THE INDIRA GANDHI INSTITUTE OF MEDICAL SCIENCES (AMENDMENT) ACT, 2019
AN
ACT
To amend the Indira Gandhi Institute of Medical Sciences Act, 1984 (Bihar Act, 10, 1984) (as amended from time to time). Preamble- Whereas the object of the Indira Gandhi Institute of Medical Sciences established by the Indira Gandhi Institute of Medical Sciences Act, 1984, is to provide high level health and medical facilities and develop continuous education programs and research; and WHEREAS the Bihar Government is always committed to the progressive development of medical education, research and medical facilities; and
WHEREAS it is necessary and expedient to provide for the power to extend the tenure of the director of this institute in the inevitable situations;
Now, therefore in order to fulfill the above object, amendment in the Indira Gandhi Institute of Medical Sciences Act, 1984 (as amended from time to time) has become necessary. Be it enacted by the Legislature of the State of Bihar in the seventieth year of the Republic of India as follows:-
1. Short title and commencement.- (1) This Act may be called the Indira Gandhi Institute of Medical Science (Amendment) Act, 2019.
(2) It shall come into force at once.
2. Amendment in Section-12 of Bihar Act, 10, 1984.- The following new proviso shall be added at the end of subsection (1) of section-12 of the said Act, 1984 :-
"Provided that the term of the outgoing director, maximum one time only, may be extended, by the government for a period of three years or part thereof, but not beyond 65 years of age."
3. Saving.- Notwithstanding such amendment, anything done or any action taken previously under section-12 of the said Act, 1984 (as amended from time to time) shall not be affected.
