further to am end the Gauhati University Act, 1947. Preamble Whereas it is expedient further-to amend the GauhatiUniversity Act, 1947, hereinafter referred to as the principal Act, in the manner herein after appearing;

It is hereby enacted in the Sixty-fourth Year o f the Republic o f India, as follows:-.
Short title,
extent and
commencement
1. (I) This Act may be called the Gauhati University (Amendment) Act, 2013,
(2) It shall have the like extent as the principal Act.
(3) It shall come into force at once. Amendment of 2. In the principal Act, in section .36, in the marginal note and in section 36 sub-section (1 J, the word and punctuation mark "pension", shall be deleted.
Insertion o f 3 . In the principal Act, alter section 36, the following new section section 36A 36A shall be inserted, namely:-

"Pension and Family Pension 36A(I) The existing permanent employees o f the University, both teaching and non-teaching, who have entered service before 1-2-2005, shall be eligible for pension on their retirement from the service o f the University with effect from the 1" day of April.2013:
Provided that these employees o f the Universify who entered service before 1-2-2005 and who have expired before coming into force of this Act shall be entitled to receive family pension, under the provision o f this A c t:
Provided further that those employees of the University who have entered service on or after 1-2-2005 shall be covered under the new Pension Scheme introduced- bv the State Government.
(2) The Universify shall regulate The matter regarding their employees by such Authority as may be determined by the University:
Provided that granting and eligibility o f pensionshall be guided by the Assam Services (Pension) Rules, 1969.
(3) Pension under this section shall include Superannuation pension and Family pension only and does not include Gratuity."
Insertion o f new 4. In the principal Act, after section 43, the following new section section 44 44 shall be inserted, namely:-
