MBNA AMERICA BANK, N.A. v. JERRY SKOCZYLAS. MEMORANDUM OF DECISION PICKARD, JUDGE. This is an application to confirm an arbitration award in favor of the plaintiff, MBNA America Bank, N.A. It arises out of the use of an MBNA credit card by the defendant, Jerry Skoczylas. The matter was heard at short calendar. The submission to the arbitrator was unqualified and unrestricted. The defendant submitted evidence to the arbitrator which he feels proves that the debt was paid in full. The arbitrator considered the evidence from both parties and issued an award in favor of the plaintiff in the amount of $7,104.44. The award conforms to the submission. At the short calendar argument the defendant again raised the issue of payment and submitted the same evidence which he had provided to the arbitrator. The defendant did not make a timely motion to vacate the award in accordance with C.G.S. § 52-420(b). In that circumstance, the court has no choice but to confirm the award. C.G.S. § 52-417; Amalgamated Transit Union Local 1588 v. Laidlaw Transit, Inc., 33 Conn.App. 1, 4-5 (1993). Therefore, the award is confirmed. C.G.S. Section 52-420(b) provides that: "No motion to vacate, modify or correct an award may be made after thirty days from the notice of the award to the party to the arbitration who makes the motion." BY THE COURT, John W. Pickard
