academic Council" the words "Executive Council" and "Academic Senate" shall respectively be substituted;

36. "Constitution of Selection Committee.- There shall be constituted a Selection Committee in regard to the appointment of Professors and Readers, which shall consist of the following, namely:-

(1) The Vice-Chancellor,-

(2) Nominee of the Chairman of the Andhra Pradesh Ctommissionerate of Higher Education;

(3) Three experts from outside the University to be nominated by the Vice Chancellor of whom atleast two shall be present in the Selection Committee,

(4) Chairman/Dean of the Faculty concerned:

Provided that no person shall participate in the meetings of the Selection Committee for any appointment if he/if his near relative is a candidate for that appointment:

Provided further that no teacher holding a post lower in rank than the one to which the appointment is to be made shall be a member of the Selection Committee."

(34) Section 37-A shall be omitted:

(35) in section 39, in sub-section (2), for the words "State Government" the words "Andhra Pradesh Commissionerate of Higher Education" shall be substituted:

Section 4. Amendment of Act No. IX of 1959

4. Amendment of Act No. IX of 1959.- In the Osmania University Act; 1959,-

(1) In section 1, for sub-section (2), the following sub-section shall be substituted, namely,-

"(2) It extends to the area comprising the districts of Hyderabad, Rangareddy, Mahabubnagar, Medak, Nalgonda and Nizamabad in the State of Andhra Pradesh".

(1-a) in section 2, in clause (a-2), for the word "Syndicate" the words "Executive Council" shall be substituted;

(2) in section 3, in sub-section (2), for the words "a Senate, a Syndicate and an Academic Council" the words "an Executive Council and an Academic Senate" shall be substituted;

(3) in section 4,-

(a) in sub-section (1), clause (c) shall be omitted;

(b) for sub-section (2), the following sub-section shall be substituted, namely:-

"(2) Nothing contained in sub-section (i) shall be deemed to prevent the Andhra Pradesh Commissioner are of Higher Education from issuing such orders as it may deem fit in regard to the levy of fees and other charges for admission of students to colleges.’

(4) section 7 shall be omitted;

(5) in section 8,

(a) for sub-section (1) the following sub-suction shall be substituted, namely:-

"(1) The Government shall have the right to cause an inspection to be made by the Andhra Pradesh Commissionerate of Higher Education of the University, its buildings, laboratories, libraries, museums, workshops and equipment and of any institutions maintained by or affiliated to the University and also to cause an inquiry to be made, into the teaching and other work conducted or done by the University in respect of any matter connected with the University. The Government shall in every case give notice to the University of its intention to cause such inspection or inquiry to be made and the University shall be entitled to be represented thereat. The Commissionerate shall inform the Government of the results of the inspection and inquiry.".

(b) in sub-sections (2), (3) and (4) for the word "Syndicate" the words "Executive Council" shall be substituted;

(6) in section 9, after item (iii-a), the following items shall be inserted, namely:-

"(iii-b) The Deans;

(iii-c) The Directors";

(7) in section 10, the words "and the President of the Senate" and "at meetings of the Senate and" shall be omitted;

(8) in section 12, for sub-section (1), the following sub-section shall be substituted, namely:-

"(1) The Andhra Pradesh Commissionerate of Higher Education shall constitute a Search Committee consisting of:

(i) a nominee of the Executive Council;

(ii) a nominee of the Andhra Pradesh Commissionerate of Higher Education; and

(iii) a nominee of the State Government.

The Search Committee shall submit a panel of three persons to the Government from among whom the State Government shall recommend one person to the Chancellor for appointment as Vice-Chancellor and the Chancellor shall appoint such person as Vice-Chancellor;

Provided that no person shall hold the office of Vice-Chancellor beyond the age of sixty five years";

(9) in section ???,-

(a) in sub-section (1), the proviso shall be omitted.

(b) for sub-section (2), the following sub-section shall be substituted, namely:-

"(2) The Vice-Chancellor shall be paid the pay and allowances admissible from time to time to a Principal Secretary in the State Government. He shall be provided with a furnished official accommodation for which he shall pay ten per cent, of his salary towards rent.";

(b) for sub-section (3), the following sub-section shall be substituted, namely:-

"(3) When the Vice-Chancellor is unable to exercise his powers, perform his functions and discharge his duties owing to absence, illness or any other cause, the Chancellor, may on the recommendation of the Government, make necessary arrangements to perform the duties of the Vicc-Chancellor by appointing, a Vice-Chancellor in-charge or otherwise.";

(10) in section 14,-

(a) for sub-section (1) the following sub-section shall be substituted, namely:-

"(1) He shall, by virtue of his office be a member and Chairman of the Executive Council and of the Academic Senate and shall preside at the Convocations of the University in the absence of the Chancellor.";

(b) in sub-section (3), for the words "Senate, the Syndicate and the Academic Council", the words "Executive Council and the Academic Senate" shall be substituted;

(c) in sub-section (5), for the word "Syndicate" wherever it occurs, the words "Executive Council" shall be substituted;

(d) to sub-section (6), the following proviso shall be added, namely:-

"Provided that he shall not give effect to any decision of any authority of the University if he is of the opinion that such a decision is not in the interests of the University.";

(e) in sub-section (8), in clause (b), for the word "Syndicate" the words "Executive Council" shall be substituted;

(11) in section 14A, for the words "appointed by the Vicc-Chancellor" the words "appointed by the Executive Council on the recommendation of the Vice-Chancellor" shall be substituted;

(12) for section 15, the following section shall be-substituted, namely.-

(13) in section 16, for items (i), (ii) and (iii), the following items shall be substituted, namely:-

(14) sections 17, 18 and 19 shall be emitted.

(31) to control, in general, all colleges in the University area in the manner prescribed by Statutes;

(32) to confer degrees and other academic distinctions on persons who have pursued approved courses of study in a University college or an affiliated college or oriental, college, unless exempted therefrom in the manner prescribed by the regulations and shall have passed the prescribed examination of the University or shall have carried on research under conditions prescribed;

(33) to confer honorary degrees or distinctions on approved persons in the manner prescribed;

(34) to institute allowances, travelling allowances, scholarships, exhibitions (bursaries, studentships, medals and prizes);

(35) to provide for lectures and instruction to persons not being students of the University and to grant diplomas to them;

(36) to establish and maintain hostels;

(37) to prescribe the fees to be charged for the affiliation and recognition of colleges;

(38) to prepare the annual reports and annual accounts and the financial estimates of the University for submission to the Academic Senate;

(39) to enter into any agreement with the Government or with the private managements for assuming the management of any institution and taking over its properties and liabilities or for any other purpose not repugnant to the provisions of the Act;

(40) the Executive Council shall exercise all the powers of the University not otherwise provided for and all powers requisite to give effect to the provisions of the Act.

(17) in section 22, for the words "Syndicate" and "Senate" the words "Executive Council" and "Academic Senate" shall respectively be substituted; and for the words "The accounts when audited" the words "The accounts, so audited" shall be substituted;

(18) in section 22-A

(a) for the word "Syndicate" the words "Executive Council", and for the word "Senate" wherever it occurs, the words "Academic Senate" shall be substituted;

(b) the proviso thereunder shall be omitted;

(19) for section 23, the following section shall be submitted namely:-

23. The Executive Council shall prepare an annual report of the University and it to the Academic Senate on or before such date as may be prescribed by the Senate. The report shall be considered by the Academic Senate at its next annual meeting. A copy of the report with a copy of the resolution if any of the Academic Senate shall be submitted to the State Government for information.";

(20) in Section 24, for the word "Syndicate" the words "Educational Council" and for the ??? "Senate" the words "Academic Senate." shall be submitted;

(10) Ten teachers of the University, constituent and affiliated colleges nominated by rotation by the Chancellor on the recommendation of the Government;

(11) Fifteen Principals of the affiliated colleges nominated by the Chancellor on the recommendation of the Government;

(12) two heads of Research Laboratories and ??? in the University ??? recognised by the University nominated by the Chancellor on the recommendation of the Government.

(13) Six students for a team of none year two each from (a) undergraduate (Professional and Non-???) (b) Post-graduate and (c) Research-Scholars nominated by the Chancellor from among the names recommended by the Government on the basis of merit as prescribed.

(14) Seven from the alumni of the University representing one SC one ST/one B.C., one Woman, one Professor from such areas as engineering, medicine and law, ore Management of the College, one representing Commerce and ??? nominated by the Chancellor on the recommendation of the Governing;

(15) five members of the Legislative Assembly nominated by the Government;

(16) such members of the Educative Council who are not otherwise Members of the Academic Senate.

