1. Heard learned counsel for the petitioner and learned
Standing Counsel for the State respondents.
2. This writ petition has been filed for the following reliefs:-
"(i). Issue a writ, order or direction the nature of mandamus directing the
Respondent Bank not to confirm the Auction sale schedule for today
i.e.20.09.2024 till the disposal of the interim relief application filed by
Petitioners ;
(ii). Issue a writ, order or direction in the nature of Mandamus directing
the Debt Recovery tribunal to decide the interim relief application filed by
the petitioners at the earliest."
3. The respondent no.4 in this case is Aditya Birla Housing
Finance Limited, which is a Private Company. The petitioner
has prayed for a direction to the respondents to not to
confirm the auction sale scheduled for 26.09.2024 and also
a writ in the nature of mandamus to the Debts Recovery
Tribunal to decide the interim relief application of the
petitioner.
4. This writ petition was disposed of with liberty to the
petitioner to approach this Court under Article
227/supervisory jurisdiction of the Constitution as he
wishes this Court to issue a direction to the Debts Recovery
Tribunal to decide his interim relief application.
