Mazzarelli v. Mazzarelli, Court of Appeals of the State of New York (Decided May 2, 1978)

Factual and Procedural Background

The appeal was taken by Florence Mazzarelli (appellant) from an order of the Appellate Division of the Supreme Court in the Second Judicial Department. The Appellate Division had determined, with respect to property and assets held jointly, that respondent Nicholas Mazzarelli successfully rebutted the presumption of a gift arising from taking title jointly in the names of both spouses. The Court of Appeals reviewed that determination on appeal and issued a memorandum affirming the order, with costs. Counsel of record: Barry M. Fallick and David A. Goldstein for appellant; Bernard Dworkin for respondent.

Legal Issues Presented

  1. Whether the respondent husband successfully rebutted the presumption of a gift that arises when title to property is taken jointly in the names of both spouses.

Arguments of the Parties

The opinion does not contain a detailed account of the parties' legal arguments.

Table of Precedents Cited

Precedent Rule or Principle Cited For Application by the Court
Kover v Kover, 29 N.Y.2d 408, 419 The presumption of a gift which arises from the act of taking title jointly in the name of both spouses. The Court relied on the Appellate Division's finding, grounded in this principle, that the respondent rebutted the presumption as supported by the record; the Court affirmed that determination.

Court's Reasoning and Analysis

The Court reviewed the Appellate Division's determination under the standard of examining the record as a whole and considering the realities of the situation. It concluded that the Appellate Division's finding—that the husband rebutted the presumption of a gift arising from joint title—was supported by the weight of the evidence. Based on that support in the record, the Court sustained the Appellate Division's conclusion.

Holding and Implications

Order affirmed, with costs.

Implications: The Appellate Division's ruling that the respondent rebutted the joint-title presumption stands; the Court of Appeals affirmed that result. The opinion does not announce broader new legal principles beyond affirming the application of the cited presumption and its rebuttal on the record in this case.

FLORENCE MAZZARELLI, Appellant, v. NICHOLAS MAZZARELLI, Respondent.

MEMORANDUM.

The order appealed from should be affirmed, with costs. The Appellate Division has found, with regard to the property and assets held jointly, that respondent husband successfully rebutted the presumption of a gift which arises from the act of taking title jointly in the name of both spouses (see Kover v Kover, 29 N.Y.2d 408, 419). Reviewing this determination, as we must, in light of the realities of the situation as expressed by the record viewed as a whole, we find that the conclusion of the Appellate Division is indeed supported by the weight of the evidence, and should be sustained.
