The Court has been convened through video conferencing due to Covid-19 pandemic.
Present petition has been filed for issuance of a writ in the nature of mandamus directing the respondents to allot the permanent posting to the petitioner on the post of Primary teacher at Rohtak, as per her preference since the candidates lower in merits to the petitioner have been allotted districts of their preference.
After hearing learned counsel for the petitioner and going through the record, it transpires that the petitioner has submitted a representation which was recommended by the District Committee, Faridabad and forwarded by the Block Education Officer, Faridabad to the Director Elementary Education (DEEO), vide communication dated 17.01.2020 (Annexure P-5) but no further action has been taken thereon.

It shall be proper and appropriate if the matter is dealt with at departmental level, to avoid unnecessary litigation. Therefore, the writ petition is disposed of by directing the respondents to take a final decision on communication dated 17.01.2020 (Annexure P-5) by passing speaking order in accordance with law within a period of three months from today. The petitioner is given liberty to approach this Court again, if she is still aggrieved by the order passed by the competent authority.