26. Powers of the Academic Senate (1).- The Academic Senate shall have the authority to provide instruction and training in such branches of leaning as it thinks ???. It shall exercise general ??? over the Academic policies of the University and provide leadership for raising the standard and quality of education and research.

(2) In particular the Academic Senate shall have powers;

(a) to consider the Annual Report and Budget Estimates prepared by the Executive Council;

(b) to advise the Executive Council or all academic matters, including the control and management of the libraries;

(c) to constitute the several faculties as may be prescribed;

(d) to formulate, modify or revise schemes for the constitution or reconstitution of departments of reaching;

(e) to make recommendations to the Executive Council for the institution of Professorships, Readerships, Lectureships and other teaching posts and in regard to the duties and emoluments thereof;

(f) to make recommendations to the Executive Council for the recognition of teachers qualified to give instruction in Affiliated and Oriental Colleges;

(g) to make recommendation to the Executive Council for the selection of a college in the University area on a reference made thereof by the Executive Council for the conferment of autonomy on such college or for withdrawal of autonomy already conferred;

(h) to make regulations for the encouragement of co-operation and reciprocity among colleges with a view to promoting academic life;

(i) to make regulations regarding the admission of students to the University;

(j) to make regulations relating to courses, examinations and the conditions on which students shall be admitted to examinations for the degrees of the University;

(k) to decide the conditions under which exemptions relating to the admission of students to examinations may be given;

(l) to appoint standing committees and to delegate to them or the Vice-Chancellor, powers to execute any of the functions assigned by this Act;

(m) to make regulations for the use of Telugu as medium of instruction and examination."

(23) in section 27.-

(a) for sub-section (1), the following sub-section shall be substituted, namely:-

"(1) The University shah have such faculties as may be prescribed by the Statutes".;

(b) in sub-section (4)-

(i) for clause (a), the following shall be substituted, namely:-

"(a) There shall be a Dean/Chairman for each faculty who shall be appointed by the Executive Council from among the members of the faculty concerned on the recommendation of the Vice-Chancellor".

(ii) in clause (b), for the word ‘Dean’ the words ‘Dean/Chairman’ shall be substituted.

(24) to section 28, the following words shall be added at the end namely:-

"There shall be representation for students on the Boards of Studies".;

(25) after section 28, the following section shall be inserted, namely:-

28-A. "Planning and Monitoring Board.- There shall be a Planning and Monitoring Board consisting of:-

The Vice-Chancellor (Chairman)

Four Principals of University, and

Professional colleges, Deans/Chairman of Faculties nominated by the Vice-Chancellor, Two outside educationist? nominated by the Vice-Chancellor,

Two nominees of the Andhra Pradesh Conimissionerate of Higher Education.

The Board shall be the Principal Planning and reviewing body and it should also arrange for periodical monitoring of the developmental programmes and of teaching and research in the University.";

(26) in section 30, the words "elected or" shall be omitted;

(27) in section 32, the words "or the invalidity of the election of any of its members" shall be omitted;

(28) in section 33, for sub-section (1) including the marginal heading, the following shall be substituted, namely:-

(1) "Term of office of members of Executive council and the Academic Senate etc.- Save as otherwise provided the Executive Council, the Finance Committee and the Academic Senate shall be reconstituted at or about the same time every three, years and the members of these, authorities shall except in the case of ex-officio members hold office as members thereof upto the date of next reconstituted;

Provided that no person other then ex-officio member professor, Heads of Departments other than Professors, Deans/Chairman of Faculty and Principals shall be a, member of the Executive Council or the Academic Senate for more them two term consecutively.";

(29) after section 33-B, the following section shall be inserted namely:-

33-C. "Special provision as to the reconstitution of the Executive Council, Academic Senate and the Finance Committee. Notwithstanding anything in this Act,-

(a) the members of the Senate, the Syndicate, the Academic Council and the Finance Committee constituted and functioning before the commencement of section 4 of the Andhra Pradesh University Acts Amendment) Act, 1987 (hereinafter referred to as the said Act) shall continue to be such member and function only until a new Executive Council, Academic Senate and the Finance Committee is reconstituted in accordance with the provisions of this Act as amended by the said Act, and

(b) on the reconstitution of such new Executive Council, Academic Senate and the Finance Committee in accordance with the provisions of this Act as amended by the said Act, the members of the Semite, the Syndicate, the Academic Council and the ??? Committee holding office immediately before such reconstitution shall cease to be such members".

(30) in section 34, for the words ‘Senate and Syndicate’ wherever they occur, the words ‘Academic Senate’ and ‘Executive Council’ shall respectively be substituted;

(31) in section 37, for the words. ‘Academic Council’ the words ‘Academic Senate’ shall be substituted,

(32) in section 38-A, in sub-section (2), for the word ‘Syndicate’ in the two places whose it occurs, the words ‘Executive Council’ shall be, substituted.

(33) in section 38-B. for the word ‘Syndicate’ in she two places where it occurs, the words "Executive Council" shall he substituted;

(34) in section 38-C. for title word ‘Syndicate’ in the two places where it occurs, the words ‘Execute Council’ shall be substituted;

(35) for section 39, the following section shall be substituted namely:

39. Constitution of Selection Committee.- There shall be constituted a Selection Committee in regard to the appointment of Professors and Readers which shall consist of the following, namely:-

(1) The Vice-Chancellor

(2) Nominee of the Chairman of the Andhra Pradesh Commissionerate of Higher Education.

(3) Three experts from outside the University to be nominated by the Vice-Chancellor of whom atleast two shall be present in the Selection Committee.

(4) Chairman Dean of the Faculty concerned:

Provided that no person shall participate in the meetings of the Selection Committee for any appointment if he if his near relative is a candidate for that appointment.

Provided further that no teacher holding a post lower in rank than the one to which the appointment is to be made shall be a member of the Selection Committee.";

(36) section 40-A shall be omitted.

(37) in section 41, in clause (ii) for the wont ‘Government’ the words ‘Andhra Pradesh Commissionerate of Higher Education’ shall be substituted:

(38) in section 42, for the word ‘Syndicate’ the words ‘Executive Council’ shall be substituted;

(39) in section 43,-

(a) for sun-section (1), the following sub-section shall be substituted, namely:-

"(1) There shall be constituted a Finance Committee which shall be a Sub-Committee of the Executive Council with the following as members, namely:-

(2) No statute passed by the Executive Council shall be valid or shall come into force until assented to by the Chancellor.";

(44) in section 46,-

"(2) All regulations shall have effect from such date as the Academic Senate may direct.";

Section 5. Amendment of Act No. 44 of 1976

5. Amendment of Act No. 44 of 1976.- In the Kakatiya University Act, 1976,-

(1) in section 2,-

(a) in clause (1), for the word "Syndicate", the word "Executive Council" shall be substituted;

(b) in clause (20), for the words "municipality of Warangal", the words "districts of Warangal, Adilgbad, Karimnagar and Khammam" shall be substituted:

(2) in section 3, for sub-section (1), the following sub-section shall be substituted, namely:-

"(1) There shall be constituted in and for the local area comprising the Districts of Warangal, Adilabad, Karimnagar and Khammam a University by the name of the Kakatiya University, which shall consist of a Chancellor, a Vice-Chancellor, a Rector if any, an Executive Council and an Academic State.";

(3) in section 5,-

(i) in subjection (1),

(a) in item (i), after the word "research" the word "extension programmes" shall be inserted;

(b) in item (xxiv), the words "with the prior written approval of the Government" shall be omitted;

(c) in item (xxv), the words "University Press, University Sports and Athletic Clubs" shall be added at the end;

(ii) in sub-section (3), for the word "Government" the words "Andhra Pradesh Commissionerate of Higher Education" shall be substituted; and the words "under the management of the Government and the salaries of teachers in such colleges" shall be omitted;

(4) in section 7,-

(a) for sub-section (1), the following sub-section shall be substituted, namely:-

"(1) The Government shall have the right to cause an inspection to be made by the Andhra Pradesh Commissionerate of Higher Education of the University, its buildings, laboratories, libraries, museums, workshops and equipment and of any institutions maintained by or affiliated to the University and also to cause an inquiry to be made, into the teaching and other work conducted or done by the University in respect of any matter connected with the University. The Government shall in every case give notice to the University of its intention to cause such inspection or inquiry to be made and the University shall be entitled to be represented thereat. The Commissionerate shall inform the Government of the results of the inspection and inquiry.";

(b) in sub-section (2), for the word "Syndicate" the words "Executive Council" shall be substituted;

(c) in sub-section (3), for the word "Syndicate" the words "Executive Council" shall be substituted;

(5) in section 8. after item (4), the following item shall be inserted, namely:-

"(4-a) the Directors";

(6) in section 9, in sub-section (2), the words "and President of the Senate and shall, when present, preside at the meetings of the Senate" shall be omitted;

(7) in section 10,-

(a) for sub-section (1) the following sub-section shall be substituted, namely:.-

"(1) The Andhra Pradesh Commissionerate of Higher Education shall constitute a Search Committee consisting of:-

(i) a nominee of the Executive Council;

(ii) a nominee of the Andhra Pradesh Commissionerate of Higher Education; and

(iii) a nominee of the Government.

