S.C Parija, J.:— Heard learned counsel for the parties.
2. This appeal has been filed challenging the order dated 08.10.2015, passed by the learned District Judge, Jagatsinghpur, in ARBP No. 21 of 2015, rejecting the application of the appellant filed under Section 34 of the Arbitration and Conciliation Act, 1996, holding that the decision of the learned Arbitrator on the issue regarding limitation is not an award or interim award.
3. On a perusal of the impugned order, it is seen that the appellant had filed an application under Section 34 of the Arbitration and Conciliation Act, 1996, challenging the order of the learned Arbitrator dated 23.7.2015, holding that the claim raised by the respondent-claimant is not time barred. Learned District Judge has come to hold that the order of the learned Arbitrator being not in the nature of an award or interim award, the same cannot be the subject matter of challenge under Section 34 of the Arbitration and Conciliation Act, 1996.
4. Relevant findings of the learned District Judge is extracted below:
In the instant case, the Hon'ble Arbitrator has decided the issue of limitation at the out-set and the same was decided against the present petitioner. As the order of the Hon'ble Arbitrator did not decide the claim or even any part of the claim or any issue of liability, it could not be held to be an interim award. Unless, a final order or any interim order is challenged U/s 34 of this Act, this Court has lack of jurisdiction to decide the same within the purview of section 34 of this Act. Moreover, the petitioner can raise the same in U/s 34 of the Act at final adjudication of petition against the final Arbitral award. It is well settled principle of law that issue of limitation is a mixed question of law and fact which can be taken up in final adjudication.
5. Considering the submissions made and keeping in view the findings of the learned District Judge given in the impugned order and the reasons assigned in support of the same, I do not find any infirmity so as to warrant any interference in this appeal.
6. ARBA is accordingly dismissed. Interim order dated 14.3.2016 stands vacated. Issue urgent certified copy as per rules.
