NOTIFICATION

S.R.O. No.165/2018— Whereas, the draft of the Urban Local Bodies (Rehabilitation Assistance) Rules, 2018 was published as required by Section 22 read with Section 18 of the Odisha Municipal Services Act, 2016 (Odisha Act 7 of 2016) in the Extraordinary issue No. 59, dated the 16th January , 2018 of the Odisha Gazette in the notification of the Government of Odisha in the Housing & Urban Development Department No. 1170-HUD- MUN-ADM-176/2017/HUD., dated the 12th January, 2018 inviting objections and suggestions, from all persons likely to be affected thereby, on or before 12th February, 2018 ;
And, whereas, no objection or suggestion has been received in respect of the said draft within the date specified;
Now, therefore, in exercise of the powers conferred by Section 22 read with Section 18 of the Odisha Municipal Services Act, 2016 and in supersession of the Housing & Urban Development Department Resolution No.33359-Legis-I-28/91-HUD., dated the 19th August, 1991 except as respect things done and action taken, the State Government do hereby make the following rules to regulate recruitment to posts under different Urban Local Bodies as a measure of Rehabilitation Assistance, namely:—
1. Short title and Commencement.:— (1) These rules may be called the Urban Local Bodies (Rehabilitation Assistance) Rules, 2018.
(2) They shall come into force on the date of their publication in the Odisha Gazette.
2. Definition:— The words and expressions used in these rules shall have the same meaning as respectively assigned to them as in the Odisha Municipal Services Act, 2016 and rules made thereunder.

3. Application of the rules applicable to the Government employees:— The provisions of the O.C.S. (Rehabilitation Assistance) Rules, 1990 as amended from time to time shall, mutatis and mutandis, be applicable to a member of the family of the employees of the Urban Local Bodies who die while in service.
4. Issue of Instructions and removal of doubts:— (1) The Government in Housing & Urban Development Department may issue such instruction not inconsistence with the provisions of the Odisha Municipal Services Act and rules made thereunder, as they consider necessary, in order to carry out the provision of the rules made applicable under rule 3.
(2) In case of any doubt or difficulty arises, the matter may be referred to the Government in Housing & Urban Development Department for decision. [No.10370-HUD-13-LEGIS-67-POLICY-15-11/2018/HUD.]