The Search Committee shall submit a panel of three persons to the State Government from among whom the State Government shall recommend one person to the Chancellor for appointment as Vice-Chancellor and the Chancellor shall appoint such person as Vice-Chancellor.

No person shall hold the office of Vice-Chancellor beyond the age of Sixty live years.";

(b) to sub-section (2), the following proviso shall be added, namely:-

"Provided that he shall not give effect to any decision of any authority of the University if he is of the opinion that such a decision is not in the interests of the University.";

(c) in sub-section (3), in the second proviso, for the word "Syndicate" in the two places where it occurs, the words "Executive Council" shall be substituted;

(8) for section 11, the following section shall be substituted, namely:-

11. The Rector.- The Rector shall be appointed by the Executive Council on the recommendation of the Vice-Chancellor in such manner and shall exercise such powers and perform such duties as may be prescribed by the statutes.";

(9) in Section 12, for sub-section (1), the following sub-section shall be substituted, namely:-

"(1) The Registrar shall be a whole-time paid officer of the University appointed by the Executive Council for a term of three years or less and on such other terms as may be prescribed by the Statutes; Provided that he shall not continue in that office for more than six years. The Executive Council may transfer the Registrar to a suitable position even before the completion of the term provided he is shown a position in the University with the same emoluments."

(10) for section 13, the following section shall be substituted, namely:-

13. Finance Officer.- (1) The Finance Officer shall be a whole-time paid officer of the University appointed by the Executive Council for a period of three years or less end on such terms and conditions as may be prescribed, provided that he shall not continue in that office for more than six years.

(2) The Executive Council may transfer the Finance Officer to a suitable position even before the completion of the term provided he is shown a position in the University with the same emoluments.";

(11) for section 14, the following section shall substituted, namely:-

"4. Deans of faculties and other office.- There shall be a Deans Chairman for each faculty who shall be appointed by the Executive Council from among the members of the faculty on the recommendation of the Vice-Chancellor. The powers and duties of the Deans Chairmen of Faculties and the manner of appointment and the powers and duties of other officers shall be prescribed by the Statutes.";

(12) in section 15, for items (1), (2) and (3), the following items shall be substituted, namely:-

(1) The Executive Council;

(2) The Academic Senate.",

(13) Section 16 shall be omitted;

(14) in section 17, for the word "Syndicate" wherever it occurs, the words "Executive Council" shall be substituted;

(15) in section 18, for the words "Academic Council" wherever they occur, the words "Academic Senate" shall be substituted."

(16) in section 20, to sub-section (2), the words "Save as otherwise provided in section 14" shall be added in the beginning;

(17) in section 21, for the words, "Planning Board" wherever they occur, the words "Planning and Monitoring Board" shall be substituted;

(18) in section 22, for the words "Senate, Syndicate and Academic Council," wherever they occur, the words "Executive Council and Academic Senate" shall be substituted;.

(19) after section 22A, the following section shall be namely:-

22-B. Special provision is to the reconstitution of the Executive Council Academic Senate and the Finance Committee.- Notwithstanding anything in his Act,-

(a) the members of the Senate, the Syndicate, the Academic Council and the Finance Committee constituted and functioning before the commencement of section 5 of the Andhra Pradesh University Acts (Amendment) Act, 1987 (herein-after referred to as the said Act) shall continue to be such members and function only until a new Executive Council, Academic Senate and the Finance Committee is reconstituted in accordance with the provisions of this Act as amended by the said Act; and

(b) on the reconstitution of such new Executive Council, Academic Senate and the Finance Committee in accordance with the provisions of this Act as amended by the said Act, the members of the Senate, the Syndicate, the Academic Council and the Finance Committee holding office immediately before such reconstitution shall cease to be such members.";

(20) in section 23, in clause (ii), for the word "Government" the word "Andhra Pradesh Commissionerate of Higher Education" shall be substituted;

(21) in section 24, for the word "Syndicate" the words "Executive Council" shall be substituted;

(22) in section 25, the proviso shall be omitted;

(23) in section 26",-

(a) for the word "Government" wherever it occurs, the words "Andhra Pradesh Commissionerate of Higher Education" shall be substituted;

(28) for section 32, the following section shall be substituted, namely:-

32. Annual accounts.- The Executive Council shall prepare during each financial year the annual accounts of the University of the preceding financial year and submit them to such audit as the Government may direct before the end of the financial year. The accounts so audited shah he published in the Andhra Pradesh Gazette, and copies thereof together with copies of the audit report shall he sent to the Academic Senate not later than two years from the end of the financial year to which the accounts pertain and to the Government.":

(29) after section 32, the following section shall be inserted, namely:-

32-A. Financial estimate.- The Executive Council shall prepare before such date as may be prescribed by the Statutes, the financial estimates for the ensuing financial year along with the annual accounts, whether audited or not, of the preceding financial year and end the same to the Academic Senate. These estimate shall be considered by the Academic Senate at its annual meeting and resolutions of the Academic Senate thereon shall be submitted to the Government for information.";

(30) In section 33, in sub-section (2), for the word "Syndicate" occurring in two places, the words "Executive Council" shall be substituted;

(31) in section 34, for the word "Syndicate" occurring in the two places, the words "Executive Council" shall be substituted;

(32) in section 35, for the word "Syndicate" occurring in the two places, the words "Executive Council" shall be substituted;

(33) section 37 shall be omitted;

(34) in section 38, the words "elected or" shall be omitted;

(35) in section 40, the word "elected" in the two places where it occurs shall be omitted;

(iii) in Statute 2,-

1. Two persons nominated by the Andhra Pradesh Commissionerate of Higher Education.

2. One Professor and one Principal/Dean of the University Colleges/Professional Colleges, one Principal of the affiliated colleges nominated by the Chancellor by rotation in order of seniority for a period of one year on the recommendation of the Government;

3. Three ??? persons representing the educational ??? of the University area nominated by the State Government.

(2) The term ??? of the members shall be three years;

(b) in clauses (3), (4), (5) and (6), for the word "Syndicate" the words "Executive Council" shall be substituted;

(G) in Statue 6, for the heading thereof and for clauses (1) and (2), the following shall be substituted, namely:-

"THE ACADEMIC SENATE

6. Academic Senate.- (1) The Academic Senate shall constitute of the following persons, namely:-

(1) The Vice-Chancellor;

(2) The Rector;

(3) The Secretary, Andhra Pradesh Commissionerate of Higher Education;

(4) The Secretary to Government, Education

(5) The Director, N.C.C.;

(6) All Deans Chairman of Faculties/Directors of Schools and Administrative Deans:

(7) Fifteen or ⅓ of Heads of the Department of the University whichever is less nominated by the Chancellor on the recommendation of the Andhra Pradesh Commissionerate of Higher Education;

(8) Fifteen or ⅓ of the Professors of the University whichever is less nominated by the Chancellor on the recommendation of the Andhra Pradesh Commisionerate of Higher Education;

(9) Fifteen or ⅓ of the Chairman, Boards of Studies whichever is less nominated by the Chancellor on the recommendation of the Andhra Pradesh Commissioneratc of Higher Education;

(10) ten teachers of the University, constituent and affiliated colleges nominated by rotation by the Chancellor on the recommendation of the Government;

(11) fifteen Principals of the affiliated colleges nominated by the Chancellor on the recommendation of the Government;

(12) the Principal of the Regulation ??? Collage, Warangal;

(13) two heads of Research Laboratories and Institutions in the University area recognised by the University, nominated by the Chancellor on the recommendation of the Government.

(14) Six student for a term of one year two each from (a) undergraduate (Professional and Non-Professional), (b) Post-Graduate and (c) Research-Scholars nominated by the Chancellor from among the names recommended by the Government on the ???.

(15) seven from the alumni of the University representing one SC, one ST and one B.C., one Woman, one Professor from such areas as Engineering, Medicine and law, one Management of the college, One representing Commerce and Industry nominated by the Chancellor on the recommendation of the Government.

