G.C Mital, J.:— During the course of arguments, it occurred to us to pass an order for interim arrangement and to postpone the case for final disposal.
2. Out of six petitioners, petitioners Nos. 1, 2, 4 and 5 are present before us.
3. They have apologised for whatever has happended in this in cident.
4. Out of the remaining two petitioners, Jagdish Lal Sehgal has already retired on 31.3.1985, and the petitioners present before us undertake to place on record an undertaking on behalf of the other petitioner, namely, Dev Raj Sharma, for good conduct.
5. Since the main incident arose because of Jagdish Lal Sehgal, who stands retired, it would be in the fitness of things to put back the remaining five petitioners to duty to enable them to work properly and show their proper behaviour. We have been told that they would not repeat such an incident.
6. They are out of service since 17.11.1980 and are getting half of the salary which they were getting at that time.
7. We are of the considered view that the conduct of the petitioners should be seen for a year or so and the case should be taken up after six months to have the latest report from the District and Sessions Judge, Ferozepore. Accordingly, we adjourn the case as part heard to 16.7.1990 and the District and Sessions Judge, Ferozepore, will report about the conduct of the five petitioners by submitting a report in the month of June, 1990.
8. The learned District & Sessions Judge, Ferozepore, will allow the five petitioners to join their duties forthwith. The learned District & Sessions Judge, Ferozepore, will get the salary of each petitioner fixed on the basis as if they were throughout in service and whatever pay and emoluments would be payable to them on the date of their joining would be paid to them with effect from 1.12.1989 till an order to the contrary is passed by this Court.
9. The question of back wages shall be decided while passing final order. This order is only by way of interim arrangement.
10. It may be clarified that it is not an agreed order.
11. A copy of this order be given to both the sides without payment. A copy be also sent to the learned District & Sessions Judge, Ferozepore, for compliance.
12. Orders accordingly.
