Uttaranchal Panchayat (Amendment) Act, 2002*

An Act To amend the Uttar Pradesh Panchayati Raj Act, 1947 and Uttar Pradesh Kshetra Panchayat & Zila Panchayat Act, 1961 its applicaton to Gram Panchayat, Kshetra Panchayat & Zila Panchayat respectively.
Section 1. Short title, extension and Commencement

1. Short title, extension and Commencement.- (1) This Act may be called the Uttaranchal Panchayat (Amendment) Act, 2002.
(2) It shall be applicable to the whole State of Uttaranchal.
(3) It shall be deemed to be enacted October 28, 2002.

CHAPTER-2
2. After the section 12, 8, & 20 respectively of Uttar Pradesh Panchayat Raj Act, 1947 Uttar Pradesh Kshetra Panchayatand Zila Panchayat Act, 1961 (as Adapted and Modified in its application to Uttaranchal State) sub-section (3-A) shall be deemed to be amended as follows, namely:
(3-A) Notwithstanding anything contained in any other provisions of this Act, where due to unavoidable circumstances or in public interest, it is not practicable to hold an election to constitute a Gram Panchayat, Kshetra Panchayat & Zila Panchayat before the expiry of its duration and extended term of six months the State Government or an officer authorized by it in this behalf may, by order, appoint an administrator who shall hold office for such period not exceeding six months as may be specified in the said Order and all powers, functions and duties of Gram Panchayat, Kshetra Panchayat & Zila Panchayat respectively its Pradhan, Pramukh & Adhyaksh and Committees shall vest in and be exercised, performed and discharged by such Administrator.
Section 3
3. The Uttaranchal Panchayat (Amendment) Ordinance, 2002 (Ordinance no. 6 of 2002) is hereby repealed.