(16) five members of the Legislative Assembly nominated by the Government: and

(17) such members of the Executive Council who are not otherwise Members of the Academic Senate.

(2) The term of office of the members shall be three years".;

(H) Statute 7 and the heading thereto shall be omitted.

(I) for Statute 8 and the heading thereto the following shall be substituted, namely:-

"QUORUM FOR THE MEETING OF THE EXECUTIVE COUNCIL.

8. The quorum for a meeting of the executive council shall be one-third of the total number of members or four persons whichever is higher."

(J) in Statute 9 and the heading thereto,-

(a) for the words "Syndicate" and "Academic Council" wherever they occur, the words "Executive Council" and "Academic Senate" shall respectively be substituted;

(b) in clause (b),-

(A) in item (ii), the word "lecturers" shall be omitted and to the item as so amended, the following proviso shall he added, namely:-

"I provide that if the Executive Council rejects the selections made by the Selection Committee, the matter shall be referred by the University to the Government whose decision thereon shall be final."

(B) item (xviii) shall be omitted and after item (xvii), the following items shall be added, namely:-

"(xviii) to institute and maintain University colleges;

(xix) to provide for research and advancement and dissemination of knowledge;

(xx) to institute professorships, readerships, lecturerships and other leaching posts required by the University;

(xxi) to establish and equip and maintain the University laboratories and libraries;

(xxii) to control, in general, all colleges in the University area in the manner prescribed by Statutes;

(xxiii) to confer degree, and other academic distinctions on persons who have pursued approved courses of study in a University college or an affiliated or Oriental College, unless exempted therefrom in the manner prescribed by the regulations and shall have passed the prescribed examination of the University or shall have carried on research under conditions, prescribed;

(xxiv) to confer honorary degrees or distinctions on approved persons in the manner prescribed;

(XXV) to institute allowances, travelling allowances, scholarships, exhibitions (bursaries, studentships, medals and prizes);

(XXVI) to provide for lectures and instruction to persons not being students of the University and to grant diplomas to them;

(XXVII) to establish and maintain hostels, to prescribe the fees to be charged for the affiliation and recognition of colleges;

(XXVIII) to prepare the annual reports and annual accounts and the financial estimates of the University for submission to the Academic Senate;

(XXIX) to enter into any agreement with the Government or with the private managements for assuming the management of any institution and taking over its properties and liabilities or for any other purpose not repugnant to the provisions of the Act;

(XXX) the Executive Council shall exercise all the powers of the University not otherwise provided for and all powers requisite to give effect to the provisions of the Act.";

(K) In Statute 10 and the heading thereto, for the words "Academic Council" wherever they occur the words "Academic Senate" shall be substituted;

(L) for Statute 11 and the heading thereto, the following shall be substituted, namely:-

"POWERS OF THE ACADEMIC SENATE.

11. (1) The Academic Senate shall have the authority to provide instruction and training in such branches of learning as it thinks fit. It shall exercise general supervision over the Academic policies of the University and provide leadership for raising the standard and quality of education and research.

(2) In particular the Academic Senate shall have powers:-

(a) to consider the Annual Report and Budget Estimates prepared by the Executive Council;

(b) to advise the Executive Council on all academic matters, including the control and management of the libraries;

(c) to constitute the several Faculties as may be prescribed;

(d) to formulate, modify or revise schemes for the constitution or recoinstitution of departments of teaching;

(e) to make recommendations to the Executive Council for the institution of Professorships, Readerships, Lecturerships and other teaching posts and in regard to the duties and emoluments thereof;

(f) to make recommendations to the Executive Council for the recognition of teachers qualified to give instruction in Affiliated and Oriental colleges;

(g) to make recommendation, to the Executive Council for the selection of a college in the University area on a reference made thereof by the Executive Council for the conferment of autonomy on such college or for withdrawal of autonomy already conferred;

(h) to make regulations for the encouragement of co-operation and reciprocity among colleges with a view to promoting academic life;

(i) to make regulations, regarding the admission of students to the University;

(j) to make regulations relating to courses examinations and the conditions on which students shall be admitted to examinations for the degrees of the University;

(k) to decide the conditions under which exemptions relating to the admission of students to examinations may be given;

(l) to appoint standing committees and to delegate to them or the Vice-Chancellor, powers to execute any of the functions assigned by this Act;

(m) to make regulations for the use of Telugu as medium of instruction and examination.";

(M) for Statute 12 and the heading thereto, the following shall be substituted, namely:-

"PLANNING AND MONITORING BOARD.

12. There shall be a Planning and Monitoring Board consisting of:-

(1) The Vice-Chancellor (Chairman);

(2) Four Principals of University; and

Professional Colleges, Deans/Chairman/of Faculties nominated by she Vice-Chancellor;

(3) Two outside educationists nominated by the Vice Chancellor;

(4) Two nominees of the Andhra Pradesh Commissionerate of Higher Education;

The Board shall be the Principal Planning and reviewing body and it should also arrange for periodical monitoring of the developmental programme and of teaching and research in the University.";

(N) In Statute 13, in clause (1), the following words shall be added at the end, namely:-

"There shall be representation for students on the Hoards of studies.";

(O) in Statute 14.-

(a) for clauses (1) and (2) the following clauses shall be substituted, namely:-

"(1) There shall be constituted a Finance Committee which shall be a sub-Committee of the Executive Council with the following as members, namely:-

(a) Vice Chancellor (Chairman).

(b) One member of the Executive Council from among the nominees of the Andhra Pradesh Commissionerate of Higher Education nominated by the Executive Council; and

(c) one member of the Executive Council from among its other members nominated by the Executive Council.";

(b) in clause (5), for the word "Syndicate" the words "Executive Council" shall be substituted;

(P) in Statute 15,-

(a) for the heading, the following shall be substituted, namely:-

"SELECTION COMMITTEE";

(b) for clauses (1) and (2), the following clauses shall be substituted, namely:-

"(1) There shall be constituted a Selection Committee in regard to the appointment of Professors, and Readers which shall consist of the following, namely:-

(1) The Vice Chancellor

(2) Nominee of the Chairman of the Andhra Pradesh Commissionerate of Higher Education;

(3) Three experts from outside the University to be nominated by the Vice-Chancellor of whom atleast two shall be present in the Selection Committee;

(4) Chairman/Dean of the Faculty concerned;

Provided that no person shall participate in the meetings of the Selection Committee for any appointment if he/if his near relative is a Candida'e for that appointment:

Provided further that no teacher holding a post lower in rank than the one to which the appointment is to be made shall be a member of the Selection Committee.";

(c) clause (6) shall be omitted.

(d) in clause (7)(ii), for the word "Chairman" wherever it occurs, the words "Chairman/" Dean shall be substituted;

(Q) in Statutes 16, 17, 21, 22, 24, 25, 26, 32 and 33, for the words "Syndicate" and/"Academic Council" wherever they occur the words. "Executive Council" and "Academic Senate" shall respectively be substituted;

(R) in Statute 29, for the words "Senate, the Syndicate, the Academic Council", the words "Executive Council and the Academic Senate" shall be substituted.

Section 6. Amendment of Act 43 of 1976

6. Amendment of Act 43 of 1976.- In the Nagarjuna University Act, 976,

(1) in section 2, in clause (1), for the word "Syndicate" the words "Executive Council" shall be substituted;

(2) in section 3, in sub-section (1) for the words "a Senate, a Syndicate" the words "an Executive Council" and for the words "Academic Council" the words "Academic Senate" shall be substituted;

(3) in section 5,

(a) in sub-section (1)

(i) in clause (i), ‘after the word’ "Research" the words "Extension Programmes" shall be inserted;

(ii) in clause (XXIV), the words "with the Prior written approval of the Government" shall be omitted;

(iii) in clause (XXV), the words "University Press, University Sports and athletic clubs and other similar associations" shall be added at the end;

(b) in sub-section (3),

(i) for the word "Government", the words "Andhra Pradesh Commissionorate of Higher Education" shall be substituted;

(ii) the words "under the management of the Government and the salaries of teachers in such colleges" shall be omitted,

(4) in section 7,

(a) in sub-section (1), for the words "such person or persons as they may direct" the words "the Aadhra Pradesh Commissionerate of Higher Education" shall be substituted and the words "The Commissionerate shall inform the Government of the results of the inspection and inquiry" shall be added at the end;

(b) in sub-section (2), for the word "Syndicate" the words "Executive Council" shall be substituted;

(c) in sub-section (3), for the word "Syndicate" the words "Executive Council" shall be substituted;

(5) in section 8, after item (4), the following item shall be inserted, namely:

