(Syllabus.)
1. Appeal and Error — Reversal for Insufficiency of Evidence With Directions. Where an appeal is taken to this court, and the case is reversed for the reason of the insufficiency of the evidence, it is the better practice to give directions to the lower court to grant a retrial if in the opinion of the county attorney he has sufficient evidence other than was offered at the first trial to sustain a conviction, otherwise, the defendant to be discharged.
2. Same — Reversal With Direction to Discharge Defendant. If the reversal of the case is upon grounds that defendant may not again be tried as a matter of law, directions should be given to discharge the defendant.
3. Same — Sufficiency of Evidence to Sustain Conviction on Second Trial. When a case is reversed and retried and the evidence on the second trial is sufficient to sustain the judgment and sentence, the case will not be reversed.
4. Same — Penitentiary Sentence of 15 Years for First-Degree Manslaughter Reduced to Four Years.
