THE JAMMU AND KASHMIR GOVERNMENT

GAZETTE, ACT 1945 (1888 A. D.)

( Act No. XII of Samvat 1945)

[Sanctioned by His Highness the Maharaja Sahib Bahadur in Council on 14th Phagan, 1945].

Whereas it is expedient for the better administration to start the publication of Government Gazette within the State, His Highness in Council is pleased to command as follows :--

1 . Title.-- This Gazette shall be called the1 [Jammu and Kashmir Government Gazette].

2 . Day of publication.--It shall be2 [published every week on Monday unless3[the Government] fix any other day in this behalf.

3 . What it will contain.--There shall be published in the Gazette all Aims and Orders relating thereto duly passed by3[the Government], all Departmental Orders, Notifications and Circulars, appointments of Gazetted Officers and their transfers, leaves, dismissal and suspension. 4. Parts of the Gazette.--4[This Gazette will have as many parts as necessary.] 5 [x x x x x] 5. Responsibility of Officer-in-charge of Press.--The Officer- in-Charge of the Press, shall be responsible for the proper and timely publication of the matters pertaining to each department and for the 6 [correct reproduction] of every order printed therein. 1. Title of the Gazette was substituted by Notification I-Lof Samvat 1982 published in Govern- ment Gazette dated 5th Jeth 1982 for "State Gazette". 2 . The day of issue of Gazette is Thursday now by Finance Department Notification No. 21, dated 4th July, 1927 published in Government Gazette dated 10 thSawan, 1984.

3 . In sections 2 and 3 for the words "His Highness in Council" the words "the Government" substituted by Act X of Samvat 1996.

4 . The present arrangement of the Gazette is different. 5 . Paragrapgs second, Third, Fourth and Fifth of section 4 omitted by A.L.O. 2008. 6 . Substituted by Act VI of 1959 for "correctness".

6. Charges for publication of Civil Court notices.--1[The notices issued by the Civil Courts in pursuance of the provisions of the law in force may be published subject to the payment of the charges at the rate of2[twelve naya paise per line per insertion or at such rate as may be determined by the Government from time to time]. The charges shall be realised by the Civil Courts from the person at whose request a notice is issued and amount realised shall be remitted to the Superintendant Press.

7. Private publications.--1[Any member of the public may, on an application to the Officer-in-Charge of Press, get his advertisements pub- lished on payment of the charges at the rate of3[twelve naya paisa per line per insertion or at such rate as may be determined from time to time].

8. Officers to whom Gazette shall be supplied free.--3[Copies of the Government Gazette shall be supplied free of charge to such officers and departments as the Government may direct].

9. Annual subscription.--4[Any person may subscribe to the Gov- ernment Gazette on payment of subscription charges at a rate to be deter- mined by the Government from time to time].

10. Publication of Government orders.--All orders on the annual reports of4[Departments of the State passed by5[the Government,] shall be published in the Government Gazette, if their publication is sanctioned by 5 [the Government].

11. Presumption Proof.--Every entry in the Gazette shall be presumed to have been made under the orders of a competent authority. An order published in the Gazette may be proved to have been issued by the production of a copy of the Gazette in which it may be found printed.

12. Government to frame rules.--The6[Government] shall frame proper rules for the regular publication of the Gazette. 7 [x x x x].
