Summary Disposition February 3, 1997:
10/December 1996 The cause having been briefed and orally argued, the order of May 22, 1996, 451 Mich. 899, granting leave to appeal is vacated, and in lieu of granting leave to appeal, the judgment of the Court of Appeals is reversed with respect to its conclusions that the defendant was not entitled to share in the settlement proceeds and, even if he were, that the trial court erred in the manner in which the proceeds were distributed. MCR 7.302(F)(1), Plaintiff admitted in pleadings in court that the defendant was the son of the deceased. Plaintiff is bound by that admission. Therefore, the trial court's distribution award to the defendant is reinstated. Reported below: 209 Mich. App. 66.