"(4-a) The Director";

(6) in section 9, in sub-section (2), the words "and President of the Senate and shall, when present preside at the meetings of the Senate" shall be omitted;

(7) in section 10,

(a) for sub-section (1), the following sub-section shall be substituted, namely:-

"(1) The Andhra Pradesh Commissionerate of Higher Education shall constitute a Search Committee consisting of:

(i) a nominee of the Executive Council;

(ii) a nominee of the Andhra Pradesh Commissionerate of Higher Education, and

(iii) a nominee of the State Government,

The Search Committee shall submit a panel of three persons to the Government from among whom The Government shall recommend one person to the Chancellor for appointment as Vice-Chancellor and the Chancellor shall appoint such person as Vice Chancellor;

Provided that no person shall hold the office of Vice-Chancellor beyond the age of sixty-five years";

(b) to sub-section (2), the following proviso shall be added, namely:-

"Provided that he shall not give effect to any decision of any authority of the University if he is of the opinion that such a decision is not in the interests of the University.";

(c) in sub-section (3), in the second proviso, for the word "Syndicate" in the two places where it occurs, the words "Executive Council" shall be substituted;

(8) for section 11, the following section shall be substituted, namely:-

11. "The Rector.- Rector shall be appointed by the Executive Council on the recommendation of the Vice-Chancellor in such manner and on such terms and conditions from among the Senior Professors and shall exercise such powers and perform such duties as may be prescribed by the Statutes"

(9) in section 12, for sub-section (1), the following sub-section shall be substituted, namely:-

(1) Registrar.- The Registrar shall be a whole time paid officer of the University appointed by the Executive Council for a term of three years or less and on such other terms as may be prescribed by the Statutes; provided that he shall not continue in that office for more than six years. The Executive Council may transfer the Registrar to a suitable, position even before the completion of the term provided he is shown a position in the University with, the same emoluments."

(10) For Section 13 the following section shall be substituted, namely:-

13. "Finance Officer.- (1) The Finance Officer shall be a whole-time paid Officer of the University appointed by the Executive Council for a period of three years or less and on such terms and conditions as may be prescribed; provided that he shall not continue in that office for more than six years.

(2) The Executive Council may transfer the Finance Officer to a suitable position even before the completion of the term provided he is shown a position in the University with the same emoluments";

(11) for section 14, the following section shall be substituted, namely:-

14. Dean of Faculties Other Officers.- There shall be a Dean/Chairman of each Faculty who shall be appointed by the Executive Council from among the members of the Faculty on the recommendation of the Vice-Chancellor. The powers and duties of the Deans/Chairman of Faculties and the manner of appointment and the powers and duties of other officers shall be prescribed by the statutes.";

(12) for section 15, the following section shall be substituted, namely:-

15. "Authorities of the University.- The following shall be the authorities of the University:-

(1) the Executive Council;

(2) the Academic Senate;

(3) the Finance Committee;

(4) the Faculties;

(5) the Boards of Studies; and

(6) such other bodies as may be declared by the Statutes to be authorities of the University;"

(13) Section 16 shall be omitted;

(14) in section 17,

(a) in sub-section (1), for the word "Syndicate" the words "Executive Council" shall be substituted.

(b) in sub-section (2), for the word "Syndicate" the words "Executive Council" shall be substituted.

(c) in the marginal heading for the word "Syndicate" the words "Executive Council" shall be substituted.

(15) in section 18,-

(a) in sub-section (1) for the words "Academic Council" the words "Academic Senate" shall be substituted.

(b) in sub-section (2), for the words "Academic Council" the words "Academic Senate" shall be substituted;

(c) in the marginal heading for the words "Academic Council", the words "Academic Senate" shall be substituted;

(16) in section 20, to sub-section (2), the words "Save as otherwise provided in section 14" shall be added in the beginning;

(17) in section 21, for the words "Planning Board" wherever they occur, the words "Planning and Monitoring Board" shall be substituted;

(18) in section 22 and in the marginal heading, for the words, "Senate, Syndicate and Academic Council" the words "Executive Council and Academic Senate" shall be substituted;

(19) after section 22-A, the following section shall be inserted, namely:-

22-B. "Special Provision as to the reconstitution of the Executive Council Academic Council Academic Senate and the Finance Committee.- Notwithstanding anything in this Act,

(a) the members of the Senate the Syndicate, Academic Council and the Finance Committee constituted and functioning before the commencement of section 6 of the Andhra Pradesh University Acts (Amendment) Act, 1987 (hereinafter referred to as the said Act) shall continue to be such members and function only until a new Executive Council, Academic Senate and the Finance Committee is reconstituted in accordance with the provisions of this Act as amended by the said Act; and

(b) on the reconstitution of such new Executive Council, Academic Senate and the Finance Committee in accordance with the provisions of this Act as amended by the said Act, the members of the Senate, the Syndicate, the Academic Council and the Finance Committee holding office immediately before such reconstitution shall cease to be such members"

(20) in section 23, in clause (ii), for the word "Government" the words "Andhra Pradesh Commissionerate of Higher Education" shall be substituted.

(21) in section 24, for the word "Syndicate" the words "Executive Council" shall be substituted.

(22) in section 25, the Proviso shall be omitted

(23) in section 26,

(a) for the word "Government" wherever it occurs the words "Andhra Pradesh Commissionerate of Higher Education" shall be substituted

31. "Annual Report.- The Executive Council shall prepare an annual report of the University and send it to the Academic Senate on or before such date as may be prescribed by the Statutes. The report shall be considered by the Academic Senate at its next annual meeting. A copy of the report with a copy of the resolution thereon, if any of the Academic Senate shall be submitted to the Government for information".

(28) for section 32 the following section shall be substituted, namely:-

32. "Annual Accounts.- The Executive Council shall prepare during each financial year the annual accounts of the University of the preceding financial year and submit them to such audit as the Government may direct before the end of the financial year. The accounts so audited shall be published in the Andhra Pradesh Gazette and the copies thereof together who copies of the audit Report shall be sent to the Academic Senate not later than two years from the end of the financial year to which the accounts pertain and to the Government.";

(29) after section 32, the following section shall be inserted, namely:

32-A. "Financial Estimates.- The Executive Council shall prepare before such date as may be prescribed by the Statutes, the financial estimates for the ensuing financial year along with the annual accounts, whether audited or not, of the preceding financial year, and send the same to the Academic Senate. These estimates shall be considered by the Academic Senate at its annual meeting and the resolutions of the Academic Senate thereon shall be submitted to the Government for information.";

(30) in section 33, in sub-section (2), for the word "Syndicate." occuring in the two places, the words "Executive Council" shall be substituted;

(31) in section 34, for the word "Syndicate" occurring in the two places, the words "Executive Council" shall be substituted;

(32) in section 35, for the word "Syndicate" occurring in the two places, the words "Executive Council" shall be substituted;

(10) ten teachers of the University, constituent and affiliated colleges nominated by rotation by the Chancellor on the recommendation of the Government;

(11) fifteen Principals of the Affiliated Colleges ??? by the Chancellor on the recommendation of the Government;

(12) two Heads of Research Laboratories and Institution in the University area recognised by the University, nominated by the Chancellor on the recommendation of the Government;

(13) six students for a term of one year two-each front (a) under graduate (Professional and Non-Professional) (b) Post-Graduate and (c) Research-Scholars nominated by the Chancellor from among the names recommended by the Government on the basis of merit as prescribed;

(14) seven from the alumni of the University representing one Scheduled Caste, one Scheduled Tribe, one Backward Class, one Woman, one Professor from such areas as engineering, medicine and law, one Management of the College, one representing Commerce and Industry nominated by the Chancellor on the recommendation of the Government;

(15) five Members of the Legislative Assembly nominated by the Government; and

(16) such members of the Executive Council who are not otherwise Members of the Academic Senate.

