the dissolutwn

of

the

Senate

and the' Syndicate of ^the

Gandhiji

University. Preamble—WHEREAS ^itisconsidered necessary^{in the}

interest of the

Gandhiji

University

and ⁱⁿ

the

public

interest ^to

dissolve

the Senate and

the

Syndicate

of the

Gandhiji University

and to entrust the powers and functions

of the

Senate

and the

Syndicate temporarily ^{to the}Vice-Chancellor ^{of the}

Gandhiji Umversxty;

BE

it enacted

in

the

Thirty-ninth

Year of the

Republic

of

India as follows:-~—

1.

Short title

and

commencement—(1)

This Act may

be called the

Gandhiji University

(Dissolution'of

the

Senate

and the Syndicate) ^Act,

1988.

'

(2) ^It

shall^be

deemed to have come into

force on the

24th day ^of

December,

1987.

2.

Definitions.—-In

this

Act,—- (a)

"Gandhiji UniverSIty"

means the

Gandhiji University constituted under the

Gandhiji

Universfiy

Act,

1985

(12 ^of

1985):

(b)

"Senate"

and "Syndicate"

means^theSenate and the Syndicate ^ofthe

Gandhiji Univers1ty; (c)

"Vice-Chancellor" means^the

Vice-Chancellor of the Gandhiji University.

Dissolution

of

the Senate and the

Syndicate—Notwith- standing anythmg

contained^{in the}

Gandhiji University

Act,

1985

(12 ^of

1985), ^{on andfrom}

the^dateofcommencement

of this

Act, Ellie

Senate and the

Syndicate

shall,

by

virtue of

this

4.

Consequences of

Dissolution—0n the

dissolution

of the Senate and the

Syndicate

under section

3,

all the members of the Senate and the

Syndicate

shall be deemed to have vacated their offices as such.

5. Powers and

functions of

the

Senate and

the

Syndicate

to ^be exercised

by the

Vice-Chancelkrr.—All

or

any

of the powers and

the functions of

the Senate and

the

Syndicate except

the power of the Senate to review the action of the

Syndicate

as

provtded

in sub- section

(1)

of section

19

of

the

Gandhiji UniverSity

Act,

1985

(12

of

1985), may.

during

the interval between the' dlshOlutiOl'l of

the Senate and ^the

Syndicate

under section 3

and

the reconstitution of the Senate and the

Syndicate

in

pursuance

of

section

6,

be exercised and

performed,

as far as

may be,

and to such extent as the Govern- ment

may determine,

by

the

Vice-Chancellor.

6.

Reconstitution

of

the Senate

and the

Syndicate—The

Senate and the

Syndicate

shall

be reconstituted in

accordance with ^the provisions ^{of the}

Gandhiji University ^{Act. 1985(12 of}

1985),

within one

year

from the date

of commencement

of this Act. ^-

7. Removal

of difiiculties.—'(1)

If any difficulty

arises

in giving

effect ^tothe

provisions ^ofthis

Act,_ ^theGovernment^{may, as} occasion may require,

by

order,

not inconmstent

with

the

provisions ~of this

Act,

remove such

difficulty.

(2)

Every

order^madeunder

sub-section

(1)

shall^be published ^{in the}Gazette^and

shall, ^{assoonas may}be,

after ^{it is} made, ^he-laid before ^theState

Legislature. ^.

8.

Repeal

and

saving—(1)

The

Gandhiji

University

(Dissolu- tion of the Senate

and the

Syndicate)

Ordinance,

1987 (

7 of

1987),

is

hereby repealed.

(2)

Notwithstanding

such

repeal,

anything ^{done or}

any action taken under the said Ordinance

shall^bedeemed^to

have been done or taken under this

Act.
