It is hereby enacted in the Eig hth Yea r of t he Republic of In di a as follows:—
1. Short tit le, extent and commencement.—(1) This Act may be called the Assam Land Rev enue Re-Assessment (Am endment) Act, 1957.
(2) It shall have the like extent as the Principal Act,
(3) It shall come into force at once.
2. Amendment of Section 2 of Assam Act VlH of 1936.—
Clause (XI) of Section 2 of the Principal Act shall be subs tituted by the following, na mely:—
" town land means any la nd w ithin an are a declared or deemed to be a munic ipa lity o r notified are a under the Assam Mu nic ipa l Act , 1923 (Assam Act I of 1923) and any oth er land which the Sta te Government may dec lare un de r the Assam L and and Revenue Regulat ion , 1886 (Regulatio n I of 1886) or under the provisions of this Act, to be town lan d" .
/ 3. Amendment of Section 11 of Assa m Act VIII of 1936.—
(1) In sub-section (2) of Section 11 of the P rin cip al Act , the figures "24"
and "40 " shall be sub stituted by the figures " 30" and " 50" respectively.
(2) Th e existing proviso under sub-section (2) of Section 11 of the Principal Act shall be substitu ted by the following, na m ely:—
" Provided th at for the purp ose of app lyin g this sub-section, any land which, in the opinion of the Sta te Government had, immedia tely before the settl ement, been held on concess ional terms or settled or used for special cult ivat ion or any villages which were imma ture at th e time of the last sett lement, shall be left ou t of account, and the limitat ions men- tion ed in sub-sec tion (2) shall n ot apply to such lands."
4. Amendment of Section 12 of Assa m Act VIII of 1936.—
Y /( l) In sub-section (1) of Section 12 of the Principal Act , the words
" assessment g rou p" shall be substituted by the word " village" , and the lett ers and figures " Rs.12" by the l ette rs and figures " Rs.15" .
(2) In sub-section (2) of Section 12 of the Princi pal Act for the letters and figures " Rs .12" wherever they occu r, the lette rs and figures
" Rs .15" shal l be substituted.
(3) Th e existing e xplana tion unde r Section 12 sha ll be sub stituted by the following proviso, namely :—
" Provided th at the concession m ent ioned in the sub-sect ion (1) above shall no t be ava ilab le for any lan d which, in th e opin ion of the State Government h ad , imm edia tely before the settl ement , been held on conces- siona l te ri rs or settled or used for special cul tiva tion ."
5. Amendment of Section 13 of Assam Act VIII of 1936.—
(1) In the proviso (i») to Section 13 of the Principal Act, after the words
" ind ust ria l purpo ses" and before the words " the assessment" , the following shall be inserte d, na mely:—
"or if the soil of any estate has permanen tly im pro ved or dete riorate d through causes beyond the control of th e settl ement ho lder" .
(2) At the end of the existing provisos to Section 13 of the Principal Act the following new proviso shal l be adde d, na mely:— (fit) that, if , a fter the expiry o f every fifteen years, the average level of prices of A gric ultu ral produce fo r the last fifteen years has , in the opinion of the Sta te Government c hanged by more than 25 p er cen t from the average price level of the period of fifteen years prec eding the last
a fifteen years, then the assessment may be revised at any time afte r the exp ira tion o f the last fifteen years by increasing or reducing the assessment accord ing as the prices rise or fall , in the ma nner set ou t be low:— Changes in prices Changes in Lan d Revenue

6. A m en dm en t o f S ec ti on 20 o f A ss am A ct VIII o f 1936.—
(1) In sub-section (2) of Section 20 of the Principal Act for the lette rs and figures "Rs. 12" the lette rs and figures "Rs. 15" shall be substitu ted and for clauses («), (Z>) and (c) the following shall be subst itu ted , na mely:—
" the enh ancement shall be effected gradually by trie nnial incremen ts each not exceeding 25 per cen t of the tota l en ha nc em en t:
Provided that in any case iit which the enh anc ement exgeeds 400 per cen t of the old revenue, the case shall be referred to the Sta te Go vernm ent for orde rs ."
(2) In sub-section (3) of Section 20 of the Princ ipa l Act the lette rs and figures " Rs.12" whereve r they occur shall be sub stituted by the lette rs and figures "Rs. 15" .
7. A m en dm en t o f Sec tion 26.— In Section 26 of the Principal Act, the comm a afte r the words " This Ac t" shall be sub stituted by a full stop and the rem ain ing pa rt o f the section dele ted.
