ASSAM ACT XVI OF 1968

(Received the assent of the Governor on the 20th June, 1968)

TH E ASSAM NON-AGRICULTURAL URBAN AREAS TENANCY

(AMENDMENT) ACT, 1968

[ Published in the Assam Gazette Extraordinary, dated the 22nd June 1968 ]

An Act further to amend the Assam Non "Agricultural Urban Areas Tenancy Act, 1955.

Preamble, Whereas it is expedient further to amend the Assam Non-Agricultural Urban Areas Tenancy Act, 1955 hereinafter called the principal Act, in the manner hereinafter appearing ;

I t is hereby enacted in the Nineteenth Year of the Republic of India as follows:—

Short title,

extent and

commence- ment. 1. (1) This Act may be called the Assam Non- Agricultural Urban Areas Tenancy (Amendment) Act, 1968.-

(2) I t shall have the like extent as the princi- pal Act.

(3) I t shall come into force at once. Amendment 2. In section 5 of the principal Act, in sub-section of section 5 (■jx a t t fie e n j o f clause (a), the following provisos shall Ac?XH of be added, n am ely ;-

''Provided that whe_e .a .tenant- having built a

permanent structure -within the period specified above and for anv of the purposes mentioned therein, renews

the tenancy on expiration of the original contract, he shall always be deemed'to have built such permanent

structure within the period of five years from the date of the renewed contract:

Provided further that a .person having a right, title

and interest over a permanent structure by whatever

mode of acquisition he may have taken the tenancy

from the landlord of the land wherein the said

structure stands, shall not be ejected except on the

ground of non-payment of rent.'"