(2) The term of office of the members shall be three years";

(H) Statute 7 and the heading thereto shall be omitted;

(I) for Statute 8 and the heading thereto, the following shall be substituted, namely:-

(XIX) to provide for research and advancement and dissemination of knowledge;

(XX) to institute professorships, readerships, lectureships and other teaching posts required by the University;

(XXI) to establish, equip and maintain the University Laboratories and Libraries;

(XXII) to control in general, all colleges in the University area in the manner prescribed by Statutes;

(XXIII) to confer degrees and other academic distinctions on persons who have pursued approved courses of study in a University college or an affiliated College or Oriental College, unless exempted therefrom in the manner prescribed by the regulations and shall have passed the prescribed examination of the University or shall have carried on research under conditions prescribed;

(XXIV) to confer honorary degrees or distinctions on approved persons to the manner prescribed;

(XXV) to institute allowances, travelling allowances, scholarships, exhibitions (bursaries, studentships, medals and prizes);

(XXVI) to provide for lectures and instruction to persons not being students of the University and to grant diplomas to them;

(XXVII) to establish and maintain hostels to prescribe the fees to be charged for the affiliation and recognition of College;

(XXVIII) to prepare the annual reports and annual accounts and the financial estimates of the University for submission to the Academic senate;

(XXIX) to enter into any agreement with the Government or with the private managements for assuming the management of any institution and taking over its properties and liabilities or for any other purpose not repugnant to the provisions of the Act;

(XXX) the Executive Council shall exercise all the powers of the University not otherwise provided for and all powers requisite to give effect to the provisions of the Act.";

(K) in Statute 10 and the heading thereto, for the words "Academic Council" wherever they occur the words "Academic Senate" shall be substituted;

(L) for Statute 11 and the heading thereto, the following shall be substituted, namely:-

"Powers of the Academic Senate

11. Power of the Academic Senate.- (1) The Academic Senate shall have the authority to provide instructions and training in such branches of learning as it thinks fit. It shall exercise general supervision over the Academic Policies of the University and provide leadership for raising the standard and quality of education and research.

(2) In particular the Academic Senate shall have powers:-

(a) to consider the Annual Report and Budget Estimates prepared by the Executive Council;

(b) to advise the Executive Council on all academic matters, including the control and management of the libraries;

(c) to constitute the several Faculties as may be prescribed;

(d) to formulate, modify or revise schemes for the constitution or reconstitution of departments of teaching;

(e) to make recommendations to the Executive Council for the institution of Professorships, Readerships, Lecturerships and other teaching posts and in regard to the duties and emoluments thereof;

(f) to make recommendations to the Executive Council for the recognition of teachers qualified to give instructions in Affiliated and Oriental colleges;

(g) to make recommendations to the Executive Council for the selection of a College in the University area on a reference made thereof by the Executive Council for the conferment of autonomy on such college or for withdrawal of autonomy already conferred;

(h) to make regulations for the encouragement of co-operation and reciprocity among colleges with a view to promoting academic life;

(i) to make regulations regarding the admission of students to the University;

(j) to make regulations relating to courses, examinations and the conditions on which students shall be admitted to examinations for the degrees of the University;

(k) to decide the conditions under which exemptions relating to the admission of students to examinations may be given;

(l) to appoint standing committees and to delegate to them or the Vice-Chancellor powers to execute any of the functions assigned by this Act;

(m) to make regulations for the use of Telugu as medium of instruction and examination".;

(M) for statute 12 and the heading thereto, the following shall be substituted, namely:-

"Planning and Monitoring Board

12. Planing and Monitoring Board.- (1) There shall be a Planning and Monitoring Board consisting of:-

(1) The Vice-Chancellor (Chairman);

(2) Four Principals of University and Professional Colleges, Deans/Chairman of Faculties nominated by the Vice-Chancellor;

(3) Two outside educationists nominated by the Vice-Chancellor;

(4) Two nominees of the Andhra Pradesh Commissionerate of Higher Education.

The Board shall be the Principal Planning and reviewing body and it should also arrange for periodical monitoring of the developmental programmes and of teaching and research in the University".

(N) in Statute 13, in clause (1), the following words shall be added at the end, namely:-

"There shall be representation for students on the Boards of studies.";

(O) in Statute 14,

(a) for clauses (1) and (2) the following clauses shall be substituted, namely:-

"Finance Committee.-(1) There shall be constituted a Finance Committee, which shall be a sub-Committee of the Executive Council, with the following as members, namely:-

(a) Vice-Chancellor (Chairman);

(b) One member of the Executive Council from among the nominees of the Andhra Pradesh Commissionerate of Higher Education nominated by the Executive Council;

(c) one member of the Executive Council from among its other Members nominated by the Executive Council";

(b) in clause (5), for the word "Syndicate" the words "Executive Council" shall be substituted;

(P) in Statute 15,

(a) for the heading, the following shall be substituted namely:-

"Selection Committee"

(b) for clauses (1) and (2), the following clauses shall be substituted, namely:-

Constitution of Selection Committee.- There shall be constituted a selection Committee in regard to the appointment of Professors, and Readers which shall consist of the following, namely:

(1) The Vice-Chancellor;

(2) Nominee of the Chairman of the Andhra Pradesh Commissionerate of Higher Education;

(3) Three experts from outside the University to be nominated by the Vice-Chancellor of whom at least two shall be present in the Selection Commit.

(4) Chairman/Dean, of the Faculty concerted.

Provided that no person shall participate in the meetings of the Selection Committee for any appointment if he or if his near relative is a candidate for that appointment;

Provided further that no teacher holding a post lower in rank than the one to which the appointment is to be made shall be a member of the Selection Committee";

(c) clause (6) shall be omitted.

(d) in clause (7)(ii), for the word "Chairman" wherever it occurs the words "Chairman/Dean" shall be substituted.

(Q) in Statutes 16, 17, 21, 22, 24, 25, 26, 32 and 33 for the words "Syndicate" and "Academic Council", the words "Executive Council" and "Academic Senate" shall respectively be substituted;

(R) in Statute 29, for the words "Senate the Syndicate, the Academic Council," the words "Executive Council and the Academic Senate" shall be substituted.

Section 7. Amendment of Act, 36 of 1981

7. Amendment of Act, 36 of 1981.- In Sri Krishnadevaraya University Act, 1981,

(1) in the preamble for the words "The University" the ???

(2) in Section 2,-

(a) in clause (1), for the word "Syndicate", the words "Executive Council" shah be substituted.

(b) after clause (1), the following clauses shall be inserted, namely:

"(1-a) "affiliated College" means a College located within the University area affiliated to the University in accordance with the conditions prescribed;

(2) "autonomous College" means a College on which the status of autonomy has been conferred by the University":

(3) "College" means a College established and maintained by, associated with or affiliated to or recognised by the University:

(c) in clause (9), for the word "maintained" the words "maintained or recognised" shall be substituted;

(d) in clause (10), for the word "maintained" the words "maintained or recognised" shall be substituted;

(e) after clause (10), the following clauses shall be inserted, namely:

"(10-a) "Oriental College" means a college recognised by or affiliated to the University in accordance with the conditions prescribed for qualifying students for degrees, titles, or diplomas of the University in oriental learning;

(10-b) ‘post-graduate centre’ means a University College in which provision is made for postgraduate courses of study and which is declared as such in accordance with the regulations prescribed."

(f) after clause 12, the following clauses shall be inserted, namely:

"(12-a) ‘professional college’ means a college established or maintained by the University or affiliated to the University for providing courses of study leading upto the professional degrees of the University in accordance with the Regulations prescribed;

(13) ‘recognised college’ or ‘recognised institution’ means respectively a college or an institution of higher learning recognised by the University;

(14) ‘Recognised teacher’ means a person working in any recognised institution or in any institution associated with the University and recognised by the University for the purpose of imparting instruction or conducting research or both and designated as recognised teacher by the Ordinances";

(g) in clause (19), for the words "comprised within a radius of thirty kilometres from the headquarters of the University" the words "districts of Anantapur and Kurnool" shall be substituted.

(h) in clause (21), the words "or college" shall be omitted;

(i) after clause (21), the following clause shall be inserted, namely:

"(22) ‘University Professor’ means a person appointed as such by the University";

(3) in section 3,

(a) for sub-section (1), the following sub-section shall be substituted, namely:-

"(1) There shall be constituted in and for the area comprising the districts of Anantapur and Kurnool a University by the name of Sri Krishnadevaraya University, which shall consist of a Chancellor, a Vice-Chancellor, a Rector, if any an Executive Council and an Academic Senate.";

(b) to sub-section (3), the following words shall be added at the end, namely:-

"It shall also have power to affiliate the Colleges in the University area.";

(4)(a) section 5 shall be renumbered as sub-section (1) thereof and in the sub-section as so renumbered,

(i) after clause (vi), the following clause shall be inserted, namely:-

"(vii) to recognise an institution of higher learning for such purposes as the University may determine and to withdraw such recognition";

(ii) in clause (viii) after the words "persons working" the words "in any recognised institution or" shall be inserted;

(b) after clause (xi), the following clause shall be inserted, namely:-

"(xia) to establish, maintain and manage or to affiliate colleges, autonomous colleges and postgraduate centres in any part of the University area outside the University campus";

(c) for clause (xv), the following clause shall be substituted, namely:-

"(xv) to institute take over and maintain colleges and hostels, to affiliate or recognise colleges or hostels not maintained by the University and to withdraw such affiliation or recognition;";

(d) for clause (xvi), the following clause shall be substituted namely:-

"(xvi) to declare a college, an institution or a department as an autonomous college or institution or department as the case may be;"

(e) after sub-section (1) as so renumbered, the following sub-sections shall be inserted, namely:-

"(2) No college or institution associated with or recognised or maintained by any other University in the University area of this University shall be associated with or recognised by Sri Krishna Devaraya University for any purpose except with the prior approval of the Government and the concerned University and the management of the College or institution concerned.

