Heard learned counsel for the petitioners.
This writ petition has been filed seeking a direction to the District Judge,
Jhansi to decide the execution case no.16 of 2007, filed by the petitioner in
S.C.C. Case No.41 of 1997, expeditiously, preferably within a short and
stipulated period of one month.
Considering the facts and circumstances of this case, without expressing
any opinion on the merits of the case, the District Judge, Jhansi acting as
Judge Small Cause Court is directed to decide the aforesaid suit in the
light of the judgment of the Hon'ble Apex Court in the case of Hameed
Kunju vs. Nazim 2017 (8) SCC 611 in which it has been observed that
the object of the rent laws all over the State is to ensure speedy disposal of
eviction cases between the landlord and tenant and especially those cases
where the landlord seek eviction for his bona fide need, as expeditiously as
possible, preferably within four months in accordance with law, without
granting any unnecessary adjournments and giving short dates provided
there is no other legal impediment and the advocates are not refraining
from work.
With the aforesaid observations, present writ petition stands disposed of.
