Sanjib Banerjee, J.:— It appears that the marriage between the parties has been annulled by a court in New Jersey. The order of the court records the annulment of the marriage to be by consent of the husband and wife.
The grievance of the petitioning husband is that notwithstanding the marriage having been annulled, the wife is pursuing proceedings instituted in the Alipore Court prior to the annulment of the marriage declared by the New Jersey court, despite the subsequent final pronouncement by the New Jersey court.
The wife raises several issues, including that the New Jersey court lacked the territorial jurisdiction to receive the matrimonial proceedings, inter alia, on the ground that at the relevant point of time the wife was a resident of Dallas, Texas and she was not governed by the rules applicable in the State of New Jersey.
The wife also claims that since the parties were married under the Special Marriage Act in India, the annulment of the marriage could only have been considered under such statute and not the statute of the place of domicile of either spouse or both.
Since it is evident from the order of the New Jersey court that the annulment of marriage was made pursuant to the consent of the parties, the principles of comity of courts require the order of the court to be accepted in preference to any contrary submission that may be made by a party to the proceedings who appears to have submitted to the jurisdiction and accorded her consent to the order passed by the court.
In such circumstances, the wife has to be restrained from pursuing the action in the Alipore Court for the time being to enable the wife to take appropriate steps before the relevant forum in New Jersey or elsewhere in the United States of America against the recording in the relevant order of the parties having obtained the order of annulment of marriage by consent.
CO 3307 of 2014 is disposed of by staying Matrimonial Suit No. 61 of 2014 pending before the 9 Additional District Judge at Alipore till December 31, 2015. If, within such time, the order dated July 16, 2013 passed by the New Jersey court is modified or altered to the benefit of the wife, the wife will be entitled to cite the same and revive Matrimonial Suit No. 61 of 2014. If, however, the wife cannot demonstrate that the relevant order has been altered or set aside or revised by the appropriate forum in the United States of America by the end of the year 2015, the husband will be entitled to cite this order to seek a dismissal or permanent stay of the matrimonial suit in the Alipore Court.
There will be no order as to costs.
Certified website copies of this order, if applied for, be made available to the parties upon compliance of the requisite formalities.