(3) Nothing contained in sub-section (1) shall be deemed to prevent the Andhra Pradesh Commissionerate of Higher Education from issuing such order as it may deem fit in regard to the levy of fees and the charges for admission of students to colleges.";

(5) in section 7

(a) for sub-section (1) the following sub-section shall be substituted, namely:-

"(1) The Government shall have the right to cause an inspection to be made by the Andhra Pradesh Commissionerate of Higher Education, of the University, its buildings, laboratories, libraries, museums, workshops and equipment and of any institutions maintained by or affiliated to the University and also to cause an inquiry to be made, into the teaching and other work conducted or done by the University in respect of any matter connected with the University. The Government shall in every case give notice to the University of its intention to cause such inspection or inquiry to be made and the University shall be held to be represented thereat. The Commissionerate shall inform the Government of the results of the inspection and inquiry.";

(b) in sub-section (2), for the word "Syndicate" the words "Executive Council" shall be substituted;

(c) in sub-section (3), for the word "Syndicate" the words "Executive Council" shall be substituted;

(6) in section 8, after item (4), the following item shall be inserted, namely:-

"(4-a) The Directors";

(7) in section 9, in sub-section (2), the words "and President of the Senate and shall, when present, preside at the meetings of the Senate" shall be omitted.

(8) in section 10,-

(a) for sub-section (1), the following sub-section shall be substituted, namely:-

"(1) The Andhra Pradesh Commissionerate of Higher Education shall constitute a Search Committee consisting of

(i) a nominee of the Executive Council;

(ii) a nominee of the Andhra Pradesh Commissionerate of Higher Education: and

(iii) a nominee of the Government.

The Search Committee shall submit a panel of three persons to the Government from among whom the Government shall recommend one person to the Chancellor for appointment as Vice-Chancellor and the Chancellor shall appoint such person as Vice-Chancellor:

Provided that no person shall hold the office of Vice-Chancellor beyond the age of sixty-five years."

(b) to sub-section (2), the following proviso shall be added, namely:-

"Provided that he shall not give effect to any decision of any authority of the University if he is of the opinion that such a decision is not in the interests of the University."

(c) in sub-section (3), in the second proviso, for the word "Syndicate" in the two places where it occurs, the words "Executive Council" shall be substituted.

(9) for section 11, the following section shall be substituted, namely:-

11. "The Rector.- The Rector shall be appointed by the Executive Council on the recommendation of the Vice-Chancellor in such manner and shall exercise such powers and perform such duties as may be prescribed by the Statutes.";

(10) in section 12, for sub-section (1), the following sub-section shall be substituted, namely:-

12. "The Registrar.- The Registrar shall be a whole-time paid officer of University appointed by the Executive Council for a term of three years or less and on such other terms as may be prescribed by the Statutes, provided that he shall not continue in that office for more than six years. The Executive Council may transfer the Registrar to a suitable position even before the completion of the term provided he is shown a position in the University with the same emoluments.";

(11) for section 13, the following section shall be substituted, namely:-

13. "Finance Officer- (1) The Finance Officer shall be a whole-time paid officer of the University appointed by the Executive Council for a period, of three years or less and on such terms and conditions as may be prescribed, provided that he shall not continue in that office for more than six years.

(2) The Executive Council may transfer the Finance ??? to a suitable position even before the ??? of the term, provided he is shown a ??? in the University with the same emoluments."

(12) for section 14, the following section shall be substituted, namely:-

14. "Deans of Faculties and others Officer.- There shall be a Dean/Chairman for each faculty who shall be appointed by the Executive Council from among the members of the faculty on the recommendation of the Vice-Chancellor. The powers and duties of the Deans/Chairman of Faculties and the manner of appointments and the powers and duties of other officers shall be prescribed by the Statutes.";

(13) in section 15, for items (1), (2) and (3), the following items shall be substituted, namely:-

"(1) The Executive Council;

(2) The Academic Senate,";

(14) Section 16 shall be omitted;

(15) in section 17, for the word "Syndicate" wherever it occurs, the words "Executive Council" shall be substituted;

(16) in section 18 for the words "Academic Council", wherever they occur, the words" "Academic Senate" shall be substituted;

(17) in section 20, to sub-section (2), the words "Save as otherwise provided in section 14" shall be added in the beginning;

(18) in section 21, for the words "Planning Board" wherever they occur, the words "Planning and Monitoring Board" shall be substituted;

(19) in section 22, for the words "Senate, Syndicate and Academic Council wherever they occur the words "Executive Council and Academic Senate" shall be substituted;

(20) after section 22-A, the following section shall be inserted, namely:-

22-B. "Special provision as to the reconistitution of the Council academic ??? and the Finance Committee.- Notwithstanding anything in this Act,-

(a) the members of the Senate the Syrtdicate, the Academic Council and the Finance Committee constituted and functioning before the commencement of Section 7 of the Andhra Pradesh University Acts (Amendment) Act, 1987 (hereinafter referred to as the said Act) shall continue to be such members and function only until a new Executive Council, Academic Senate and the Finance Committee is reconstituted in accordance 1 with the provisions of this, Act as amended by the said Act; and

(b) on the reconstitution of such new Executive Council, Academic Senate and the Finance Committee in accordance with the provisions of this Act, as amended by the said Act the members of the Senate, the Syndicate, the Academic Council and the Finance Committee holding office immediately before such reconstitution shall cease to be such members;"

(21) in section 23, in clause (ii), for the word "Government" the words "Andhra Pradesh Commissionerate of Higher Education" shall be substituted:

(22) in section 24, for the word "Syndicate" the Words "Executive Council" shall be substituted;

(23) in section 25, the proviso shall be omitted,

(24) in section 26,-

(a) for the word "Government" wherever it occurs, the words "Adhra Pradesh Commissionerate of Higher Education" shall be substituted;

A copy of the Report with a copy, of the resolution thereon if any of the Academic Senate shall be submitted to the Government for information."

(29) for section 32, the following section shall be substituted, namely:-

32. "Annual Accounts.- The Executive Council shall prepare during each financial year the annual accounts of the University of the preceding financial year and submit them to such audit as the Government may direct before the end of the financial year. The accounts so audited shall be published in the Andhra Pradesh Gazette and copies thereof together with copies of the audit report shall be sent to the Academic Senate not later than two years from the end of the financial year to which the accounts pertain and to the Government."

(30) after section 32, the following section shall be inserted, namely:

32-A. "Financial estimates.- The Executive Council shall prepare before such date as may be prescribed by the Statutes, the financial estimates for the lensing financial year along with the annual accounts, whether audited or not, of the preceding financial year, and send the same to the Academic Senate. These estimates shall be considered by the Academic Senate at its annual meeting and resolutions of the Academic Senate thereon shall be submitted to the Government for information."

(31) in section 33, in sub-section (2), for the word "Syndicate" occurring in the two places, the words "Executive Council" shall be substituted;

(32) in section 34, for the word "Syndicate" occurring in the two places, the words "Executive Council" shall be substituted;

(33) in section 35, for the word "Syndicate" in the two places where it occurs, the words "Executive Council" shall be substituted;

6. Academic Senate.- The Academic Senate shall consist of the following persons, namely:-

3. The Secretary, Andhra Pradesh Commissionerate of Higher Education;

4. The Secretary to Government, Education;

5. The Director, N.C.C.;

6. All Deans/Chairman of Faculties/Director of Schools and Administrative Deans;

7. Fifteen or 1/3 of Heads of the Departments of the University whichever is less nominated by the Chancellor on the recommendation of the Andhra Pradesh Commissionerate of Higher Education

8. Fifteen or 1/3 of the Professors of the University whichever is less nominated by the Chancellor on the recommendation of the Andhra Pradesh Commissionerate of Higher Education;

9. Fifteen or 1/3 of the Chairman, Boards of Studies whichever is less nominated by the Chancellor on the recommendation of the Andhra Pradesh Commissionerate of Higher Education.

