Shri Inder Kohli v. Delhi Development Authority (Through Shri K.G Kashyap, Dy. Directro (Gh)) Public Authority.

Room No. 308, B-Wing, August Kranti Bhawan, Bhikaji Cama Place, New Delhi-110066 File No. CIC/WB/A/2008/01037/LS Appellant : Shri Inder Kohli Public Authority : Delhi Development Authority (through Shri K.G. Kashyap, Dy. Directro (GH)) Date of Hearing : 1.1.2009 Date of Decision : 1.1.2009 Facts The background of the matter in short is that the appellant had requested DDA for the conversion of his Flat No. B-II/2, Paradise Cooperative Group Housing Society, Plot No. 40, Delhi-110092 from lease-hold to free- hold. But it appears that DDA has not taken any decision in this matter so far. In this background vide his letter dated 14.3.2008, he had requested for information on 10 points regarding the status of his case and the officers responsible for delay therein etc.

    2. CPIO vide his letter dated 10.4.2008 had informed the appellant that his file has been sent to the Legal Department of DDA and on receipt of comments from him, suitable reply will be sent to him.

    3. Dissatisfied with this, the appellant had filed appeal before the Appellate Authority, who by her order dated 14.5.2008 had disposed of the appeal without addressing the core issue.

    4. Hence the present appeal.

    5. The matter was heard on 1.1.2009. The appellant appeared before the Commission. DDA is represented by officer mentioned above. Shri Kashyap would submit that the concerned file is presently pending in the O/o Honble Lt. Governor of Delhi since last four months for appropriate decision in the matter. Contra, the appellant would submit that he is not concerned with the internal decision making process of DDA and his primary concern is that an appropriate decision is taken by DDA. One cannot find fault with his submission.

    6. It appears to me that there has been undue delay in the decision making process in the matter in hand. In this view of the matter, Smt Asma Manjar, Commissioner (Land), DDA, is hereby directed to have the decision expedited in this case in next 6 weeks time and inform the appellant accordingly.

    7. The appellant, however, would be at liberty to move this Commission again if, he is not satisfied with the response received from CPIO/Commissioner (Land), DDA.

    8. The matter is disposed of subject to the above directions. Sd/- (M.L. Sharma) Central Information Commissioner Authenticated true copy, Additional copies of orders shall be supplied against application and payment of the charges, prescribed under the Act, to the CPIO of this Commission (K.L. Das) Assistant Registrar
