This Court having considered Trustee's Application to Production of Documents and Oral Examination Pursuant to Federal Rule of Bankruptcy Procedure 2004 and good cause having been established,
IT IS HEREBY ORDERED that ROBIN McNABB shall produce the documents detailed in Exhibits "A" and "B" attached hereto, to Trustee's attorneys, Lane Nach, P.C., 2025 North Third Street, Suite 157, Arizona 85004, on or before close of business on July 13, 2005 and shall appear for an oral examination on July 20, 2005 at 10:00 a.m., which examination shall be electronically recorded.
IT IS FURTHER ORDERED, that David A. Birdsell, Trustee shall promptly serve this Order on Debtor and his attorneys and file a certificate of service therefor.
EXHIBIT "A"
1. Copies of all pre-nuptial, post-nuptial, property settlement agreements or other similar agreements entered into between you and any spouse which you currently have or ever had.
2. Copies of all judgments and/or decrees of dissolution of marriage concerning any marriage of yours which was dissolved.
3. Copies of any and all financial statements prepared by you or on your behalf, from and after for the two year period prior to the commencement of this case, including but not necessarily limited to those prepared for submission to lending institutions.
4. All titles, bills of sale or contracts of sale upon personal property for automobiles, boats, motorcycles, ATC's or aircraft belonging to you or in which you have had any interest whatsoever either alone or jointly with any other person or persons as of the commencement of the bankruptcy case.
5. Copies of the following pertaining to interests in real property in which you have or ever had a legal or beneficial interest at any time, from and after the two year period prior to the commencement of this case. This request includes all real property owned inside AND outside of the state of Arizona, including but not limited to: (a) 2021 The Alameda, Suites 225 and 230, San Jose, CA; (b) 772 Myrtle Street, San Jose, CA; (c) 3380 Montebello Court, Hollister, CA; and (d) 9517 East Meseto Ave, Mesa, AZ:
(i) Deeds;
(ii) Contracts for the purchase or sale of real property;
(iii) Escrow instructions; and,
(iv) Agreements for sale.
6. Copies of the original policy itself, or the following information for all life insurance policies owned by you or under which you have a beneficial interest:
(a) Name of insurance company;
(b) Face amount of policy;
(c) Cash surrender value;
(d) Premiums;
(e) Beneficiaries; and,
(f) Outstanding loans and balances.
7. Copies of any and all trusts, pension, profit sharing, retirement or deferred compensation plans in which you have been, or currently are a participant or beneficiary. In this connection, if such are furnished to you, produce documents showing what assets are held by any such trust or plan together with all periodic statements or accountings submitted to you from any trustee or plan manager of such trust or plan from the date such trust or plan was created up to and including the present.
8. Copies of all canceled checks, monthly bank reconciliation statements and check registers on any and all investment, savings and checking accounts in your name alone or in connection with anyone else, including business accounts, for the one year period prior to the commencement of this case.
9. A detailed accounting of all items sold at auction prior to the petition date.
10. A detailed explanation of how all proceeds from the pre-petition auction were applied. Include copies of all checks, invoices, receipts, bank statements and other supporting documentation.
11. Copies of all investment and stock accounts in which you have been, or currently are a participant or beneficiary.
12. All records of securities owned by you as of the petition date.

PLEASE PROVIDE THE FOLLOWING DOCUMENTS FOR EACH OF THE FOLLOWING ENTITIES:

1. Copies of all corporate income tax returns (federal and state) for the years 2002, 2003 and 2004.
2. Copies of all corporate minutes, articles of incorporation, by-laws and stock transfer records.
3. Copies of all limited partnership or general partnership agreements, and all amendments thereto, in which the corporation has, or ever had, a legal or equitable interest.
4. Copies of all certificates of limited partnership in which the corporation has, or ever had, a legal or equitable interest.
5. Copies of any and all financial statements prepared by the corporation or on its behalf, including but not necessarily limited to those prepared for submission to lending institutions from the date of incorporation to date.
6. All titles, bills of sale or contracts of sale upon personal property for automobiles, boats, motorcycles, ATC's or aircraft belonging to the corporation or in which it has or ever had any interest whatsoever.
7. Copies of the following pertaining to interests in real property in which the corporation had a legal or beneficial interest at any time from the date of incorporation to the present:
(a) Deeds;
(b) Contracts for the purchase or sale of real property;
(c) Escrow instructions; and,
(d) Agreements for sale.
8. All records of securities owned by the corporation from the date of its incorporation to the present.
9. Copies of any and all pension, profit sharing, retirement or deferred compensation plans. In this connection, produce documents showing what assets are held by any such plan together with all periodic statements or accountings submitted to the corporation from any trustee or plan manager of such plan from the date such plan was created up to and including the present.
10. All leases to which the corporation is a party or in which it has, or ever had, a legal or beneficial interest.
11. All contracts to which the corporation is a party or in which the corporation has or ever had a legal or beneficial interest.
12. All promissory notes in which the corporation is or was a maker, holder or payee.
13. All deeds of trust in which the corporation is or ever was a trustor or beneficiary.
14. All realty mortgages in which the corporation is, or ever was, the mortgagor or mortgagee.
15. Copies of all canceled checks, monthly bank statements, check registers pertaining to all bank or other deposit accounts in the name of the corporation or in which the corporation now has or has ever had a legal or beneficial interest, for the one year period prior to the petition date, to the present. This request is for all such accounts currently existing or which ever existed.
16. Copies of all certificates of deposit or other instruments of any kind whatsoever in which the corporation currently has or ever had a legal or beneficial interest.
17. Any and all appraisals covering real or personal property owned by the corporation or in which it has or ever had an interest.
18. All insurance policies and schedules owned by the corporation at the present time.
19. Copies of all business books and records for the two year period prior to the commencement of this case, to the present, including, but not limited to, the following:
(a) The cash receipts journal;
(b) The cash disbursement journal;
(c) The general ledger;
(d) The payroll journal;
(e) The payroll tax returns;
(f) Schedule of accounts payable; and,
(g) Schedule of accounts receivable.
