for the exercise

of certain

additional functions

in. respect

of theservices of

local

authority

in

the State

of

Manipur by

the

Manipur

PublicService

Commission. Be it

enacted in

the

Sixty-fifth Year of

the

Republic

of India as follows:-

1.

Short title and

commencement.-

(1) .This

Act may be

called the Manipur Public Service

Commission

(Additional

Functions) Act,

2014.

(2) ^It

shall come

into

force on such

date as the State Government may, by notification in

the

Official

Gazette, appoint.

2.

Definitions.-. In

this

Act,

unless the context

otherwise

requires,- {a)

"appointment" means

direct appointment or

appointment

of an official

by promotion;

(b) "Commission" means

the

Manipur

Public

Service

Commission; (c)

"local

authority"' means local

authority as

specified

in

the Schedule

appended to this

Act;

(d) "State

Government" means the

Government of

Manipur.

3.

Functions of

the.

Public Service Commission in

respect

of services of the local

authorities.-

Notwithstanding anything contained in any law

relating

to appointment and

conditions of service of

employees

of

local

authorities,

-

(a) ^the

Commission shall

be the

authority competent

to

conduct examinations

for appointments to the services of a local

authority;

(b) ^theCommission shall ^be

consulted,--

(i) ^onallmatters

relating ^tomethods ^ofrecruitment ^toservices^and posts

under^alocal

authority ^{as maybe}

specified

by ^the

State Government;

(ii) ^onthe

principles ^tobefollowedⁱⁿ

making appointments ^to services and

posts

under^alocal

authority

and

In

making promotions and transfers

from^oneservice^toanother and^onthe

suitability

of candidates for such

appointments, promotions ^ortransfers; (iii} ^onall

disciplinary

matters

affecting ^a

person serving

under^a local

authority including

memorials^and

petitions relating ^tosuch matters who

is

appointed ^onthe local

authority ^onthe recommendation ^{of the}

Commission;

(c) ^itshall ^{bethe duty ofthe}Commission^toadvise^{on any}

matter^so referred to^themand^on

any

other matter

relating ^to

employees ^oflocal authorities which ^theGovernment may

refer^tothem:

Provided ^thatthe

State Government may make

orders

specifying ^the matters in which

either

generally ^orin

any particular

class of cases^orin

any particular

circumstances, ^itshall^notbenecessary^{for the}

Commission^tobe consulted.

(d) ^all

orders^made

under^the

proviso ^toclause ^{(c)by the}

State Government shall

be laid for^notless than fourteen

days

before the House of the

Manipur Legislative

Assembly ^{as soon as}

possible

after

they ^aremade and shall ^be

subject ^tosuch

modifications,

whether

by way of

repeal ^or amendment, ^asthe

House^ofthe

Manipur Legislative Assembly^maymake during ^thesession ⁱⁿwhich ^{they areso}laid.

4. Power to add^oromit from the

list of local

authorltv.c-

The

State Government may, if

satisfied,

that ^itis

necessary ^or

expedient may by notification in the Official Gazette add

to, ^orasthecase

may be, ^omitfromthe list ^of

local

authority specified ^intheSchedule.

5. Power to make

Rules.-

(1)

The Government

may, ⁱⁿconsultation

with the

Commission,

make rules ^for

carrying

out the purposes of this

Act;

(2) ^In

particular, ^and

without

prejudice ^tothe

generality ^ofthe

foregoing power, such rules^mayprovide ^for:

(a) ^the

procedure ^tobefollowed ^by the local authorities

for consultation ^{with the}Commission;

(b) any

matter which ^isincidental to ^ornecessary for,

the

purpose

of consultation ^withthePublic

Service Commission; (c}

mattersⁱⁿwhich ^itshall ^not be necessary

for the Commission ^to be consulted.

(3)

Every ^rulemade

under ^{this Act} shall ^be

laid, ^{assoon as maybe}

after ^itis made,

before^the

Manipur Legislative

Assembly while ^{itis in}session ^foratotal period ^of

fourteen^days

which^may be

comprised ^inonesession ^{orin two} successive

sessions, ^and

if,

before^the

expiry of ^thesession ⁱⁿwhich ^itissolaid, or the session immediately

following, the

Manipur legislative

Assembly

makes any modification ⁱⁿthe rule or decides ^thattherule should ^not be made,

the rule shall thereafter

have effect

only ⁱⁿsuch modified ^{form ornotbeof}

effect, as the case

may be;

so however that any such modification ^orannulment shall be without prejudice ^tothe

validity

of

anything previously done under