10. ten teachers of the University, constituent and affiliated colleges nominated by rotation, by the Chancellor on the recommendation of the Government;

11. Fifteen principals of the affiliated Colleges nominated by the Chancellor on the recommendation of the Government;

12. two heads of Research Laboratories and Institutions in the University area recognised by the University, nominated by the Chancellor on the recommendation of the Government;

13. six students for a term of one year two each from (a) under-graduate (professional and Nan Professional) (b) Post-Graduate and (c) Research-Scholars nominated by the Chancellor from among the names recommended by the Government on the basis of merit as prescribed;

14. Seven from the alumni of the University representing one Scheduled Caste/one Scheduled Tribe, one Backward Class, one Woman, one Professor from such areas as engineering, medicine and law, one Management of the College, one representing Commerce and Industry nominated by the Chancellor on the recommendation of the Government;

15. Five Members of the Legislative Assembly, nominated by the Government; and

16. Such members of the Executive Council who are not otherwise members of the Academic Senate."

(H) in Statute 7,-

(a) for the heading thereto, and clause (1), the following shall be substituted, namely:-

"Term of office of the members of the Executive Council etc.:

(1) Save as otherwise provided, the Executive Council, the Finance Committee and the Academic Senate shall be reconstituted at or about the same time; every three years and the members of these authorities shall except in the case of ex-Officio members hold office as members thereof upto the date of next re-constitution:

Provided that no person other than ex-officio member, professor, Heads of Departments other than professors, Dean/Chairman of Faculties and principals shall be a member of the Executive Council or Academic Senate for more than two terms consecutively.

No member of an authority specified in clause (1) who is an pointed or nominated in his capacity as a member of a particular office or appointment shall continue to be a member of such authority on his ceasing to be the holder of the particular office or appointment."

(b) in clauses (3) and (4), the words "elected" and "election" shall be omitted;

(I) Statute 8 shall be omitted;

(J) for stance 9, and the heading thereto, the following shall be substituted namely:-

"Quorum for the Meeting of the Executive Council

9. The quorum for a meeting of the Executive Council shall be one-third of the total number of members or four persons whichever is higher.";

(K) in Statute 10 and the heading thereto:-

(a) for the words "Syndicate" and "Academic Council" wherever they occur, the words, "Executive Council" and "Academic Senate" shall respectively be substituted;

(b) in clause (2),-

(A) in item (ii), the word "lecturer" shall be omitted and to the item as so amended, the following proviso shall be added, namely:-

"Provided that if the ??? Council rejects the selections made by the ??? committee, the matter shall be referred by the ??? to the Government whose decision thereon shall be final.";

(B) item (xviii) shall be omitted and after item (xvii), the following items shall be added, namely:-

"(xviii) to institute and maintain University Colleges;

(xix) to provide for research and advancement and dissemination of knowledge;

(xx) to institute professorships, readerships, lecturerships and other teaching posts required by the University;

(xxi) to establish equip and maintain the University laboratories and Libraries;

(xxii) to control, in general, all colleges in the University area in the manner prescribed by Statues;

(xxiii) to confer degrees and other academic distinctions on persons who have pursued approved courses of study in a University college or an affiliated college or oriental college, unless exempted therefrom in the manner prescribed by the regulations and shall have passed the prescribed examination of the University or shall have carried on research under conditions prescribed;

(xxiv) to confer honorary degrees or distinctions on approved persons in the manner prescribed;

(xxv) to institute allowances, travelling allowances, scholarships, exhibitions (bursaries, studentships, medals and prizes);

(xxvi) to provide for lectures and instructions to persons not being students of the University and to grant diplomas to them;

(xxvii) to establish and maintain hostels to prescribe the fees to be charged for the affiliation and recognition of colleges;

(xxviii) to prepare the annual reports and annual accounts and the financial estimates of the University for submission to the Academic Senate;

(xxix) to enter into any agreement with the Government or with, the private management for assuming the management of any institution and taking over its properties and liabilities or for any other purpose not repugnant to the provisions of the Act;

(xx) the Executive Council shall exercise ??? or the University not otherwise provided for and all powers requisite to give effect to the provisions of the Act."

(L) in Statute 11 and the heading thereto, for the words "Academic Council" wherever they occur the words "Academic Senate" shall be substituted;

(M) for Statute 12 and the heading thereto, the following shall be substituted, namely:-

"Powers of the Academic Senate

12. (1) The Academic Senate shall have the authority to provide instruction and training in such branches of learning as it thinks fit. It shall exercise general supervision over the Academic policies of the University and provide leadership for raising the standard and quality of education and reasearch.

(2) In particular the Academic Senate shall have powers,-

(a) to consider the Annual Report and Budget Estimates prepared by the Executive Council;

(b) to advise the Executive Council on all academic matters, including the control and management of the libraries;

(c) to constitute the several Faculties as may be prescribed;

(d) to formulate, modify or revise, schemes for the constitution or reconstitution of departments of teaching;

(e) to make recommendations to the Executive Council for the institution of Professorships, Readerships, Lecturerships and other teaching posts and in regard to the duties and emoluments thereof;

(f) to make recommendations to the Executive Council for the recognition of teachers qualified to give instruction in Affiliated and Oriental colleges;

(g) to make recommendation to the Executive Council for the selection of a college in the University area on a reference made thereof by the Executive Council for the conferment of autonomy on such college or for withdrawal of autonomy already conferred;

(h) to make regulations for the encouragement of co-operation and ??? among colleges with a view to promoting academic life;

(i) to make regulations regarding the admission of students to the University;

(j) to make regulations relating to courses, examinations and the conditions on which students shall be admitted to examinations for the degrees of the University;

(k) to decide the conditions under which exemptions relating to the admission of students to examinations may be given;

(l) to appoint standing committees and to delegate to them or the Vice-Chancellor, powers to execute any of the functions assigned by this Act;

(m) to make regulations for the use of Telugu as medium of instruction and examination";

(n) for statute 13 and the heading thereto he Mowing shall be substituted, namely:-

"Planning and Monitoring Board.

13(1) There shall be a Planning and Monitoring Board consisting of-

The Vice-Chancellor (Chairman); Four Principals of University; and Professional Colleges, Deans/Chairman of Facuities nominated by the Vice-Chancellor;

Two outside educationists nominated by the Vice-Chancellor;

Two nominees of the Andhra Pradesh Commissionerate of Higher Education;

The Board shall be the Principal Planning and reviewing body and it should also arrange for periodical monitoring of the developmental programmes and of teaching and research in the University.";

(o) in Statute 14,-

(i) to clause (1), the following words shall be added at the end, namely;-

"There shall be representation for students on the Boards of Studies.";

(ii) in clause (2), for the words "Academic Council" the words "Academic Senate" shall be substituted;

(P) for statute 15

(a) for clauses (1) and (2), the following shall be substituted, namely:-

"(1) There shall be constituted a Finance Committee which shall be a Sub-Committee of the Executive Council with the following members, namely:-

(a) Vice-Chancellor (Chairman);

(b) One member of the Executive Council from among the nominees of the Andhra Pradesh Commissionerate of Higher Education nominated by the Executive Council; and

(c) one Member of the Executive Council from among its other members nominated by the Executive Council.";

(b) in clause (5), for the words "Syndicate" the words "Executive Council" shall be substituted;

(q) in Statute 16,-

(a) for the heading, the following shall be substituted, namely:-

"Selection Committee"

(b) for clauses (1) and (2), the following clauses shall be substituted, namely:-

"(1) There shall be constituted a Selection Committee in regard to the appointments of Professors and Readers which shall consist of the following, namely:-

(1) The Vice-Chancellor;

(2) Nominee of the Chairman of the Andhra Pradesh Commissionerate of Higher Education;

(3) Three experts from outside the University to be nominated by the Vice-Chancellor of whom atleast two shall be present in the Selection Committee;

(4) Chairman/Dean of the Faculty concerned;

Provided that no person shall participate in the meetings of the Selection Committee for any appointment if he/if his near relative is a candidate for that appointment:

Provided further that no teacher holding a post lower in rank than the one to which the appointment is to be made shall be a member of the Selection Committee.";

(c) clause (6) shall be omitted.

(d) in clause 7(ii), for the word "Chairman" the words "Chairman/Dean" shall be substituted;

(R) in Statutes, 17, 22, 23, 26, 27, 33 and 34, for the words "Syndicate" and "Academic Council" wherever they occur the words "Executive Council and "Academic Seriate" shall respectively be substituted.

In Statute 30, for the words "Senate, the Syndicate, the Academic Council", the words "Executive Council and Academic Senate" shall be substituted.
