(Syllabus.)
1. Trial — Motion to Suppress Evidence — Question of Fact for Trial Court Whether Justice of the Peace Issuing Search Warrant Acted Within His District. Where a search warrant did not show on its face the justice of the peace district from which it was issued, on accused's motion to suppress evidence, whether the justice of the peace issuing the warrant acted within his jurisdiction was a question of fact for the trial court.
2. Evidence — Justice of the Peace Presumed to Have Acted Within His District. The presumption is that official acts of a justice of the peace were performed within his jurisdiction.
3. Appeal and Error — Alleged Error not Fundamental Must Be Preserved in Motion for New Trial. Only those assignments of error preserved in a motion for new trial will be considered on appeal to this court unless the error is of a fundamental character.
4. Intoxicating Liquors — Affidavit for Search Warrant Held Sufficient. Affidavit for search warrant examined, and found sufficient to cause the justice of the peace to have probable cause to issue search warrant.
