ARTHUR WEISSBRODT, Bankruptcy Judge
This matter came for hearing on the above date and time before the Court (the "Hearing") pursuant to the Sixth Motion by Reorganized Debtors For Order Authorizing Release of Funds From Sale Price Account (the "Motion") filed by Metricom, Inc., and its domestic subsidiaries, Metricom Finance, Inc., Metricom Investments DC, Inc., Metricom DC, LLC, and Metricom New York, LLC (collectively, the "Reorganized Debtors"), requesting an Order authorizing the release of $295,436.77 from that certain interest bearing account (the "Sale Price Account"). The Sale Price Account was established pursuant paragraph 11 of this Court's Order Authorizing Sale of Debtors' Assets Free and Clear of Liens, Claims, Rights and Interests, dated November 2, 2001 (the "Sale Order"). Jurisdiction over this matter exists pursuant to 28 U.S.C. §§ 157 and 1334. Venue is proper pursuant to 28 U.S.C. §§ 1408 and 1409. This is a core proceeding pursuant to 28 U.S.C. § 157(b)(2). Unless otherwise noted, capitalized terms used herein have the meanings ascribed in the Motion.
Based on the Motion and the accompanying Declaration of Andrew Hinkelman in support of the Motion, the argument of counsel, and the record of the Hearing, the Court finds that notice of the Motion was provided in a reasonable time and manner, constituted proper notice under the circumstances, and provided an opportunity for hearing to parties in interest. The Reorganized Debtors also provided at least ten (10) days notice of the Motion to the foregoing parties in accordance with paragraph 11 of the Sale Order. Good cause appearing therefore;
IT IS HEREBY ORDERED:
1. The Motion is GRANTED.
2. The Reorganized Debtors are authorized to release $295,436.77 from the Sale Price Account for distribution in accordance with the terms of the Debtors' First Amended Joint Plan of Reorganization (July 8, 2001) (As Modified August, 21, 2002).
3. This Order is without prejudice to the Reorganized Debtors' rights to object on any available grounds to all claims, including, but not limited to, any Taxing Authority Claims or Taxing Authority Notices either filed or scheduled in these chapter 11 cases.
