THE ASSAM PROHIBITION OF SMOKING AND
NON-SMOKERS' HEALTH PROTECTION ACT, 1999.
AN
A C T
to provide for prohibiting of smoking in places of public works or use and in public service vehicles in the State of Assam and to make provision for other matters connected therewith. It is hereby enacted in the Fiftieth Year of the Republic of India, as follows :-

Dcf ini- 2. In this Act , unless th e co ntex t otherw ise require,
(a) "ad ver tise me nt" me ans and inc lud es any not ice , circ ular, wall paper, pam phle t, display on h oardin g, or any v isib le rep resentatio n mad e by means o f any other me ans of any light, sound, smoke , gas or any oth er means w hich h as the affect o f promotin g smo king and the ex pre ss io n 'a dv er ti se ' sh al l be co ns true d accordi ng ly;
(b) "authorised off ice r" me ans a perso n au tho rised under section 4 ;
(c) "Assam " means the State of Assam ;
(d) "Governm ent" means the Governm ent of Assam ;
(e) "pl ace of publ ic wo rk or use" me ans a place decla red as suc h un de r sec tio n 3 and inc lud es auditori a, hospi tal bu ild ing s, health insti tut ion s, am usem ent cen tre s, the atres, res tau ran ts, public off ices, cour t build ing s, educational ins titu tions , libr aries and the like w hich are vis ited b y general public b ut does not include any open p lace ;
(f) "Offic ial Gazette " means the Assam Gazettes.
(g) "public service vehic le" means a vehicle Act No. 59

(h) "rule" means the rule made under this A c t;
(i) "Smoking" means smoking of tcbacoo in any form wh eth er in the form of cigar ette, cig ar, bee dis or oth erw ise wi th the aid of a pipe, wrapper or any other in strumen ts.

4. (I) The Government may, by notification in the Official Gazette, authorise one or more persons who shall be competent to act under this Act.
(2) Every person authorised under sub-section Act No. 45
(i) shall be deemed to be a public servant of i8 60,
within the meaning of section 21 of the Indian Penal Code, 1860.
5. No person shall smoke in any place of public work or use.
6. Without prejudice to the provisions of the Motor Act No. 49
Vehicles Act 1988, no person shall smoke in aof 1988- public service vehicle.
7. Notwithstanding anything contained in any other law for the time being in force, no person shall advertise in any place of public work or use and any public service vehicle which may promote smoking, or the sale of cigarettes and beedis etc.
9. No person shall himsel f or by any person in his behalf, store, sell or d istribute cigarettes or beedis or any other such smoking substance within an area of one hundred metre around any col lege , school or educational institution.
10. The owner or manager or incharge of affairs of every place of public work or use and any public service vehicle shall display and exhibit a board at a conspicuous place or places in and outside the premises visited or used by general public prominently stating that place is a "No Smoking Zone" and that "Smoking is an offence".

(ii) sec tion 7, 8 or 9 shal l be p unishable with fine whic h ma y ex ten d to five hundred rup ees and in cas e of sec ond or subsequent off enc e, sha ll be punis hab le with im prisonm ent which may extend to th ree m onth s or w ith a minimum fine of five hundred ru pees, which may ex tend to one thousand rupees, o r wi th both.

13. (1) No cou rt, oth er than the co urt of a Judicial Mag istrate , sha ll take con gnizance of and an offenc e under this Act.
(2) N o c our t shal l take cong nizance or any offence under th is Ac t ex ce pt on a co mplain t in wr iting of an au thor ise d of fic er wi th respec t to of fen ce under sec tion 5, 6 and 10 and on a rep ort in wr iting of a po lice off ice r, no t below the rank of Sub-Insp ector with r espect to the offences under sectio ns 7 , 8 and 9.

The G overn me nt or any pe rson a uthoris ed by it by g eneral or special ord er in this behalf, may , either before or afte r the inst itut ion o f the proceedings, com pound any offences mad e pu nish able by or under th is Act.
(1) The Go vernmen t may make rule to pro vid e fo r or regu late any mat ter in respec t of which this Act makes no pro visio n or ma kes insu ffi cien t prov isi on and provis ion is, in its opinion , necessary .
(2) Any rule made b y the Government shall be sub jec t to prev ious publicat ion thereof in the O fficia l Gazette.
(3) Every rule mad e by the Go vernm ent under this Ac t shall be laid, as soo n as may be, aft er it is made, before the Assam Legis lative Ass embly w hile i t is in ses sion for a to tal per iod of thirty days w hich m ay be co m pr ised in on e se ss io n or more su cc es sive sessions. The State Legis latu re may agree tha t there should be mo dif ica tion in the rule or tha t the rule should not b e mad e. In tha t case th e rule s sha ll hav e eff ect only in suc h modif ied fo rm or be of no e ffec t, as the ca se may be. Any such mod ifi ca tio n or ann ulm ent shal l, how ever, be w ithout pre judice to the validity of anyth ing prev ious ly done und er that rules.
